That does not automatically give the lab an unlimited veto over every finding. The answer depends on the signed agreement, the information involved, applicable law, and any safety, privacy, or security duties. Public principles and program descriptions may express intended practice, but the executed contract controls a particular engagement.
Start with the executed agreement
The first document to analyze is the agreement actually signed by the evaluator and the lab. A web page describing a testing program, a request for proposals, or a policy statement may be useful context, but it may not create enforceable publication rights.

OpenAI’s Economic Research Exchange request for proposals, issued June 8, 2026, illustrates the distinction. It says, “Researchers will retain independence in study design and analysis.” It also says that external publication or public use of findings will be coordinated with OpenAI to address accuracy, privacy, legal compliance, and appropriate context. The RFP describes itself as informational and preliminary, creates no binding obligation, and says obligations arise only after execution of a definitive written agreement.
That combination is not contradictory. A program can promise a principle of independence while reserving details for a later contract. Before beginning work, an evaluator should obtain the final agreement, every incorporated policy, and any amendments or order forms. A description on a public site cannot safely be treated as a substitute.

What a confidentiality clause can cover
Confidentiality language normally defines the information that cannot be disclosed and the period for which the duty lasts. The important question is whether the definition reaches only material supplied by the lab or also reaches the evaluator’s results, model outputs, analyses, and derived findings.
OpenAI’s external-testing example
OpenAI’s published external-testing agreement provides a concrete example. It states that covered information is generally subject to confidentiality for two years. Trade secrets remain confidential for as long as they continue to qualify as trade secrets.
The same agreement describes an exception for information included in a researcher’s noncommercial research or academic publication. The information may fall outside the confidentiality obligation to the extent that OpenAI approved it in writing before publication or it results from a version of OpenAI technology made generally available to the public. The language distinguishes publicly available model versions from nonpublic versions and their outputs.
This is an example of a contract balancing confidentiality with publication. It is not evidence that every evaluator signs those terms, that the terms are an industry standard, or that the exceptions override another clause or applicable law. The precise definitions, exclusions, and hierarchy of documents in the agreement still matter.
Definitions to check line by line
- Covered information: Identify source code, model weights, prompts, logs, documentation, user data, security details, and other material the lab labels confidential.
- Evaluator-created material: Check whether test results, transcripts, statistical analyses, screenshots, and conclusions are owned by or restricted by the lab.
- Public information: Look for exclusions covering information already public, lawfully received from another source, independently developed, or obtained from a generally available model version.
- Derived information: Ask whether a finding inferred from public behavior is treated differently from a finding that reveals a nonpublic system detail.
- Survival: Separate the ordinary confidentiality term from indefinite treatment of trade secrets, personal data, security vulnerabilities, or other protected categories.
Review is not automatically a veto
A contract can give a lab a prepublication review without giving it unlimited editorial control. Those are different mechanisms:

| Mechanism | What it usually addresses | Question to ask |
|---|---|---|
| Factual review | Errors about the system, dates, tests, or results | Can the lab request corrections, or can it block release? |
| Confidentiality review | Nonpublic information covered by the agreement | Are only specific passages removable, or can the entire report be withheld? |
| Privacy review | Personal data, user records, or identifying details | What redaction standard and evidence apply? |
| Security or safety review | Details that could enable misuse or expose an unresolved vulnerability | Is there a defined delay for remediation, and who decides when it ends? |
| Editorial approval | The lab’s control over wording, interpretation, or conclusions | Does the agreement expressly grant a veto, or only a bounded review right? |
OpenAI’s published third-party assessment principles recommend mutually agreed scopes and clearly defined claims, proportionate access, enforceable confidentiality protections, a reasonable remediation period where appropriate, and reports shared as openly as possible while protecting sensitive and confidential information. They also state: “Assessors should maintain editorial independence, while ensuring that confidentiality and IP protections are maintained.”
The principles describe a model in which a lab can request correction of inaccuracies or redaction of sensitive information while the assessor retains editorial independence. They do not, by themselves, determine the legal publication right in every separate agreement. The operative language could instead require approval, permit delay, or impose a different process.

How to read a publication clause
Publication by default
The most evaluator-friendly structure permits publication after a short review period unless the lab identifies a contractually recognized problem. The agreement should say whether silence is consent and should prevent an open-ended review.
Publication after approval
Some agreements require written approval before release. If that is the structure, the contract should define the decision-maker, permissible grounds for refusal, response deadlines, and a dispute route. Without those limits, an approval requirement can function like a broad veto.
Publication with redactions
A narrower arrangement lets the evaluator publish but allows removal of specified confidential, personal, security-sensitive, or legally protected material. The evaluator should be able to describe that material’s removal and explain how it affects the conclusions, provided the disclosure itself does not reveal the protected information.

Publication after a safety delay
A safety extension can be legitimate when immediate disclosure would expose a vulnerability or enable misuse. It should be tied to a concrete remediation process, a named contact, and an endpoint. The public principles support open reporting and redaction processes, but the available primary examples do not establish a universal number of days for review or delay.

Publication language is only one part of independence. The AI Evaluator Forum’s AEF-1 framework identifies five operating dimensions:
- Sufficient access and resources: The evaluator needs the model versions, interfaces, documentation, time, compute, and records necessary to test the claims.
- Minimized conflicts of interest: Payment arrangements, ownership ties, contingent compensation, and other commercial relationships should be disclosed and managed.
- Analytic autonomy: The assessor should control scoping, evaluation choices, direct access where agreed, analysis, and conclusions.
- Transparent methods and results: Readers should be able to understand what was tested, how it was tested, and what limitations apply.
- Protection of sensitive information: Security, privacy, and confidential material need safeguards that do not silently erase the substance of a finding.
Under analytic autonomy, AEF-1 specifically lists scoping, evaluation autonomy, direct access, and editorial control. The Forum’s page says the European AI Office endorsed key provisions as a means of complying with independence provisions of the General-Purpose AI Code of Practice. That is the Forum’s description of the endorsement; it should not be treated as an independent determination of the Code’s legal effect.
Do not confuse different kinds of public commitments
Several public documents may use the word “independence,” but they address different relationships.
| Document or policy | Relationship covered | What it establishes |
|---|---|---|
| External-testing agreement | Outside tester working under contractual access | Specific confidentiality duration and a described publication exception for qualifying noncommercial or academic material |
| Third-party assessment principles | Recommended structure for independent assessments | Open sharing where possible, redaction of sensitive information, correction of inaccuracies, and assessor editorial independence |
| Economic Research Exchange RFP | Prospective economic researchers | Independence in study design and analysis, coordinated public use, and no binding obligation until a definitive agreement is signed |
| Employee safety commitments | Workers and internal governance | Separate promises about raising concerns or enabling external research; not an outside evaluator’s publication clause |
| Sharing and publication policy | Researchers using an API | Welcome for related publications and a request to report safety or security issues through coordinated disclosure; not a guarantee under every access agreement |
A 2024 compilation of frontier AI safety policies reproduces Anthropic’s commitment not to impose employee non-disparagement obligations in a way that could impede or discourage employees from publicly raising safety concerns. It also reproduces an OpenAI Preparedness Framework commitment to enable external research and government access for testing. Those commitments concern employees and governance policy, not the rights of an independent evaluator hired or granted access under a separate contract.

OpenAI’s sharing and publication policy welcomes research publications related to the OpenAI API and asks researchers to report safety or security issues through its coordinated vulnerability disclosure program. It also says the company may take appropriate action to protect users in security- or misuse-related cases. Treat that as a public policy statement rather than a promise that every separate agreement permits unrestricted publication.
Contract checklist before accepting an evaluation
Use this checklist during negotiation, and obtain advice from qualified counsel when the stakes or jurisdiction require it.
- Map the information flow. List what the lab supplies, what the evaluator creates, what is public, and what may identify users or expose security weaknesses.
- Define confidentiality precisely. Mark exclusions for public, independently developed, and lawfully received information. Separate ordinary confidential information from trade secrets and personal data.
- Choose the publication model. State whether publication is allowed by default, requires approval, or is allowed after a review period.
- Limit review grounds. Tie review to factual correction, privacy, security, legal compliance, and specifically identified confidential material. Say whether review is advisory or can delay release.
- Set deadlines. Include a concrete review window and a narrowly defined extension for urgent safety or security remediation. The examined public sources do not establish a universal deadline, so the contract must supply one.
- Protect redaction transparency. Specify what may be removed, the standard for removal, how disputes are handled, and whether the evaluator may publish a redaction notice describing the effect on its analysis.
- Preserve analytic control. Confirm that the evaluator controls methods, analysis, conclusions, and wording, subject only to the agreed confidentiality and safety limits.
- Lock down access and scope changes. Pre-register questions and claims, define access and resource expectations, and create a route to expand testing when a serious issue falls outside the original scope.
- Create an urgent-reporting route. Separate public publication from confidential escalation to a security, safety, or oversight contact. Make immediate reporting procedures clear for vulnerabilities or imminent risks.
- Disclose compensation and conflicts. State who pays, whether payment depends on results, and what other relationships could affect perceived independence.
What to do when a lab requests changes
Ask for the contractual basis
Request the exact clause supporting each requested correction, redaction, delay, or withdrawal. A general statement that material is “sensitive” is not the same as an identified contractual category.
Separate errors from disagreement
Correct a demonstrable factual error. Treat a dispute over interpretation, severity, or policy preference as an editorial disagreement unless the contract expressly gives the lab authority over the conclusion.

Preserve an audit trail
Keep dated drafts, review comments, response deadlines, and the final disposition of each requested change. That record helps demonstrate what was changed and why, and it supports a transparent redaction notice when publication is permitted.

Use confidential escalation for immediate risk
Do not publish exploit instructions, personal data, or details that could create imminent harm merely to establish independence. Use the agreement’s urgent channel, coordinated vulnerability disclosure process, or an appropriate oversight contact while seeking a defined remediation timeline.
How to compare two engagement offers
When evaluating different programs or contracts, compare the same dimensions rather than relying on labels such as “independent” or “external.” The available public examples differ in kind—a testing agreement, assessment principles, and a research RFP—so they should not be treated as identical contract forms.
| Comparison axis | What a strong agreement makes clear |
|---|---|
| Default publication rule | Whether publication is allowed automatically, after review, or only with prior approval |
| Lab’s authority | Whether the lab has a veto, a bounded redaction right, or only a factual-review role |
| Review timing | The response deadline and any narrowly defined safety extension |
| Confidentiality | Covered categories, exclusions, ordinary duration, and trade-secret survival |
| Evaluator control | Control over methods, analysis, conclusions, and final wording |
| Access | Relevant model versions, systems, records, interfaces, and resources |
| Transparency | Disclosure of redactions, conflicts, funding, and material limits on the work |
| Urgent escalation | A confidential route and timing for vulnerabilities, safety issues, or imminent risks |
Legal limits and jurisdiction
Whether a restriction is enforceable depends on the governing law, contract language, the type of information, and the facts of the dispute. A clause may interact with privacy, whistleblower, research, public-records, export-control, employment, or security-disclosure rules. This guide cannot determine how a court would interpret a particular agreement or whether a statutory protection applies.
That uncertainty is why categorical claims are unsafe. It is too broad to say that a lab can always suppress publication, and equally broad to say that an evaluator always has a legal right to publish. The reliable answer is conditional: read the signed agreement, identify the information and review mechanism, check applicable law, and preserve a route for urgent confidential reporting.
