Sometimes—but there is no blanket rule. In the United States, whether an AI-generated game mod can be made, shared, or monetized depends on separate questions: what parts of it are copyrightable, whether it uses protected game or third-party material, and what the game’s terms and upload platform allow. A mod can lack copyright protection for its AI-generated elements and still violate a game’s terms or someone else’s rights.
Three separate questions determine whether a mod is allowed
“Legal” can refer to different things. Copyright law, a game’s End User License Agreement (EULA), and a hosting platform’s rules are distinct checkpoints. Passing one does not automatically satisfy the others.

- Can you claim copyright in the mod? That turns in part on whether a human contributed enough original expression.
- Does the mod use material you have permission to use? AI generation does not erase rights in game assets, voices, code, or other creators’ work that the mod copies or adapts.
- Do the game and host permit this use and distribution? Their terms may limit file modifications, ports, uploads, attribution, or monetization even apart from copyright ownership.
These are general U.S.-focused considerations, not a legal determination about a particular mod. Modding law and platform terms vary by jurisdiction, game, and host.
Does AI-generated material have copyright protection?
The U.S. Copyright Office’s Part 2 report on copyrightability, announced January 29, 2025, applies existing copyright principles to generative AI. Its central test is whether a human author determined sufficient expressive elements in the work. The Office says that merely supplying prompts is not enough by itself.

- Compatible with Windows and Android.
- 1000Hz Polling Rate (for 2.4G and wired connection)
- Hall Effect joysticks and Hall triggers. Wear-resistant metal joystick rings.
- Extra R4/L4 bumpers. Custom button mapping without using software. Turbo function.
- Refined bumpers and D-pad. Light but tactile.
Human-authored expression that appears in the result, or a person’s sufficiently creative selection, arrangement, or modification of AI-generated material, may be protectable. Using AI as assistance—or incorporating AI-generated material into a larger work created by a human—does not automatically prevent copyright protection for the human-authored contributions. The Office’s statement is about copyrightability, not permission to use a game’s assets, characters, voices, or code.
For a modder, keep a record of the human work involved: original writing, edits, code decisions, selection and arrangement of generated assets, and development history. That record can help explain the contribution; it does not itself guarantee that the contribution meets the legal standard.

Can a mod use a game’s art, code, voices, or other assets?
Changing a game is not automatically infringement. The World Intellectual Property Organization (WIPO) explains that a mod can introduce material without copying protected game content. But many mods do use or adapt material such as game code, graphics, or other protected elements. Depending on the facts and applicable law, copying, adapting, or distributing that material may implicate copyright rights.

For example, generating a new voice line does not establish permission to use a protected character, imitate or incorporate a third party’s recording, or distribute files containing material extracted from a game. Likewise, a mod can include original human-authored work and still raise a separate issue over the assets it uses.

- The unique floating D-pad rests on four switches-instead of a single pivot point-making it responsive to quick changes in direction.
- The six-foot cord lets you lean back and play a comfortable distance from your PC monitor.
AI model training is another distinct issue. The Copyright Office said a forthcoming Part 3 of its report would address training models on copyrighted works and licensing considerations. The cited sources do not settle whether training on any particular game asset or voice was lawful.
What the game’s EULA can restrict
A game’s EULA and supplemental mod terms are the practical starting point for whether you may modify its files and distribute a mod. WIPO notes that a EULA may limit modification, and that breaking terms can affect the permission under which a player uses the game. The legal effect depends on the applicable terms and law; WIPO’s discussion includes UK litigation concerning cheat software and temporary copies during gameplay, not a universal ruling about mods or a statement of U.S. law.

In the reviewed Bethesda/ZeniMax EULA, ZeniMax and its licensors reserve ownership of game content and restrict unauthorized modification of game-client files. Bethesda’s Terms of Service separately address user-generated content and distinguish Game Mods from other submissions. Those are publisher-specific terms, not rules for every game. Read the current EULA and any supplemental mod policy for the exact game and version you intend to modify.

How Bethesda, Nexus Mods, and Steam differ
These examples illustrate why there is no universal platform ranking. A game publisher’s permission, a host’s upload requirements, and copyright law do different jobs.

| Service or rules | Relevant requirements in the cited terms | AI-specific guidance stated in the cited source |
|---|---|---|
| Bethesda community | Bethesda’s community standards require uploads to be your own work or used with the original creator’s permission. Porting guidance calls for the author’s name, source link, and publicly available permission, with any additional permission required by the author’s terms. Monetized or crowdfunding mod projects are not allowed in that community. | Not stated in the cited Bethesda community rules (Bethesda community standards). |
| Nexus Mods | Reuse permissions are file-specific and can be set only by the original author. If permission information is absent, Nexus says to request permission. These network rules do not determine copyright ownership in every jurisdiction. | Its submission guidance distinguishes AI-Generated Content, AI Media, and AI Assisted. Primarily AI-generated mods should receive the AI-Generated Content tag. An AI-assisted claim requires evidence such as project history and demonstrated knowledge of the work. |
| Steam Workshop | Steam’s Subscriber Agreement says Workshop contributions are generally available for free; paid distribution may be allowed by exception under App-Specific Terms. Contributors represent that they have sufficient rights to grant the required licenses. The agreement also gives Valve specified rights to use and modify contributions. | Not stated in the cited Steam Subscriber Agreement (Steam Subscriber Agreement). |
The Bethesda details above come from its reviewed EULA, Terms of Service, community standards, and porting guidance. Check the actual current terms for the game and destination community: permission to use an asset in one context does not necessarily permit porting, changing, combining, or charging for it in another.
Check a mod before making or uploading it
- Identify the exact game, version, and host. Read the current game EULA, any supplemental mod policy, and the host’s submission rules. Confirm that modding and the planned method of distribution are permitted.
- Inventory every asset and dependency. Record game files, third-party art, voice recordings, music, code, and other mods used, transformed, or redistributed. Check the applicable license or get permission from the rights holder; credit alone is not a substitute for permission when permission is required.
- Document your human contribution. Keep development files and a clear record of original writing, edits, arrangement, selection, and code decisions. Prompts alone do not establish copyright in the AI output under the Copyright Office’s January 2025 guidance.
- Apply the host’s AI disclosure rules. On Nexus Mods, select the category that fits the contribution—AI-Generated Content, AI Media, or AI Assisted—and retain evidence supporting an AI-assisted designation.
- Verify porting, credit, redistribution, and payment conditions. Check the terms for every destination, including the particular Steam app’s App-Specific Terms where relevant. Do not assume permission for one platform or use covers another.
- Keep records if a rights dispute arises. Preserve source files, permission messages, applicable page terms, and upload records. A platform takedown procedure is separate from a final court determination.
What to do if someone reports or removes a mod
Bethesda support directs copyright owners who believe a mod was uploaded without permission to its report process and DMCA notice procedure. Its guidance lists identification and contact details, a good-faith belief statement, and a statement under penalty of perjury among the notice requirements. That is a platform process, not a court ruling on whether a particular mod infringes. If you receive a notice or face a consequential dispute, preserve relevant records and consider advice from a lawyer familiar with the applicable jurisdiction.
