Are AI Mental Health Chatbots Private? What to Check Before Using One

Mental-health chatbots do not share one privacy standard. This practical U.S.-focused guide explains when HIPAA may apply, how FTC rules fit, and the settings and policy questions to check before sharing sensitive details.

Not automatically. An AI chatbot discussing anxiety, depression or therapy is not necessarily covered by HIPAA, and a “health” label or secure-looking interface proves nothing. Privacy depends on the provider’s legal role, data relationships, settings and business practices. Before sharing a sensitive disclosure, audit the service’s collection, model-training, human-access, sharing, retention, deletion, security and age policies—and disclose as little identifying information as possible.

What privacy protection does an AI mental-health chatbot actually provide?

There is no single privacy status for “AI mental-health chatbots.” A service may be a consumer app, a feature operated for a clinic, or a product connected to other health records. Those arrangements can trigger different legal obligations. The same company might offer one product for a health-care organization and another for the general public, with different data flows and contracts.

For U.S. users, the first question is not whether a conversation sounds medical. It is whether the provider and the particular product are actors covered by a relevant rule. Treat privacy as a service-specific investigation rather than a promise attached to the word health.

Why HIPAA does not automatically protect your chat

HIPAA follows covered actors and protected information

The HIPAA Privacy Rule limits certain uses and disclosures of protected health information by defined covered entities—health plans, health-care clearinghouses and certain health-care providers—and by business associates performing specified services for them. The U.S. Department of Health and Human Services explains the scope in its HIPAA Privacy Rule summary.

A stand-alone consumer chatbot is not covered merely because it discusses symptoms or offers emotional support. Coverage can depend on whether the service is acting for a HIPAA-covered provider, what information is exchanged, and whether a business-associate relationship and agreement exist. Do not infer HIPAA status from a product name, a “confidential” button or a generic security statement.

Other rules can apply outside HIPAA

The FTC says its Act can reach businesses that collect, use or share health information even when those businesses are not subject to HIPAA. Its guidance also describes the FTC Health Breach Notification Rule, which covers certain non-HIPAA personal health-record vendors and related entities. The scope depends on the service and its data model; these rules do not create the same rights or obligations as HIPAA. See the joint HHS guidance and the FTC explanation.

Regulatory coverage is not a confidentiality privilege. A provider’s statements about deletion, retention or sharing must also be truthful and understandable. If you need legal advice about a particular disclosure, consult a qualified lawyer in your jurisdiction rather than relying on a chatbot’s policy summary.

Audit the entire data lifecycle before you type

Use the same questions for every service. The checklist below follows FTC and American Psychological Association (APA) guidance and includes information that can be inferred from your activity, not just words you enter.

Privacy question What to find in the policy or settings
What is collected? Prompts, uploaded files, voice or images, account identifiers, device and usage data, location, cookies, connected health records and information inferred from your activity.
How is it used? Providing replies, personalization, safety review, support, security, advertising, profiling, analytics and model training or improvement.
Who can receive it? Authorized employees, contractors, cloud and support vendors, affiliates, advertising or analytics partners, legal authorities and connected-account providers.
How long is it kept? Chat history, logs, account records, backups and safety records; note separate periods and exceptions.
What does deletion do? Whether deleting a chat, disconnecting an account or closing the account removes copies from active systems, backups, model datasets and vendor systems.
What protections exist? Access controls, encryption claims, breach notices, account security and a clear explanation of incident response.
Who may use it? Minimum age, parental controls, caregiver deletion requests and procedures for disclosures suggesting risk of harm.
What legal relationship applies? Whether this exact product is supplied to a HIPAA-covered organization and whether a business-associate agreement governs the data flow.

The FTC specifically warns that health information may include data that conveys or enables an inference about health, such as browsing, location or purchase information. Consequently, review tracking technologies, permissions and linked accounts—not only the transcript. Read the FTC’s consumer-health-data guidance for that broader definition.

A practical pre-use privacy check

  1. Identify the product and account type. Record the exact app, web feature, region, subscription or workplace/clinic account. A health-specific mode may have different defaults from ordinary chat.
  2. Open the privacy policy and data controls. Look for menus labelled Privacy, Data Controls, Personalization, Improve the model, Connected apps or Delete account. Do not rely on a marketing page alone.
  3. Confirm collection. Check whether prompts, attachments, voice recordings, images, IP address, device identifiers, approximate location, contacts or health integrations are stored.
  4. Check training and improvement defaults. Determine whether conversations are used to train or improve models, whether safety review is separate, and whether an opt-out applies to existing data or only future chats.
  5. Map human and vendor access. Find out whether authorized staff, contractors or service providers can inspect content for safety, abuse prevention, customer support, security or legal compliance.
  6. Inspect sharing and monetization. Look for advertising, analytics, personalization, profiling, targeted ads, affiliate disclosures and onward transfers. A policy should identify categories of recipients and purposes.
  7. Read retention and deletion terms. Determine the time to delete a conversation, account and backups; whether de-identified or derived data remain; and whether legal, fraud or safety exceptions apply.
  8. Verify age and safety processes. Confirm the minimum age, parental or caregiver deletion route and how the provider handles a disclosure of imminent self-harm or harm to others. Privacy controls are not a substitute for emergency care.
  9. Test the controls with a low-risk message. Change the training setting, export or delete a test chat, disconnect an integration and verify what the interface says happened. Keep screenshots of the setting and confirmation date.
  10. Decide what not to disclose. If answers are vague or settings are difficult to locate, treat that uncertainty as a reason to share less—or choose a service with clearer controls.

Protect yourself when the policy is unclear

APA’s November 2025 advisory tells consumers to check privacy policies and in-app settings, limit data sharing and avoid personally identifying details. That means removing full names, street addresses, phone numbers, email addresses, employer or school names, account credentials and distinctive dates from a disclosure. Use a general description—such as “a co-worker” or “my city”—when the detail is not necessary for the question.

Do not upload medical records, therapy notes, screenshots, insurance cards or messages containing someone else’s information unless you have a clear, lawful reason and understand where the file will go. Disable optional location, contacts, microphone, camera and health-data permissions. Disconnect an integration when it is not needed, then check whether previously imported data are deleted or merely no longer synchronized.

Separate identity from sensitive content where practical. A pseudonymous account does not make a conversation anonymous if the service retains payment, device, IP or linked-account data. Avoid combining several clues—exact age, rare diagnosis, workplace, small town and appointment date—that could identify you even without a name.

What to compare when choosing two services

Do not rank chatbots by a single “private” badge. Record comparable evidence for each product and date the comparison because policies and defaults change.

If a cell cannot be answered from current documentation, mark it “not stated” rather than assuming the most favorable interpretation. A clear limitation is more useful than a reassuring guess.

Current example: reading a health-feature notice

OpenAI’s Health Privacy Notice, updated June 29, 2026, illustrates why product-specific reading matters. It says Health Features may include information a user provides about health history, symptoms and care, as well as linked medical records or Apple Health data. It states that, by default, connected medical and health data, ChatGPT Health conversations and conversations when Health Connect is enabled are not used to improve foundational models. It also says a limited number of authorized personnel and trusted service providers might access Health Feature data for model safety unless the user opts out.

Those statements apply to the described Health Features, not automatically to ordinary conversations, every account type or every chatbot. Check eligibility, current settings and the notice at the time you use the feature. Product documentation can change, and a policy statement does not by itself establish HIPAA coverage.

Children, teenagers and crisis disclosures

Young users may reveal intimate concerns, sexuality, abuse or self-harm without understanding long-term data consequences. APA advises developers to explain collection, storage, sharing, training use and permanent deletion in clear language, and to provide a way for caregivers to request deletion on behalf of a young person. Before allowing a minor to use a service, verify its age policy and caregiver process rather than assuming an app-store rating supplies those protections.

A chatbot cannot guarantee emergency intervention. If someone may be in immediate danger, contact local emergency services or an appropriate crisis service instead of relying on a privacy setting or an automated reply. Understand what the provider says about escalation, human review and disclosures indicating risk before treating the service as support.

Regulatory activity is not proof of a violation

In September 2025, the FTC announced an inquiry into seven companies offering AI chatbots that act as companions. The inquiry sought information about data handling, disclosures, monetization and protections for children and teenagers. It is an information-gathering inquiry, not a finding that any named company violated privacy law. Read the announcement at FTC.gov and distinguish an investigation or request for information from an enforcement decision.

When to stop and choose another service

  • The provider cannot say whether prompts are used for training or safety review.
  • Deletion language promises removal from your account but says nothing about backups, vendors or derived data.
  • Advertising, analytics or profiling partners are unnamed or the purposes are unclear.
  • Health-record or wearable access is enabled by default without a clear disconnect and deletion path.
  • Human review is possible but the roles, reasons and controls are unexplained.
  • The minimum age, caregiver rights or response to high-risk disclosures is missing.
  • The service implies HIPAA protection without identifying the covered organization or business-associate relationship.

In each case, do not try to “write around” the gap with more elaborate anonymization. Share only non-sensitive, general information or use a provider whose documentation and controls answer the checklist plainly.

Bottom line for a private conversation

Assume an AI mental-health chat is a consumer data transaction until the exact provider, product and legal relationship demonstrate otherwise. HIPAA may apply in a specific health-care arrangement, but it is not a blanket label for software. Check collection, inferences, training, access, sharing, retention, deletion, security, age controls and connected accounts; turn off optional uses; and omit identifiers. That approach gives you a realistic privacy decision without promising confidentiality that the service has not actually provided.
