The exemption is temporary, runs through January 1, 2030, and applies only to devices that meet the law’s 1,200-watt AC limit, electrical-code requirements, laboratory certification and anti-backfeed protections. It does not settle whether a landlord, HOA or building owner must allow a particular installation.
What SB 868 changes—and when
California SB 868 (Chapter 985) takes effect on January 1, 2027. Until then, the new exemption is not in force. From that date through January 1, 2030, qualifying “portable solar generation devices”—often called plug-in or balcony solar—are exempt from state, California Public Utilities Commission, investor-owned utility and local publicly owned utility interconnection requirements, according to the enacted law as published by California Legislative Information in 2026.
For a qualifying device, a utility cannot require prior approval, an interconnection agreement, device-related fees or additional controls. A utility may still require a simple online notice identifying the installation’s address, device make and model, and device size. That notice is not the same as an approval process.
The law addresses grid interconnection and device safety. It does not create a general right to attach panels to a balcony, roof or other part of a building, nor does it waive otherwise applicable building or electrical requirements.

Does a plug-in solar kit qualify?
Every condition below must be met for the statutory exemption. The limit is 1,200 watts of aggregate AC output per dwelling, not 1,200 watts for each panel or device.
- Output: All covered devices at the dwelling together must not exceed 1,200 W AC.
- Connection: The device must connect and disconnect through a receptacle.
- Purpose: It must be intended to offset electricity use onsite.
- Electrical codes: It must meet the most recent National Electrical Code and California Electrical Code.
- Certification: It must be certified as a plug-in photovoltaic system by Underwriters Laboratories (UL) or an equivalent nationally recognized testing laboratory.
- Outage protection: It must include certified isolation that prevents it from sending power back to the grid during an outage.
If even one condition is missing, the device does not receive SB 868’s interconnection exemption. Before buying a balcony solar kit, check its documentation for the system’s AC output, plug-in photovoltaic certification, applicable code compliance and certified isolation protection. A general product description or a panel’s wattage alone does not establish that the complete device qualifies.

What the exemption means for renters and building residents
The law is aimed in part at renters, apartment residents, people with roofs unsuitable for conventional solar and households that cannot or do not want to pay for rooftop systems, as KQED reported in 2026. But exemption from utility interconnection rules is separate from permission to mount equipment on a balcony, hang it from a railing, place it on a roof or set it in a yard.
SB 868 does not expressly override lease terms, landlord decisions, condominium or cooperative rules, HOA restrictions, balcony load limits or local building-placement rules. The statute therefore does not establish a single statewide answer to whether an individual renter or owner may install panels in a particular location. Check the rules and permissions that apply to the property, as well as any relevant local requirements, before mounting or placing equipment.

What to check before installing
- Confirm the device qualifies: Review its certification and safety documentation against every item in the eligibility checklist, including aggregate AC output for the dwelling.
- Check utility notification: Find out whether the serving utility requires the simple online notice permitted by the law. A notice, where required, is not utility approval.
- Resolve placement separately: Check your lease or building and association rules, and determine whether the proposed location raises a balcony-loading, building or local placement issue.
Prices, availability and the 2030 cutoff
KQED reported plug-in solar models priced at about $300 to $2,200 in 2026, depending on size. That is a reported range, not a guaranteed current price or a statement that every model in it qualifies under SB 868. The California Assembly Utilities and Energy Committee’s 2026 policy analysis said plug-in systems were available for retail sale in some markets, including Amazon and Bright Savers; that does not establish current stock or certify a particular product.
The exemption is temporary. The law also provides that, after January 1, 2030, receptacle-connected devices that do not meet the applicable requirements may not be sold in California. Anyone shopping before then should distinguish a product’s availability from its eligibility for the exemption and its sale eligibility after the cutoff.
