What does Jane Doe allege?
According to a civil complaint filed in September 2026, Jane Doe says the incident occurred at the Chi Phi house on October 19–20, 2024. Reuters reported that the complaint says she had consumed alcohol earlier and alleges that she was given alcohol, marijuana and ketamine before becoming incapacitated and being sexually assaulted by multiple fraternity members. Those are allegations in the complaint and reported accounts, not established findings.

Several of the accused men have denied having nonconsensual sex with her or denied touching her, according to reporting by the Associated Press. The complaint names seven fraternity members, Chi Phi, Cornell, a local bar and Jane Doe’s sorority as defendants. Their inclusion as defendants does not itself establish that any of them violated the law.
How did the case develop?
- October 19–20, 2024: The civil complaint places the alleged assault at the Chi Phi house during this period.
- November 2024: According to the Associated Press, Jane Doe reported the incident to Cornell police. Cornell began its own inquiry, and the university suspended Chi Phi and some students.
- After the initial police review: The local district attorney decided not to bring charges at that time. The Associated Press reported that the decision relied on a campus-police summary rather than a full interview transcript.
- September 2026: Jane Doe filed the civil lawsuit. The district attorney reopened the criminal investigation after the suit, Reuters reported.
- October 2026: Reports said New York Attorney General Letitia James took over the criminal matter as special prosecutor, while Cornell trustees selected former Deputy Attorney General Sally Yates to lead an independent review of the university’s handling of sexual-misconduct complaints and related campus processes.
How are the university, criminal and civil proceedings different?
These processes have different decision-makers and purposes. A university disciplinary outcome is not a criminal conviction; a prosecutor’s earlier decision not to charge is not a finding that an allegation was disproved; and a civil complaint states a plaintiff’s claims, not a court’s conclusion.

What is known about Cornell’s inquiry?
The Associated Press reported that Cornell’s inquiry included 50 interviews with 32 witnesses, 12 hearing days and a 99-page panel report. These figures describe the university’s internal process, not an independent criminal investigation. Cornell has said some students were expelled or suspended but has declined to disclose individual disciplinary outcomes, citing federal privacy law. The Chi Phi chapter remains barred from campus.
Separately, Cornell’s trustees selected Sally Yates to review how the university handled sexual-misconduct complaints and related campus processes. Trustee Chair Anne Meinig Smalling said, “It is imperative that Cornell be willing to examine itself with the same rigor we expect of others.” The conclusions of Yates’s review had not been reported in the October 2026 coverage.

Why did the criminal investigation reopen?
The earlier decision not to bring charges was based on a campus-police summary, according to the Associated Press. Its fact-check reported that the summary did not include statements attributed to Jane Doe in the interview transcript: that later events involved coercion and that she was certain she had been raped. That account helps explain why the summary has been scrutinized; it is not an independent finding about what happened.

Attorney General James said, “We will review the facts, gather evidence, interview witnesses and, if warranted, pursue prosecutions.” Her statement describes the work ahead, not a conclusion or a decision to file charges.
