Yes—but the exact rule depends on where the measure is and what kind of measure it is. A measure can get more “yes” than “no” votes among people who answered the question and still fail a separate supermajority or participation requirement. The key is to distinguish votes cast on the measure from all votes cast in the election.
How a majority can still fall short
In ordinary usage, a majority means more than half. For a ballot measure, that usually means more than half of the votes cast on that particular question are “yes.” But a jurisdiction can impose an additional legal condition before the measure takes effect. A majority among people who answered the question is not automatically a majority of all ballots cast, and it may not reach a higher approval threshold.

For example, a hypothetical measure receiving 54% “yes” and 46% “no” has a majority of votes on the question. It would nevertheless fail if the applicable rule required 55% approval.

| Test | What is counted | How a measure can fail |
|---|---|---|
| Approval threshold | Yes votes as a share of votes cast on the measure | Yes votes exceed no votes but fall short of a required supermajority, such as 55%, 60%, or two-thirds. |
| Participation or validation threshold | Votes on the measure compared with a larger election-wide total, or a specified minimum yes-vote count | The measure may win among those who answered but fail to meet the separate participation or minimum-vote condition. |
A participation rule does not mean that every person who skipped the question literally voted “no.” Instead, the law uses a separate denominator or minimum-vote test to decide whether the result is valid for passage.

Examples from state and local rules
Supermajority requirements
California’s Secretary of State explains that statewide ballot measures can pass by a majority, while certain local measures require 55% or two-thirds approval. The threshold therefore depends on the type of measure; a simple statewide-majority rule should not be assumed to apply to every local proposition. See the California Secretary of State’s ballot-measure guidance.
Washington’s participation condition
For measures initiated or referred under the process described in Article II, Section 1(d) of the Washington State Constitution, passage requires both a majority of votes cast on the measure and votes on that question equal to at least one-third of all votes cast at the election. The Constitution states: “Any measure initiated by the people or referred to the people as herein provided shall take effect and become the law if it is approved by a majority of the votes cast thereon: Provided, That the vote cast upon such question or measure shall equal one-third of the total votes cast at such election and not otherwise.” If enough voters leave the question blank, the participation condition can fail even when “yes” exceeds “no.” This rule is specific to the measures and process described in the state constitution; it is not a nationwide standard. Read the Washington State Constitution, Article II, Section 1(d).

Different local measure categories
Snohomish County, Washington, describes different validation rules for different local measures. Its guidance says most non-school levies need at least 60% “yes” votes and a minimum yes-vote count tied to 40% of prior general-election turnout. By contrast, the county says school levies use a simple majority without that turnout or minimum-vote condition. Its bond guidance describes approval and turnout-validation requirements as well. These are county-specific explanations and measure categories, not rules for every county or every Washington ballot measure. The county’s example uses 10,000 participants in the prior general election: 40% is 4,000, and 60% of that figure is a 2,400-vote minimum. See Snohomish County’s ballot-measure validation requirements.

Some jurisdictions also set special rules for competing or conflicting proposals. Washington’s constitution describes a two-question process for conflicting measures and requires a majority on the comparison question for one measure to become law. That is a state-specific rule, not a general feature of ballot measures across the United States; consult the applicable constitutional text for the details.

How to check the rule for a particular ballot
- Identify the jurisdiction and measure type. A statewide initiative, local levy, school measure, and bond may face different passage conditions.
- Read the ballot language and official election materials. Look for the percentage required and whether the rule refers to votes on the question, all votes in the election, turnout, or a minimum yes-vote total.
- Verify the controlling law. Check the relevant state constitution and statutes, then compare them with the local election authority’s explanation. Ohio law, for example, requires ballot issue text to state the percentage of affirmative votes necessary for passage; see Ohio Revised Code Section 3505.06.
For a broader comparison, the National Conference of State Legislatures reports that initiative participation requirements in Illinois, Mississippi, Nebraska, and Wyoming add a specified election-participation percentage to a simple-majority test. Because comparative summaries can change and do not replace the controlling law, confirm the current state-specific requirement in primary legal sources. See NCSL’s overview of initiative election and adoption rules.
