Some systems require you to confirm each order; others are designed to make payments within limits you set in advance. Whether a specific purchase was authorized depends on what you instructed, the controls in that payment flow, the relevant terms, and the circumstances.
What does “without your permission” mean?
There are two different questions: did you approve this individual purchase at checkout, and did you give the agent authority to make purchases of this kind at all? A system may skip a fresh approval for every transaction while still requiring you to set a budget, select a merchant or category, or authorize a particular task. Conversely, having the technical ability to submit a payment does not establish that an agent was authorized to use it.

For example, asking an agent to find “best running shoes under $100” could mean you want recommendations, a checkout draft, or a completed purchase. The prompt alone may not make clear which outcome you intended. Check whether the product explains what your instruction permits and what action still requires confirmation.

How purchase flows handle approval and spending limits
AI shopping and payment systems can put the approval point in different places. The controls and responsibilities below are those described by OpenAI, Stripe, and Visa for their respective products or services; implementations and availability can differ.

Stripe’s guide also describes Shared Payment Tokens constrained to a seller, amount, and time window. These limits can reduce exposure of the underlying payment credential, but do not, by themselves, answer every question about authorization or disputes.
What counts as permission in a specific system?
Look at the authority you actually granted and compare it with what the agent did. Relevant boundaries can include the task, merchant or category, maximum amount, duration, and whether final approval is required. A transaction may be technically possible but outside those boundaries.

Stripe’s service terms use “Authority” to mean “the express scope of authority an Agentic Customer grants to any AI agent operating within the Agentic Interface to initiate Agentic Transactions on Agentic Customer’s behalf including any applicable spending limits, merchant restrictions, or time-bound parameters.” That is contractual language for Stripe’s defined service setting, not a general statutory definition.
Those terms describe transactions as unauthorized under the agreement when, among other cases, an agent acts without customer authorization, exceeds the authority granted, or acts because of a bug, hallucination, or misinterpretation. They also address whether the customer manifested purchase intent or received that intent. These are provisions in Stripe’s terms and should not be read as a universal rule about who is liable for every AI-initiated transaction.

Who handles the order if something goes wrong?
In the OpenAI Instant Checkout flow described in its announcement and developer documentation, the merchant accepts or declines the order, processes payment through its provider, and handles fulfillment and customer support. OpenAI says it passes necessary information between the user and merchant and is not the merchant of record.
Stripe’s terms likewise place fulfillment and post-fulfillment obligations—including shipping, returns, refunds, and exchanges—on the seller. They also allocate certain unauthorized-transaction risks between Stripe and the user of its agentic interface. That allocation applies to the parties and service covered by those terms; it does not settle responsibility in unrelated arrangements.

If a purchase is disputed, check the terms for the seller, payment provider, and AI platform involved, then contact the appropriate provider about the specific order. Keep the order confirmation and any record of the instruction or spending limit you set.

Visa says its AI-Ready Cards approach uses tokenized credentials bound to particular agents and use cases, alongside real-time authorization and continuous fraud monitoring. Visa describes controls such as spending limits, merchant-category restrictions, and approval requirements, with operation depending on the implementation. Its announcement says: “Only the consumer can instruct the agent on what to do and when to activate a payment credential.” That statement describes Visa’s announced system; it is not a universal legal rule or a guarantee that every agent payment requires a fresh approval.
Does the law let an agent buy things without permission?
There is no universal legal answer established by these product descriptions. Whether a particular transaction is authorized, reversible, or the user’s responsibility can depend on the jurisdiction, the facts, the payment arrangement, and the governing terms. Company product materials and contracts explain how their systems are intended to work; they are not a comprehensive analysis of consumer, payment, or agency law across countries.
For practical purposes, distinguish an agent acting within permission you granted from one exceeding that scope or acting without your intent. For a real disputed charge or a legal question, consult the relevant provider and, when needed, a qualified adviser in your jurisdiction.
