Yes, conditionally. A European email provider can use a US cloud service if the personal-data transfer has a valid GDPR Chapter V route and the provider meets the GDPR’s other requirements. The EU–US Data Privacy Framework (DPF) can provide that route when the specific US recipient has an active certification that covers the relevant entity and data. If it does not, another suitable transfer ground, such as Standard Contractual Clauses (SCCs) or Binding Corporate Rules (BCRs), may be available. Neither route, by itself, proves that an email service is GDPR-compliant.
What the EU–US Data Privacy Framework permits
The European Commission adopted the EU–US DPF adequacy decision on 10 July 2023. Under that decision, personal data may flow from the EU to US companies participating in the framework. The European Data Protection Board (EDPB) describes DPF participation as self-certification by US companies. An exporter should verify the actual recipient’s current listing and certification scope rather than assume that any company in a corporate group is covered.

Certification must be renewed annually, and its scope matters. For example, the EDPB notes that not every DPF certification covers human-resources data. If an email provider handles employee information, it should check that the certification covers that category as well as the legal entity receiving it. These checks are set out in the EDPB’s EU-U.S. Data Privacy Framework F.A.Q. for European businesses, version 2.0, adopted 15 January 2026.

The table describes transfer mechanisms, not complete compliance packages. As the EDPB emphasizes, using the DPF for a transfer does not displace other GDPR requirements or applicable national data-protection law. The Commission also says the US national-security safeguards described on its EU–US data transfers page apply to GDPR transfers to US companies regardless of the transfer mechanism.

Does keeping email data on EU servers settle the question?
No. Storage location is relevant, but it is not the whole assessment. A provider should identify which legal entity receives or processes personal data, whether US-based staff or affiliates can access it, what subprocessors are involved, and which transfer arrangement covers those relationships. This follows from the EDPB’s requirements to check the recipient and certification scope, processor arrangements, and third-country authority requests; an EU data-centre address alone does not answer those questions.
Ask for the service’s current data-flow and subprocessor information, including support and administrative access. Then compare the actual entities and access paths with the contract and the stated transfer mechanism. The relevant facts depend on the service’s design and the data it handles; no general statement about “EU hosting” establishes that a particular arrangement is compliant.

What the provider still owes when the cloud company is a processor
If the US cloud company processes email or related personal data on the European provider’s instructions, the provider and processor still need an Article 28 data-processing agreement, whether or not the cloud company is DPF-certified. The EDPB FAQ says the agreement and working arrangement must address the processor’s duties, including:

- Following documented instructions and ensuring confidentiality.
- Maintaining appropriate security and controlling the use of subprocessors.
- Assisting with data-subject rights and the provider’s compliance duties.
- Returning or deleting data when the service ends, as applicable.
- Providing information and audit rights.
The initial processor must ensure that required protections and obligations flow down to its subprocessors, and remains liable to the controller for their performance of those obligations, according to the EDPB FAQ. Review the live subprocessor list and contract terms rather than relying on a general claim about where data is stored.

How US government-access concerns fit into the assessment
The European Commission describes the DPF safeguards introduced following the Court of Justice’s Schrems II decision, including limits on US intelligence access and an independent redress mechanism. The Commission says those safeguards apply to GDPR transfers to US companies regardless of the transfer mechanism. That description concerns the framework’s safeguards; it is not a finding that every provider, contract, or data flow satisfies every GDPR obligation.
A demand from a non-EU authority is not automatically enforceable in Europe. In its announcement of the final Article 48 guidelines on 5 June 2025, the EDPB explained that decisions by third-country authorities cannot automatically be recognised or enforced in Europe. Where there is no international agreement that supplies an appropriate legal basis and safeguards, other grounds may be considered only exceptionally and case by case. A particular demand still requires assessment under the facts and applicable law.

A practical checklist for reviewing an email service
For a provider or customer review, gather the documents and answers for the specific service and data flow:
- Map the parties: Identify the controller, processor, contracting entity, actual data recipient, and any EU or US affiliates involved.
- Define the data: List the personal-data categories and purposes, including whether employee or other HR information is handled.
- Check the transfer route: For a DPF transfer, verify the recipient’s current listing, certification scope, covered affiliate, and relevant data category. If DPF does not cover the recipient, identify the Chapter V ground actually relied on and its supporting documentation.
- Review processor terms and operations: Check the Article 28 agreement, security commitments, support and administrative access, subprocessor flow-downs, audit information, and deletion or return terms.
- Check the rest of the GDPR picture: Review privacy notices and other applicable requirements independently of the transfer mechanism.
- Understand escalation for authority requests: Find out how the provider evaluates third-country demands, including when it escalates to counsel and applies the Article 48 analysis.
These checks reflect the EDPB’s January 2026 FAQ, its final Article 48 guidance announcement of 5 June 2025, and the Commission’s explanation of EU–US data transfers. They are not a determination about any unnamed provider. A concrete conclusion depends on current certification status, contracts, entities, access paths, and technical arrangements.

Comparing two cloud arrangements
When comparing providers, line up the same facts for each arrangement: receiving entity and country; storage and processing locations; staff and remote-support access; active DPF scope or another transfer mechanism; controller and processor roles; subprocessors and contractual flow-downs; encryption and key control as actually implemented; audit and transparency terms; and data deletion, return, and exit arrangements. These are practical comparison points, not a certification of any particular email provider.
