In the United States, an AI recommendation or automated refill does not, by itself, make the software a licensed prescriber. Prescription authority and responsibility depend on the medication, state rules, the service’s clinical workflow, and any licensed practitioner involved. FDA oversight of a software function is a separate question from who may prescribe and who is responsible for a patient’s care.
What does it mean for an AI to “control” a prescription?
There are four separate questions behind that phrase:
As an Amazon Associate I earn from qualifying purchases.
- Who built and operates the software? The developer and healthcare organization determine how the tool is designed, deployed, and integrated into care.
- Who reviews or acts on its recommendation? A clinician might consider the output, approve each order, review only flagged cases, or not be involved in a particular workflow. Those are materially different arrangements.
- Which rules apply to the software function? FDA device oversight depends on the function’s intended use and technological characteristics. Not every healthcare tool is necessarily a regulated medical device.
- Who has authority and responsibility for care? Professional licensing and prescribing requirements are governed separately, including by state and federal rules. The details of a specific service’s responsibility cannot be inferred just from the fact that it uses AI.
These questions should not be collapsed into a single claim that “the FDA approved the AI” or “the doctor is responsible.” A product’s regulatory status, a practitioner’s authority, and the allocation of responsibility in a particular care arrangement are distinct matters.

No. The FDA describes its role this way: “The FDA does not regulate AI as such; it regulates medical devices, including AI-enabled medical devices.” For functions that are medical devices, the agency considers intended use and technological characteristics and describes pathways including 510(k), De Novo, and premarket approval. Those pathways concern device oversight, not a software system’s professional license to prescribe.

The FDA reported that it had authorized more than 1,600 AI-enabled medical devices for marketing in the United States as of September 2026. That broad total is not a count of autonomous prescribing systems and does not establish that a particular AI service is authorized to issue prescriptions.
FDA guidance is also not the same thing as a binding law or regulation. The agency issued its final Clinical Decision Support Software guidance on January 29, 2026. The guidance explains the agency’s approach; guidance generally does not have the force and effect of law.
When can clinical decision-support software fall outside the device definition?
The 2024 U.S. Code describes an exclusion from the medical-device definition for certain clinical decision-support functions. For relevant recommendation software, the statutory text includes conditions around professional support: a healthcare professional must be able to independently review the basis for a recommendation, and the software must not be intended for primary reliance in an individual patient’s diagnosis or treatment decision under the stated provision.

That language does not automatically classify every product that recommends or renews medication. A product’s actual functions and intended use matter, and the statutory criteria are not a definitive classification of any named AI prescribing service.
The Office of the National Coordinator for Health Information Technology describes clinical decision support as digital tools that provide timely, person-specific information to enhance outcomes and care quality. Its examples include clinician-facing prescribing support built around guidelines: software can assist a clinician without being an autonomous prescriber.
Who can prescribe, and what changes for controlled substances?
Prescribing authority is a matter of professional and prescribing rules, not something conferred simply by calling a product an AI doctor or by having FDA-regulated software. The responsible practitioner’s licensure context and the state where care is provided can matter, as can the medication and the way the service works.

Controlled substances have additional requirements. HHS says federal telemedicine flexibilities for authorized practitioners continue through December 31, 2026, subject to conditions. Those flexibilities concern authorized practitioners; they are not blanket permission for an AI system itself to prescribe controlled substances.

What does Utah’s Doctronic refill pilot show?
An Associated Press report in 2026 described a Doctronic program in Utah in which patients provide prescription and medical-history information. The service checks whether a prescription is valid through a pharmacy database and can renew eligible medication requests to a local pharmacy; cases needing attention are sent to a Doctronic telehealth physician.

AP reported that doctors reviewed all orders during the program’s initial phase, while the company expected to move toward fully automated refills later. The report also described concerns raised by medical board members and a dispute over the lines between federal device oversight and state professional oversight. These are reported program details and concerns, not a final legal determination.
AP quoted Utah medical licensing board chair Dr. Alan Smith saying, “We were essentially told: ‘Yes this is going on. And no, you don’t have a say in it.’” AP noted that Smith was speaking only for himself. His statement reflects one participant’s view, not an official finding by the board.
The reporting does not establish that the FDA specifically authorized the Utah pilot to renew prescriptions autonomously. It also does not establish that the program is illegal. Neither conclusion follows from the reported account alone.

What evidence supports claims that AI can prescribe safely?
A June 27, 2025 preprint by authors including Doctronic co-founder Adam Z. Oskowitz describes a retrospective comparison involving 500 consecutive urgent-care telehealth encounters. The Doctronic-affiliated authors reported agreement on the top diagnosis in 81% of cases and treatment-plan alignment in 99.2%. The comparison used blinded LLM-based adjudication and expert review.
Those figures describe that study’s comparison; they do not measure prospective real-world safety of autonomous prescriptions. The preprint also does not establish that its results generalize to other populations, settings, medication types, or prescribing tasks.
How should you assess an AI-enabled prescription service?
Before relying on a service’s claims, look for specific answers to these questions:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Is the tool advising or taking action? A suggestion for a clinician to consider differs from software that sends an order to a pharmacy.
- When does a clinician review the decision? Ask whether every decision is reviewed or only cases the system escalates, and who handles an escalation.
- Which medication is involved? Find out whether controlled-substance rules apply rather than assuming one refill policy covers every drug.
- Which state and practitioner are involved? Confirm the relevant location and the licensed professional or organization providing care.
- What FDA status applies to this specific function? Ask what authorization or clearance, if any, covers the software function; a general claim about AI-enabled devices does not answer that question.
- What evidence supports this task and patient group? Look for evidence that matches the service’s actual use, rather than relying on a different task or a broad performance claim.
Regulatory and pilot details can change. Verify the current rules and the service’s stated workflow for the specific medication and state instead of treating one program or announcement as a nationwide precedent.
