Yes. AI image generators can create images that evoke recognizable features associated with living artists. In the United States, however, an artist’s style is not automatically the same thing as a copyrighted work, and the legal answer can change if an output copies protected expression, falsely suggests the artist made or endorsed it, or realistically replicates the person. The ethical questions—permission, market impact, and respect for an artist’s identity—are related but distinct.
What does it mean for an AI image to imitate an artist?
A prompt asking for an image “in the style of” a living artist is asking a generator to evoke a recognizable visual approach. The result may recall features associated with that artist, but that does not by itself establish that it copies a particular protected work or that the artist created or approved it.

Those distinctions matter. “Style,” “copyright infringement,” “false attribution,” and a realistic digital replica are not interchangeable legal categories. The U.S. Copyright Office’s 2024 report, Copyright and Artificial Intelligence, Part 1: Digital Replicas, discusses these issues separately and does not recommend treating style itself as protected subject matter under a federal digital-replica law.

Is an artist’s style protected by U.S. copyright law?
The Copyright Office’s position in its July 31, 2024 Part 1 report is that style itself should not be added as protected subject matter under a federal digital-replica law. That is not a blanket ruling that every image generated in an artist’s style is lawful. Copyright questions can still turn on whether an output reproduces protected expression from a specific work.

There may also be other legal routes. The Office notes that some state right-of-publicity statutes, or common law, may protect a style closely identified with an individual performer. It describes this area as not fully developed. The report also distinguishes a request to stop use of an artist’s name alongside generated material from its focus on realistic image or voice replicas; false or confusing use of a person’s name may raise separate issues under existing protections.
These are U.S.-focused observations, not a global rule. Rights and exceptions differ by jurisdiction, and the cited Office materials do not provide a comparative account of other countries’ laws. A particular dispute depends on its facts and applicable law; the report does not resolve every artist-style prompt in advance.
Why training and generated images raise separate questions
Whether copyrighted works may be used to train a model and whether a particular generated image infringes copyright are related but separate questions. The U.S. Copyright Office’s Copyright and Artificial Intelligence, Part 3: Generative AI Training discusses training through the fair-use framework, including potential market effects. Its cited version was a pre-publication report released May 9, 2025. It does not establish that every training use—or every output—is lawful or unlawful.

The report describes safeguards used by developers, including input filters, training techniques, system prompts, and output filters. It also says their effectiveness is factually disputed. A filter’s existence therefore does not, on its own, prove that a system prevents imitation or resolves copyright concerns.
The report discusses possible competition with creators and lost licensing opportunities in the training context. Those are potential market effects considered in the analysis, not quantified findings about how much any particular artist has lost. The Copyright Office’s AI study page also reported that it received more than 10,000 comments by the December 2023 submission deadline; that is a count of submissions, not a poll or evidence of public consensus.
Can a person copyright an image made with AI?
AI-generated output may qualify for copyright protection when a human author determines sufficient expressive elements. In its January 29, 2025 release summarizing Part 2 of its AI report, the Copyright Office says that merely providing prompts is not enough by itself to establish human authorship.

Human creative contributions may matter when they are perceptible in the output or when the person creatively arranges or modifies material. Including AI-generated material in a larger human-created work does not automatically prevent the larger work from being copyrightable. The question is what expressive elements a human actually determined, rather than whether an AI tool was used at all.
“Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”
That statement is from Shira Perlmutter, Register of Copyrights and Director of the U.S. Copyright Office, in the Office’s January 29, 2025 Part 2 release.

How attribution, false endorsement, and digital replicas differ
The Copyright Office’s 2019 overview, Authors, Attribution, and Integrity: Examining Moral Rights in the United States, describes moral rights as personal, non-economic interests that include being credited as an author and preventing prejudicial distortions of a work. It characterizes U.S. protections as spread across federal and state laws, with important protections as well as room for improvement. The report discusses possible legislative changes involving the Visual Artists Rights Act, the Lanham Act, and copyright-management-information protections.
- Naming an artist as inspiration: This identifies a reference point; it does not mean the artist made the image.
- Implying the artist created or endorsed it: A false or confusing claim about authorship or approval raises a different issue from using a style reference.
- Copying a specific work: The copyright question concerns whether protected expression from that work was reproduced, not merely whether the result has a similar general look.
- Creating a realistic replica: A realistic image or voice replica implicates identity-related concerns distinct from a general style imitation.
The applicable legal route depends on the conduct and circumstances. The Copyright Office’s materials do not establish a universal, standalone federal right to control every reference to a person’s style.

What are the ethical risks of imitating a living artist?
Even where a legal claim is uncertain, a style imitation can raise questions about consent, livelihood, credit, and reputation. The Copyright Office’s Part 1 report records stakeholder concerns that generators could produce large volumes of work evoking a particular creator and affect that creator’s market. Part 3 separately considers possible competition and lost licensing opportunities related to training. These are concerns and potential effects discussed in the reports, not quantified causal findings.

For a practical ethical assessment, ask:
- Was the artist’s work used with permission, and is that use disclosed?
- Could the presentation lead viewers to believe the artist made or endorsed the image?
- Is the output being sold or used in a way that competes with the artist’s commissions or licensing?
- Does the use invoke the artist’s identity or reputation, rather than simply describe visual characteristics?
These questions help identify ethical risks; they are not a substitute for the separate legal analysis.
How to use or assess an artist-inspired image responsibly
- Describe what the prompt is invoking. A broad visual characteristic is different from asking for a close imitation of a particular work or a realistic replica of a person.
- Check the output against specific works. If it appears to reproduce distinctive expression from an identifiable work, treat that as a separate copyright concern rather than assuming that a style label settles the matter.
- Label authorship accurately. Do not imply that the artist created, approved, or collaborated on an image unless that is true. If the artist is named as an inspiration, make the distinction clear.
- Consider the intended use and market. Commercial uses that may compete with commissions or licensing raise different ethical stakes from private experimentation, even though context alone does not decide legality.
- Check the applicable law and service policy. State laws and service rules can differ and change. Do not assume that a generator permits or blocks living-artist prompts without checking its current official policy.
