Sometimes—but there is no universal safety verdict. An image-to-prompt generator may process, retain, or allow access to an uploaded image under rules that vary by service, product tier, account settings, and date. For copyrighted images, asking for a text description does not by itself establish that uploading the source image is permitted.
What “safe” means when you upload an image
Before using an image-to-prompt generator, consider two separate issues: what happens to the file after upload, and whether you are entitled to submit it in the first place. A tool returning text rather than an edited image does not prove that the original file was not stored or processed.

- Processing: What does the service do with the image to provide its feature?
- Training: May the image or related content be used to improve or train models?
- Retention and deletion: How long can the service keep the upload, and what deletion controls apply?
- Access and sharing: May staff, service providers, or other third parties access or process it?
- Submission rights: Do the terms require you to own or have permission for the content you upload?
These are distinct questions. A training opt-out does not necessarily mean the image is deleted, never retained, or inaccessible to authorized personnel.

- Identify the exact product and tier. A company name alone is not enough: the rules may differ between a consumer app, a business plan, an API, or a particular image feature.
- Read the relevant policy and settings. Check input processing, training use, retention and deletion, human or service-provider access, and third-party sharing separately. Confirm that a control applies to the feature and account you plan to use.
- Keep sensitive images under your control. If a photo is confidential, intimate, identifying, or otherwise sensitive, do not submit it to an unreviewed tool. Prefer a workflow that keeps the image under your control, or a service and agreement whose safeguards you have verified.
- Check your authority to submit the image. Confirm that you own the relevant rights or have permission, and consider privacy, publicity, confidentiality, workplace, contract, and local legal obligations—not only copyright.
- Do not treat text output as a legal shortcut. A generator producing only a description does not automatically make uploading a copyrighted image permissible.
Provider policies differ: two examples
The examples below illustrate why the exact service and plan matter. They do not establish the handling practices of every image-to-prompt tool, or that either provider offers a dedicated product with identical terms.

OpenAI: consumer services and business/API products
OpenAI says it may use content from individual services such as ChatGPT, Sora, and Operator to train models. Users can opt out; new conversations after opting out will not be used for training. ChatGPT Temporary Chats are not used to train models. OpenAI says business products including ChatGPT Team, ChatGPT Enterprise, and its API do not train on inputs or outputs by default, with an explicit opt-in path for data sharing. Check the current rules and settings for the specific product you use: OpenAI’s data-use policy.
OpenAI also says a limited number of authorized personnel and trusted service providers may access user content for purposes including support, abuse or security investigations, legal matters, and model improvement unless the user has opted out. Its Help Center warns: “Please do not enter sensitive information that you would not want reviewed or used.” Read the full explanation of content access and data use.

For API customers, OpenAI’s documentation lists 30-day abuse-monitoring retention for the /v1/chat/completions and /v1/responses endpoints. Eligible customers can apply for Modified Abuse Monitoring or Zero Data Retention; access requires approval and has additional requirements, and some endpoints or features may still retain application state or have exceptions. Stability AI: training opt-out does not set a universal retention period
Stability AI’s privacy policy, effective September 30, 2026, says it may use inputs and outputs to improve and develop services and to train, fine-tune, and evaluate machine-learning models. Users can opt out of training use in account settings. The policy says retention lasts as long as reasonably necessary for stated purposes and depends on factors such as the agreement and legal requirements; it does not give one fixed retention period for every input. Its terms make users responsible for submitted content and require them to represent that they have the rights, licenses, and permissions needed to submit it. The terms say users retain ownership of submitted content between the user and Stability, to the extent permitted by law, while granting a license for service operation, maintenance, security, support, legal compliance, and other expressly permitted purposes. They also say content may be used to improve services and provide an opt-out for model-training use. That contractual ownership statement does not establish that an uploader had permission from a photographer, subject, employer, or other rights holder. See Stability AI’s terms of service.

In the United States, fair use is assessed case by case under four factors: the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality used, and the effect on the work’s potential market or value. Nonprofit or educational use is not automatically fair, and commercial use is not automatically unfair; courts balance the factors. The U.S. Copyright Office’s Fair Use Index summarizes court decisions but cannot determine whether a particular upload to a particular tool is lawful. Other jurisdictions may apply different rules.

Keep three issues separate:
- Permission to upload: This may depend on copyright and other rights, the service’s terms, the purpose of the upload, and the relevant jurisdiction.
- The service’s handling of the upload: Its policies, settings, agreement, and applicable law govern processing, retention, and permitted uses.
- Rights in generated output: These do not determine whether submitting the source image was allowed.
In a January 29, 2025 announcement about AI-assisted works, the Copyright Office said output may be copyrightable where a human determines sufficient expressive elements, but “not the mere provision of prompts.” Register of Copyrights and Director Shira Perlmutter said: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.” This concerns human authorship and copyrightability of output—not permission to upload an existing image. The Copyright Office’s AI study page lists Part 3, Generative AI Training, as a May 9, 2025 pre-publication report and says a final version will be published in the future. The analysis of model training is distinct from the legality of an individual user’s upload for analysis; an opt-out control does not settle either question. See the Copyright Office AI study page.

Quick decision guide
- Private or sensitive photo: Do not upload unless you have verified the specific service’s access, retention, deletion, and training rules and are comfortable with them.
- Someone else’s copyrighted image: Confirm you have a basis to submit it under applicable law and the service’s terms. A text-only result is not a blanket safe harbor.
- Work, client, or confidential image: Check workplace, client, confidentiality, and contractual restrictions as well as the tool’s published policies.
- Unclear policy or unclear rights: Do not upload; use an image you have authority to submit or a workflow that avoids sending the file to an unverified service.
