Indian businesses can use AI without sending sensitive information to an overseas API by running inference on premises or in a suitably configured India-hosted environment, or by minimising information before sending it to an external service. The key is to check the whole data path—not just the API’s advertised region—because prompts, logs, backups, support access and subprocessors may be handled in different places.
Whether a particular approach is lawful depends on the data, purpose, sector-specific rules, contracts and the provider’s actual configuration. The Digital Personal Data Protection (DPDP) Act, 2023 does not create a blanket India-only transfer rule for all personal data, but stricter laws and government restrictions can still apply.

What the DPDP Act says about sending personal data abroad
Section 16 of the DPDP Act, 2023 allows the Central Government to restrict, by notification, the transfer of personal data by a Data Fiduciary for processing to a country or territory outside India. The section also preserves any Indian law that provides a higher degree of protection or imposes greater restrictions on transfers. In other words, the Act’s general transfer framework is not itself a blanket rule that all personal data must stay in India.
The phrase “sensitive personal data” is often used in business discussions, but the Section 16 material described here addresses personal data generally. A company should not assume that applying or avoiding the “sensitive” label decides which transfer rules apply. The relevant question is what data is being processed, under which law and for what purpose.

The Government of India notified the DPDP Rules, 2025 on 14 November 2025, according to a Press Information Bureau release dated 17 November 2025. The release describes the framework for organisations’ collection and use of digital personal data and identifies Data Fiduciaries and processors. It also reports 6,915 consultation inputs; that figure concerns consultation on the Rules, not AI use or cross-border compliance. The Act, applicable Rules, notifications and any stricter law governing the business are the controlling materials.
When other rules can change the answer
A business must check sector-specific requirements rather than rely on the general DPDP framework alone. Payment businesses, for example, should verify current Reserve Bank of India requirements. An RBI FAQ search result describes domestic payment-system data as subject to storage in India, with limited provisions for certain overseas processing and cross-border payment transactions. Because the current detail should be checked against the RBI’s operative requirements, payment firms should verify the rule and its application before sending payment-related data to an AI service.
Contracts can add obligations too. A customer agreement, confidentiality clause, data-processing agreement or internal policy may limit where information can be processed even when a general statute does not impose an India-only requirement. Legal review should consider the organisation’s actual data flows and obligations, not just the provider’s marketing language.

Which AI deployment pattern fits your data?
There is no universal best option. Compare the arrangements against data location and access, retention and training controls, model capability, latency, total cost, operational burden, auditability and sector-specific fit.
| Approach | How it limits exposure | What to assess |
|---|---|---|
| On-premises or private local inference | Prompts can remain within infrastructure controlled by the business. | Network routes, telemetry, administrator and support access, compute capacity, model quality, operating cost, security and maintenance. |
| India-hosted cloud or managed AI | May reduce cross-border exposure if the full service configuration and its subprocessors are verified. | Prompt and output processing, logs, backups, support access, subprocessors, retention, training use and contractual commitments. |
| External API with data minimisation | Sends less information by removing or replacing fields not needed for the task. | Whether the remaining details can identify a person or disclose protected business information, and whether applicable legal and sector requirements are met. |
On-premises or private local inference
Keeping inference on infrastructure controlled by the business can suit workloads that should not be sent to an external API. “Local” is not an automatic guarantee: outbound network connections, telemetry, remote administration and support arrangements can still expose information. The business also takes on responsibility for suitable compute, security, model operations and maintenance.
An Office of the Principal Scientific Adviser paper dated 29 December 2025 discusses AI-oriented infrastructure, the MeitY-supported MeghRaj government cloud and domestic data-centre capacity. It reports that Yotta H1’s initial phase had 4,000 GPUs and that Yotta operates a 72 MW IT-load data centre in Navi Mumbai. These infrastructure examples do not establish that a specific commercial model or API is available there, or that a particular business’s prompts will stay in India.
India-hosted cloud or managed AI
A service hosted in India may be a practical middle ground, but an Indian endpoint or data-centre address does not prove that every part of the service operates in India. Confirm where prompts and outputs are processed, and separately check logs, backups, support access and subprocessors.

Government materials describe India-based cloud and AI infrastructure. A PIB Budget 2026–27 backgrounder published 14 February 2026 describes a proposal for a tax holiday through 2047 for eligible foreign cloud providers using India-based data-centre infrastructure. It also reports, citing UNCTAD 2025, that data centres accounted for more than one fifth of global greenfield project values in 2025, with announced investment exceeding USD 270 billion. These policy and global investment figures indicate infrastructure activity, not a residency commitment or privacy outcome for any AI plan.
External API with minimised data
If a business uses an external API, it can reduce exposure by sending only the fields required for the task. Depending on the use case, that may mean removing direct identifiers, masking or tokenising fields, or using synthetic or de-identified examples. Before sending a transformed prompt, check whether the remaining details could still identify a person or reveal confidential business information. Masking or pseudonymising data is not necessarily the same as anonymising it, and no technique is automatically sufficient for every legal or contractual obligation.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to verify before sending real prompts
Obtain written answers for the exact plan, tenant and configuration the business will use. A region selector alone is not enough. Ask the provider:
- Where are prompts and responses processed?
- Where are logs, abuse-monitoring records and telemetry stored, and how long are they retained?
- Where are backups and disaster-recovery copies kept?
- From which locations can administrators, support staff and subprocessors access customer content?
- Is customer content used to train or improve models? If so, what controls or opt-outs apply?
- What deletion and export controls are available, and when do they take effect?
- What contractual commitments govern these matters, and how will the provider notify customers of material changes?
Map the answers to the data categories the business intends to use, its purposes, contracts, sector rules and applicable government notifications. If the provider cannot substantiate a location or control that matters to the business, do not treat it as verified.
A practical way to choose
- Classify the proposed input. Separate personal data, regulated data, confidential business information and material that can safely be made synthetic or public.
- Check the governing rules. Identify applicable DPDP requirements, government notifications, sector rules and contract terms before selecting a provider.
- Choose the least-exposing workable route. For highly restricted workloads, assess local inference; for managed deployment, verify the full India-hosted service path; for other tasks, consider sending a minimised prompt to an external API.
- Test with non-sensitive examples first. Confirm how the workflow behaves and what data it emits before introducing production information.
- Record the configuration and reassess changes. Keep the provider’s written answers and internal data-flow decision, then revisit them when the plan, subprocessors, processing regions or applicable rules change.
India’s National Data Governance page, maintained by NeGD, describes a government data-sharing framework approved on 15 May 2026 and lists platforms including AI Kosh and API Setu. Its emphasis on consent mechanisms, de-identification, safeguards and governance concerns government data-sharing arrangements; it does not give private businesses general permission to export personal data or certify a commercial AI API.
No general infrastructure figure can answer where a specific AI product processes prompts or stores its logs. That answer remains specific to the provider, plan, configuration and business use.
