Bullying vs. Conflict: How Schools Can Tell the Difference

Bullying involves unwanted aggression, a real or perceived power imbalance, and repetition or likely recurrence. Learn how schools can assess concerns and respond without overlooking harm or discrimination.

Schools should assess bullying by looking for unwanted aggressive behavior, a real or perceived power imbalance, and repetition or a strong likelihood that the behavior will recur. An equal-power disagreement is more consistent with conflict, but neither label should replace listening, fact-finding, addressing harm, or checking school policy and possible discrimination concerns.

What distinguishes bullying from conflict?

Federal guidance commonly identifies three features of bullying: aggressive behavior that is unwanted, a real or perceived imbalance of power, and behavior that is repeated or likely to be repeated. These are screening indicators, not a shortcut for deciding what happened in an individual case.

Power can come from physical strength, popularity, access to embarrassing information, or group dynamics. A student does not have to be physically stronger for a power imbalance to exist. The assessment should consider how much ability each student has to speak up, stop the behavior, or avoid further harm.

Assessment question More consistent with conflict Raises concern for bullying
Power Students have relatively equal power and can express themselves. A student or group has real or perceived power to control or harm another.
Pattern A disagreement may be isolated and can be worked through. Aggression is repeated or has a strong likelihood of recurring.
Response to harm Students may change course when they understand the impact and may want to repair the relationship. Harmful behavior continues despite its effect on the targeted student.
Possible examples Peers disagree about a game or shared decision. Threats, repeated name-calling, rumor-spreading, deliberate exclusion, physical attacks, or damage to belongings, when power and repetition concerns are also present.

These examples do not decide a case by themselves. Context, student accounts, and other available information matter. Children’s Wisconsin describes the challenge as distinguishing bullying from “normal, everyday conflict between friends or peers” in its Bullying vs. Conflict activity guide.

How should staff assess a concern?

  1. Make the situation safe. Interrupt unsafe behavior and address any immediate need for support. Do not make the student who may be targeted responsible for stopping it.
  2. Listen and gather information. Speak with students separately as appropriate, ask what happened and whether it has happened before, and consider the power dynamics and impact. Avoid deciding from a single label or account alone.
  3. Document and follow school procedures. Record relevant information under the school’s policy and use the applicable reporting and investigation process.
  4. Check whether it continues. Monitor the situation and respond to further behavior under school procedures; a first report may not reveal the full pattern.

A single hurtful act may not meet a definition that requires repetition, but that does not make it harmless or exempt from school rules. The school should still respond appropriately to the conduct and its effects.

Why suspected bullying should not automatically be mediated

Ordinary conflict between students with relatively equal power may sometimes be addressed through a supported conversation. Suspected bullying is different: treating the students as equally responsible parties can place additional pressure on the targeted student. Federal educator training cautions that mediation may further victimize a student who has been bullied. Staff should first assess safety, power, and the pattern rather than defaulting to peer mediation.

When discrimination or disability concerns may apply

A bullying label does not settle whether conduct also raises a civil-rights concern. If behavior may relate to race, national origin, sex, disability, or another protected basis, the school should consider applicable civil-rights procedures alongside its bullying and discipline policies.

The U.S. Department of Education says that when a school knows or reasonably should know of possible discriminatory harassment, it must take immediate and appropriate steps to investigate or otherwise determine what occurred. If it finds a hostile environment, it must take prompt and effective steps to end it, prevent recurrence, and remedy effects as appropriate. Disability-related conduct may also raise responsibilities under Section 504 or Title II. These are general U.S. points, not a determination of what law or procedure applies to a particular incident.

Definitions and statistics depend on the source

Federal sources do not use identical definitions for every purpose. The CDC’s public-health definition excludes siblings and current dating partners. The National Center for Education Statistics (NCES) warns that its School Crime Supplement uses a broader definition: it does not exclude bullying by siblings or romantic partners and does not require power imbalance or repetition in the same way. Figures from these sources therefore measure different things and should not be treated as a single comparable trend.

  • About 19.2%: Students ages 12–18 in grades 6–12 reported being bullied in the National Center for Education Statistics and Bureau of Justice Statistics’ 2022 School Crime Supplement. StopBullying.gov also reports that about 15.4% reported bullying with a power imbalance, 14.5% reported repeated bullying, and 12.7% reported both, under that survey’s broader measure.
  • 19%: Students in grades 9–12 reported being bullied on school property in the prior 12 months in the CDC’s 2023 Youth Risk Behavior Surveillance System.
  • 28% of middle schools, 15% of high schools, and 10% of elementary schools: Schools reported bullying at school at least once a week in NCES’s 2021–22 School Survey on Crime and Safety, published in 2024.

These figures describe different populations, time periods, and measures; they are not directly comparable. They also do not determine whether a particular student’s experience meets a school, state, or legal definition.

Use local policy for the final process

State laws and district policies can define bullying and set reporting, investigation, and response procedures differently. Federal educator training advises using general guidance together with state law and district policy. Staff should check the rules that apply to their school and follow any relevant civil-rights process; a general screening framework is not a state-by-state legal assessment.
