Sometimes—but there is no universal open-source rule. Some projects permit code written with AI assistance when the contributor can grant the required rights, checks for third-party material, follows disclosure rules, and personally reviews the patch. Others impose stricter conditions: Apache Lucene, for example, allows AI as a coding tool but rejects contributions made by autonomous agents and expects contributors to understand and explain their changes.
The repository’s current contribution guide and AI policy control your submission. Foundation-wide guidance is not a blanket permission for every project, and your employer’s rules may be stricter still.

What “AI-generated patch” means
A patch can involve AI in several different ways, and projects may treat those uses differently:
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →- Assisted editing: You ask a model to suggest a function, refactor, test, comment, or documentation change, then you make and review the final edits.
- Substantial generation: A model produces most of a new file or feature that you adapt before submission.
- Autonomous contribution: An agent selects an issue, changes the repository, runs commands, and opens a pull request with little or no human direction.
“AI-generated” therefore does not describe one legal or policy category. A project may allow suggestions and forbid unattended agent submissions, or require disclosure only when generated material remains in the final patch. Read the project’s definitions rather than assuming that every use is treated alike.

Who decides whether your patch is allowed?
The individual repository
Start with the target repository’s CONTRIBUTING file, code of conduct, pull-request template, and any AI-specific policy. Maintainers can set requirements that are stricter than a parent foundation’s guidance. Look for rules about generated code, automated pull requests, disclosure, testing, signed commits, and who may submit changes.
The sponsoring foundation
Foundation guidance can establish a useful baseline, but it does not guarantee acceptance. The Linux Foundation says that “Code or other content generated in whole or in part using AI tools can be contributed to Linux Foundation projects,” subject to compatible tool terms and clearance or attribution of included third-party material. It also recognizes that individual projects may adopt their own guidance.
The Apache Software Foundation (ASF) similarly permits AI-generated code conditionally. Its guidance is described as evolving and, as of August 2026, asks contributors to be reasonably certain that they have the rights needed to submit the work and that copied third-party material is absent or properly handled.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsYour employer or client
An employer may prohibit particular tools, require that source code never be sent to an external service, or demand an internal approval and disclosure record. Those obligations apply even when the public repository would accept AI-assisted code. Check them before pasting proprietary code into a model.
Four checks to complete before opening a pull request
1. Confirm the repository’s contribution rules
- Read the current
CONTRIBUTINGguide and any AI policy in the repository. - Inspect the pull-request template for required fields or disclosure text.
- Search recent maintainer comments and issue guidance for restrictions on bots or autonomous agents.
- Ask a maintainer when the policy is unclear, especially if most of the patch was generated or an agent opened the change.
Do not infer permission from the fact that another contributor used AI. A project can change its policy, and a previous pull request may have been handled under different rules.

2. Check that you can grant the required rights
Being allowed to use an AI tool is not the same as owning or being able to license every output. Read the tool’s current terms for output ownership, licensing, restrictions on commercial or open-source use, and treatment of submitted prompts or code. Then compare those terms with the repository’s license and contributor agreement.
ASF guidance emphasizes that a contributor must be entitled to grant the ASF a license broad enough for the project. The Linux Foundation likewise says tool terms must not conflict with project requirements. If the tool gives you no usable rights, imposes an incompatible restriction, or leaves the rights question unresolved, do not submit the affected output without obtaining project-specific advice.

3. Investigate third-party material
A model can reproduce code, documentation, or other material from elsewhere. If your patch contains copied or substantially similar material, identify its source and license. Follow the repository’s ordinary process for permission, notices, attribution, and license files.
Similarity scanners can help you find leads, but they are not clearance certificates. ASF notes that many tools do not reveal similarity to training data and that scanners generally match only known open-source code. A clean scan cannot prove that a patch contains no third-party material; a match is a prompt to investigate, not automatic proof of infringement.
4. Perform a human review you can defend
Read every generated line. Check behavior, error handling, security, dependencies, performance, tests, and consistency with the project’s design. Run the project’s required test and lint commands, and add tests for new behavior where appropriate.

Apache Lucene’s policy makes the accountability requirement explicit: contributors must understand and explain their work in their own words. If you cannot describe why a change is correct, how it fails, and why its dependencies are acceptable, you are not ready to submit it—regardless of whether the code compiles.

| Project or organization | Stated position | What you should do |
|---|---|---|
| Linux Foundation projects | AI-generated code or other content may be contributed when tool terms are compatible and included third-party material is cleared and attributed. Individual projects and employers may be stricter. | Read the specific project policy, verify your rights, and handle third-party notices. |
| Apache Software Foundation | AI-generated code is acceptable conditionally. Contributors need sufficient rights, must address third-party material, and should record the tool used in the commit message. | Check output terms and provenance; treat scanners as incomplete evidence. |
| Apache Lucene | AI may be used as a coding tool, but contributors must understand and explain the work. Autonomous-agent contributions are disallowed. | Keep a human in control of the contribution and be prepared to explain every change. |
| Linux kernel | Contributions must meet kernel licensing requirements and carry a human contributor’s sign-off. Code without a compatible license or with copyright problems is not acceptable. | Follow the kernel’s licensing rules and sign-off process; AI use does not replace them. |
These are examples of variation, not a survey of all open-source repositories. A permissive statement from one organization cannot be generalized to another project.
Disclosure: when and how to mention AI use
Disclosure requirements differ. Some projects ask for no special notice when AI was merely an editing aid; others want a statement whenever generated code remains in the patch. Follow the repository’s requested format first.
ASF recommends recording the tool used in the commit message, with an example such as Generated-by: <Name of Tool> <Version>. That is a recommendation from ASF, not a universal token. Do not add it mechanically if the target project specifies a different field, forbids automated attribution, or asks for a pull-request explanation instead.
The Linux Foundation’s emphasis is notice and attribution for included third-party rights. That is different from simply announcing that an AI tool was used. If generated output contains material under another license, disclose and attribute it according to the applicable license and the project’s procedure.

Copyright, licensing, and authorship questions
Does AI output automatically belong to me?
No single answer applies worldwide. ASF notes that the copyrightability of AI-generated output is unsettled and can differ by jurisdiction. More importantly for contribution review, a project may still require you to have permission to submit the material and to grant the project its license. Do not rely solely on an argument that a particular output is not copyrightable.
What if the model copied an existing implementation?
Treat a substantial match as third-party material until you establish otherwise. Locate the original, read its license, and determine whether the project can accept it. Add required attribution and notices, seek permission, or rewrite the change from your own design when the license is incompatible or the source cannot be verified.
Who is responsible after submission?
The human contributor remains accountable for the patch. You are the person representing that the contribution follows the project’s process and that you can grant the required rights. An AI system cannot sign a contributor agreement, answer a maintainer’s design questions, or correct a security defect on your behalf.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Human sign-off and contributor agreements
Normal contribution formalities continue to apply. Linux kernel documentation requires a contributor sign-off and compatible licensing; the sign-off is a human attestation, not an AI-generated formality. Apache projects may require an Individual Contributor License Agreement (ICLA) for maintainers and for certain large contributions. Check the project’s current instructions to determine whether an agreement, corporate authorization, or identity verification is required.
Signing a certificate or agreement does not cure an unlicensed dependency, copied code, or a breach of your employer’s policy. Complete the legal and technical checks before signing.
Best Value
A practical, repeatable workflow
- Define the change. Write the intended behavior, affected components, constraints, and acceptance tests before asking a model for code.
- Protect sensitive material. Remove secrets and confidential source, and follow your employer’s rules about external tools.
- Generate small, reviewable units. Prefer a function, test, or documentation edit over an opaque, repository-wide rewrite.
- Record provenance. Keep the tool name and version, relevant prompts, and the date in your internal notes when policy or compliance requires an audit trail.
- Review and test. Compare the output with project conventions, run tests and static checks, and inspect dependency and security changes.
- Check for matches. Investigate suspiciously distinctive code or text and resolve licenses and attribution before submission.
- Prepare disclosure. Use the repository’s pull-request field, commit token, or maintainer-approved statement.
- Complete formalities. Add required sign-offs, contributor agreements, notices, and license files.
- Explain the patch. Describe the problem, design, alternatives, tests, and known limitations without pasting unexplained model output.
Common failure modes and fixes
“The foundation allows AI, so my pull request is automatically permitted.”
Why it fails: Foundation guidance commonly leaves room for project-specific restrictions. Fix: Apply the target repository’s policy and maintainer instructions, which may ban autonomous agents or require a particular disclosure.
“The model generated it, so there are no copyright concerns.”
Why it fails: Output may reproduce third-party material, and copyrightability rules vary by jurisdiction. Fix: Check tool terms, investigate matches, and handle licenses and attribution as you would for any other borrowed material.
“A similarity scan came back clean.”
Why it fails: Scanners cover known code and may not expose training-data similarity. Fix: Combine scanning with human review, source investigation, and a design-level rewrite when provenance is uncertain.
Recommended Free Tools
“I can explain the patch later.”
Why it fails: Projects such as Lucene expect understanding and explanation as part of contribution, not as an afterthought. Fix: Do not submit code you cannot walk through, test, and defend.
“The commit token is universal.”
Why it fails: Generated-by: is an ASF recommendation, not a cross-project standard. Fix: Use the repository’s specified format or ask a maintainer how to disclose.
What maintainers may ask you
- Which tool and version produced or transformed the code?
- How much of the final patch was generated versus written or edited by you?
- Did you send project or customer code to an external service, and was that permitted?
- What tests, security checks, and manual review did you perform?
- Did you investigate distinctive matches or third-party licenses?
- Can you explain the design and make follow-up changes without the model?
Prepare concise, factual answers. A transparent explanation usually helps maintainers evaluate risk; claiming certainty that your checks cannot establish does not.
Is there a universal statistic on how many projects allow AI patches?
No verified, general percentage is established by the policy material summarized here. Policies are changing, repositories differ, and a figure attributed to an unnamed 2022 study is not sufficient evidence for a current industry-wide rate. The reliable answer is project-specific: inspect the rules for the repository where you intend to contribute.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →Bottom line for contributors
AI-generated patches are allowed in some open-source projects, conditionally allowed in others, and prohibited in particular forms elsewhere. Permission depends on the repository’s current policy, the AI tool’s terms, your ability to grant the project the required license, the absence or proper handling of third-party material, and a human contributor who understands and stands behind the code. Check those requirements before opening a pull request, and treat any foundation guidance as a starting point—not a substitute for the target project’s rules.
