They can be, but the evidence does not show that every autistic suspect is disadvantaged or how often disadvantage occurs in real police interviews. In a 2023 mock-interview study, innocent autistic participants gave fewer details supporting their innocence than non-autistic participants, and autistic participants reported more difficulty understanding questions and greater anxiety. Yet the groups provided similar amounts of investigation-relevant information and showed similar consistency between their statements and the evidence. The findings point to possible barriers in how an account is elicited—not a universal inability to give useful or reliable information.

The findings are mixed rather than contradictory: autistic participants in the mock study reported some specific difficulties, while also providing similar levels of investigation-relevant information and statement-evidence consistency. The results do not justify assuming that an autistic person’s account will be less useful, less accurate or less consistent.

There is no reliable population-level percentage in these sources for how often autistic suspects are disadvantaged in forensic interviews. The study counts above describe the participants and reports in those particular studies; they are not prevalence rates.
How an interview can create barriers
A suspect interview can require a person to understand questions, retrieve and organize memories, respond under pressure and interpret a socially demanding interaction. In the 2023 study, autistic mock-suspects themselves reported greater difficulty understanding questions and higher anxiety. These are reported group-level differences, not traits that should be presumed in every autistic person.

In a 2022 discussion for the National Autistic Society, University of Bath researcher Dr Katie Maras describes possible challenges with freely recalling specific events, remembering context and organizing an account. She also notes that tactical decisions about when to reveal evidence can create unexpected demands. Maras writes that “an interviewee who has difficulties reading others’ intentions will naturally be at a disadvantage in such a context even when telling the truth.” That is an expert assessment of a potential mechanism, not a finding that all autistic interviewees experience it.
Communication differences are not proof of deception
Hesitation, unusual phrasing, difficulty following a question or a communication style an interviewer does not expect should not be treated on their own as evidence of guilt or lying. The 2023 study discusses how verbal cues sometimes associated with deception may also appear when autistic mock-suspects are telling the truth. It does not establish that any one behavior reliably indicates either truth or deception.

The study authors describe distinguishing difficulty from deception in autistic suspects’ accounts as “a challenging though necessary task for researchers and practitioners alike.” In practice, an account should be evaluated against the evidence and the circumstances in which it was obtained, not reduced to an interpretation of demeanor.

What interview support may look like
Interview planning can take account of the person’s individual communication, social and cognitive needs. The aim is to make questions understandable and support a detailed account without steering the person toward a particular answer. The sources support considering structure and adjustments, but do not establish one universally suitable technique for every autistic suspect.

Structured prompts and recall
Maras’s National Autistic Society article notes that standard Cognitive Interview techniques may not adequately support recall for some autistic interviewees, and that very open-ended prompts can be difficult. It discusses the Witness-Aimed First Account (WAFA) method, which divides an account into smaller topic sections and explores them in turn, as promising for witness interviews. That is not proof that WAFA is validated for suspect interviews: the sources discussed here do not establish that.
Keep the distinction between support and suggestion
More structure can help an interviewee understand what is being asked, but prompts must not supply facts or lead the person toward an answer. The relevant question is whether an approach helps this individual communicate their own account clearly and accurately; the available sources do not support prescribing a single method for all autistic suspects.

Safeguards depend on where the interview takes place
In England and Wales, the Police and Criminal Evidence Act (PACE) Codes C and H address vulnerable people in police detention and interview. Code H describes circumstances in which an urgent interview may proceed without an appropriate adult, subject to conditions and senior authorization. These are jurisdiction-specific rules, not universal standards. An autism diagnosis alone does not automatically determine vulnerability or guarantee a particular procedural outcome; the applicable test and facts of the case matter. Readers dealing with a current case should consult the current official code and seek appropriate legal advice.

What can—and cannot—be concluded
- There is direct experimental evidence that some autistic participants experienced greater difficulty and anxiety in mock suspect interviews, and that innocent autistic participants gave fewer details supporting their innocence in that setting.
- The same mock study found similar investigation-relevant information and statement-evidence consistency across autistic and non-autistic groups.
- The available evidence does not establish a real-world rate of disadvantage, a universal effect, or the likely outcome of an individual interview.
- Support and legal safeguards depend on the individual circumstances and the jurisdiction; witness-interview techniques should not be presented as proven suspect-interview methods.
