Whether police need a warrant can depend on the state, whether the data is held by an agency or a private company, and how much location history the query reveals. A court’s ruling on the Fourth Amendment also does not override separate state laws governing access, retention, sharing, or use.
What kind of license-plate-reader data are police seeking?
An automatic license plate reader (ALPR) captures an image of a vehicle’s plate and can associate a scan with a time and place. A single observation—or an alert that a vehicle passed one camera—is different from searching stored records to reconstruct where a vehicle traveled over an extended period.

That distinction matters because the legal question is not simply whether a plate could be seen in public. The number and placement of cameras, the period covered, whether police are querying historical records or receiving a real-time alert, and the movements the results reveal can all affect the analysis. The decisions discussed below do not establish a nationwide camera-count or time-period threshold.
What do the court decisions say?
Massachusetts: limited bridge-camera records did not amount to a search in this case
In Commonwealth v. McCarthy, 484 Mass. 493 (2020), the Massachusetts Supreme Judicial Court considered four fixed readers at two bridges leading to Cape Cod. Police reviewed records covering how often the defendant crossed the bridges during a three-month period and also received real-time alerts.

The court recognized a protected interest in “the whole of [a person’s] public movements,” which widespread ALPR deployment could implicate. But it concluded that the limited camera placement and use before it did not reveal a sufficiently detailed mosaic of location information. On those facts, the use was not a search under the Fourth Amendment or Article 14 of the Massachusetts Declaration of Rights.
The court’s conclusion was expressly limited: “We conclude that, while the defendant has a constitutionally protected expectation of privacy in the whole of his public movements, an interest which potentially could be implicated by the widespread use of ALPRs, that interest is not invaded by the limited extent and use of ALPR data in this case.” McCarthy is a Massachusetts decision, not a rule for every state or every ALPR search.

Ninth Circuit: United States v. Yang did not settle the broader question
In United States v. Yang (9th Cir. 2020), the Ninth Circuit affirmed the denial of a suppression motion based on the record in that case. It found no reasonable expectation of privacy in the particular historical location data at issue, while declining to resolve the broader Fourth Amendment question about warrantless ALPR use. The decision does not establish that every ALPR database query is constitutional without a warrant.
How do state statutes change the answer?
State laws can impose rules independent of constitutional decisions. They may govern agency policies, permitted purposes, retention, sharing, and access to records. These examples illustrate different controls; they are not a survey of every state.

| Authority | What it addresses | What it means for warrant questions |
|---|---|---|
| North Carolina statutes | Require state and local agencies using ALPRs to adopt written policies covering matters such as databases, retention, sharing, training, security, access, and audits. Covered data may be accessed, preserved, obtained, or disclosed only for law-enforcement purposes and may not be used to enforce traffic violations. A related provision regulates disclosure of preserved data. | The provisions described here set purpose, policy, and disclosure limits; they do not establish a universal warrant rule for every ALPR query. A separate preservation process limits disclosure to specified criminal-justice officials for a legitimate law-enforcement purpose pursuant to a written agency request. |
| Washington statutes | Generally limit retention of ALPR data to 21 days, with exceptions including specified court-authorized retention, parking enforcement, traffic studies, commercial-vehicle enforcement, and evidence of specified unlawful conduct. | The same chapter requires an agency to obtain privately held ALPR data only under a valid, court-issued probable-cause warrant. That rule applies to Washington; it should not be assumed to apply in other states. |
Statutory requirements can regulate data even when a court has not found a constitutional warrant requirement on the particular facts before it. Conversely, a statute that sets retention or agency-policy rules does not by itself answer every constitutional question about a specific search.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Does a private company have to turn over its ALPR records?
There is no single answer established here for every state. Washington expressly requires a valid, court-issued probable-cause warrant before an agency obtains privately held ALPR data. The cited examples do not establish that every state imposes the same requirement. The state where the data is held and the law governing the agency’s request matter.

It also helps to distinguish obtaining stored records from receiving an alert generated when a vehicle passes a camera. The authorities described here do not supply a nationwide rule covering every type of private-company access, request, or real-time alert.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesDoes an ALPR alert by itself authorize a traffic stop?
The court and statutory examples above do not establish a nationwide rule for stops based on an ALPR match. Whether officers may stop a vehicle—and whether a stop or any later search is lawful—requires a separate analysis under the applicable law and facts. An ALPR hit should not be treated as automatically authorizing a stop or search.
What should someone do if police used ALPR data?
If ALPR evidence is involved in an investigation or case, a lawyer familiar with the relevant jurisdiction can assess the specific query and the law that applied. Useful questions include:
- Was the record a single scan, a real-time alert, or a search of historical records?
- How many locations and what period did the query cover, and what movement pattern did it reveal?
- Was the data held by a government agency or a private company?
- What state statutes govern access, retention, sharing, and the purpose of use?
- Which court decision controls in the jurisdiction, and does it address comparable facts?
Neither McCarthy nor Yang guarantees that evidence will be admitted or suppressed in a different case. Their holdings are tied to their records and do not resolve every state-law or constitutional issue.
