Anthropic and OpenAI have been negotiating with outside AI evaluators over how safety findings can be released, according to an October 13, 2026 Reuters report. Two people familiar with private discussions told Reuters that the labs sought substantial influence over publication when reports could expose trade secrets. Both companies dispute that the account describes all of their arrangements, and they characterize their safeguards more narrowly.
What Reuters reported
Reuters reporter Aditya Soni wrote that two unnamed people familiar with negotiations said Anthropic and OpenAI had sought significant control over what independent evaluators could publish. The sources were not identified because the talks were private. Reuters also said it reviewed language in certain existing contracts that bars evaluators from publishing confidential information without a company’s consent.

The report describes a rapidly changing set of discussions rather than a finalized industry rule. Sources said that as recently as October 5 the labs were seeking strict editorial control. By October 8, Anthropic’s talks with some evaluators appeared to have changed. Those dates describe what the sources told Reuters; they do not establish that every contract or negotiation followed the same path.
How Anthropic and OpenAI characterize their positions
Anthropic
Anthropic said the Reuters characterization did not accurately describe all of its discussions and work with independent evaluators. The company said that, in current conversations with evaluators it has worked with, reviewers control the evaluation methods, criteria, conclusions and what is published. For new evaluator firms, Anthropic said it reserved a right to comment on and approve reports while the relationship is being established.

OpenAI
OpenAI said it was not seeking approval rights over complete reports. It described a process in which confidential information could be redacted, while evaluators could disclose whether major redactions had been made. That distinction matters: removing trade secrets can protect security and intellectual property, but a company approval requirement could also allow it to suppress an unfavorable conclusion. OpenAI’s statement addresses the former and rejects the latter.
Why confidentiality and independence collide
AI laboratories may legitimately need to protect source code, unreleased model capabilities, training data, security procedures and details that could enable misuse. Yet those same details can be material to a safety assessment. A reviewer who cannot inspect relevant model behavior, training history or incident records may be unable to determine whether a system presents serious risks.

Reuters reported that proposals under discussion included allowing lab employees to observe embedded evaluator teams and preventing evaluators working for one lab from simultaneously working for another. These are reported negotiating ideas, not established rules for the field. Observation can help prevent unauthorized disclosure, while exclusivity can reduce conflicts of interest; either measure can also restrict an evaluator’s independence if the company controls access or future work.
Anthropic’s embedded-evaluator arrangement
Anthropic named Faculty, Accenture’s specialist AI business, as its first embedded evaluator. Reuters reported that the parties were still working out what evaluators could access and how findings would be reported. Faculty CEO Marc Warner told Reuters: “Evaluators are only useful if people can trust what they report, so independence and transparency are critical.”

An embedded team can examine systems in a laboratory’s working environment rather than in a brief external test. Its credibility will depend on the scope of access, the evaluator’s ability to set methods and the publication terms agreed before testing begins.
The policy backdrop
Reuters said independent evaluation was one of four safety measures in the one-page White House Accord on Super Intelligence, signed by President Donald Trump and leading AI executives in late September 2026. The accord did not specify how evaluations should be conducted.

Reuters also reported that a public letter from evaluators had more than 200 signatories. The letter called for independent control of findings, broad access to labs and protection from retaliation. The signatory count is Reuters’ figure and is not independently verified here.

TechCrunch’s September 16 coverage described related evaluator concerns about access, editorial control, restrictive nondisclosure agreements, short review windows and whether teams could examine model checkpoints and training history instead of only finished models. The Associated Press reported broader criticism that company-led self-policing may not provide meaningful oversight, noting that the White House accord contained fewer specific transparency provisions than some earlier voluntary commitments. Those accounts provide policy context, not independent confirmation of the private negotiations Reuters described.

No final, common set of terms has been established across all labs and contracts. Readers, policymakers and customers can nevertheless examine the following questions when a lab announces an evaluation:

| Selection and funding | Who chooses and pays the evaluator, and can renewal or payment depend on a favorable result? |
| Protection and accountability | Can evaluators publish adverse findings without retaliation, and are obligations based on a public standard or only a private contract? |
What the public can and cannot conclude now
The available reporting does not show that Anthropic or OpenAI adopted a single policy giving them control over every outside evaluation. It does show a substantive disagreement over where confidentiality ends and editorial independence begins. Reuters’ most consequential account relies partly on unnamed sources, while the companies’ on-record statements describe narrower arrangements and safeguards. The underlying contracts, the original White House accord and the evaluator letter were not directly reviewed for this article.
Former US Science Envoy for AI and Humane Intelligence PBC CEO Rumman Chowdhury told Reuters: “Evaluators have this very privileged access, but whether explicitly or implicitly, they know that it comes at a cost.” That cost is the central governance question: access supplied by a lab is valuable only if the conditions attached to it do not make an evaluator’s public conclusions effectively subject to the lab being evaluated.
