AI-Generated Code Is Not Automatically Legally Safe: What Developers Should Know

AI-generated code is not automatically copyrighted, original, secure, or cleared for commercial use. Developers should assess human authorship, code matches and licenses, service terms, and ordinary engineering risks separately.

No. AI-generated code is not automatically legally safe. Copyrightability, possible copying or license obligations, software quality and security, and the terms governing your AI service are separate issues. Treat a suggestion as code you are responsible for reviewing—not as code that has been legally cleared. The copyright discussion below is U.S.-focused; rules and contract terms can differ by country, provider, plan, and agreement.

What does “legally safe” mean for AI-generated code?

The phrase can refer to several different questions, and a reassuring answer to one does not settle the others:

  • Can you claim copyright in the code? That depends on the human-authored expression in the work.
  • Does the code reproduce protected expression or trigger a license obligation? A generated suggestion could raise this question even if you cannot claim copyright in all of it.
  • Is the code secure and correct? Legal status does not establish that it works safely.
  • Do the AI service’s terms allow your inputs and intended use? The applicable answer depends on the provider, product, settings, plan, and contract.

These are related risk checks, not interchangeable tests. Passing one does not establish that the code passes the others.

Is AI-generated code copyrighted?

In the United States, AI assistance does not automatically rule out copyright protection, but an AI output is not protected simply because a person prompted the system. In its Jan. 29, 2025 announcement, the U.S. Copyright Office said protection may apply where a human author determines sufficient expressive elements. Human-authored material that is perceptible in the output, or creative human arrangements and modifications, may qualify; merely providing prompts does not establish human authorship. The Office also said AI-generated material within a larger human-generated work does not, by itself, prevent protection of the larger work.

The Office described existing copyright principles as flexible enough to apply to generative AI. That is the Office’s statement, not a court ruling and not a code-specific rule that decides the status of any particular program.

What this means for a developer

Do not assume that prompting an AI gives you exclusive copyright in every line it returns. If protection for your contribution matters, distinguish the output from the human-authored expression, selection, arrangement, or modifications in the finished work. The cited Copyright Office announcement does not create a code-specific recordkeeping requirement.

Can AI-generated code infringe copyright or violate an open-source license?

Potentially. Whether you can claim copyright in your own contribution is a different question from whether generated code reproduces another party’s protected expression or is subject to license terms. A match to existing code is a reason to investigate, not proof of infringement by itself.

GitHub says that matching code does not necessarily mean copyright infringement and that users must decide whether to use a suggestion and what attribution or other license compliance may be appropriate. That is vendor guidance, not an independent legal conclusion. The obligations, if any, depend on the actual code, the relevant license, how the code is used or distributed, and the circumstances.

How to handle a suspicious match

  1. Identify what appears to match. Compare the suggestion with the source you suspect it resembles; do not treat a vague resemblance as a settled legal finding.
  2. Check the source and its license. Work out whether the material is protected, what terms apply, and whether your intended reuse may require attribution, notices, source disclosure, or another action.
  3. Assess the release context. Consider how the code will be incorporated, distributed, or used, since obligations can depend on those facts.
  4. Escalate material uncertainty. Seek legal review for substantial similarity, copyleft questions, proprietary core code, or distribution across jurisdictions.

Does GitHub Copilot check for copied code?

GitHub describes an optional code-referencing filter that can detect and suppress certain suggestions matching public GitHub code. The feature is bounded: GitHub says it is based on matched code segments above a certain length. It should therefore be understood as a mitigation for some qualifying matches, not a guarantee that every suggestion is original, non-infringing, or license-compliant.

Check the setting and the current product description for the Copilot version and account you use. A filter’s existence does not replace reviewing a match or determining what license obligations apply.

How should developers review AI-generated code before release?

Review a generated suggestion as you would any code you are responsible for maintaining and shipping. GitHub’s inline-suggestions guidance warns that generated code may contain vulnerabilities or other issues and that users assume risks including bugs and intellectual-property infringement.

  1. Inspect the diff. Read the generated changes in context; confirm they do what the surrounding code requires rather than relying on a plausible explanation or appearance.
  2. Test behavior. Run relevant tests and check edge cases, failure handling, and compatibility with the project.
  3. Review security. Look for vulnerabilities, unsafe defaults, exposed secrets, and unexpected behavior.
  4. Check dependencies. Confirm that added packages are necessary and review their provenance and applicable terms.
  5. Investigate material similarity. If the output resembles known code, inspect its source and license before release.
  6. Preserve meaningful human work. Where your copyright, customer, or internal policy position depends on human contribution, keep a clear account of substantial human review and modifications.

Can you use AI-generated code commercially?

The cited sources do not establish a blanket yes or no for all AI-generated code or all providers. Commercial use involves the particular output, any relevant third-party rights or license conditions, and the service terms that govern your account. AI assistance alone does not settle those questions.

Before putting sensitive or proprietary code into an assistant, check the terms and data controls for the exact product, plan, organization settings, and customer agreement. GitHub’s Terms of Service documentation describes use of Inputs and Outputs for AI development and improvement subject to opt-out settings or applicable customer agreements. Those provisions are GitHub-specific and can change; do not assume another service follows the same policy.

What should teams compare when choosing a coding assistant?

Compare the controls and responsibilities that affect your workflow, rather than treating a product feature as legal clearance.

What to compare Question to ask
Code-match detection What kinds of matches are detected, what threshold or coverage applies, and is the feature enabled by default?
Match details When a match is identified, are repository and license details available to help assess it?
Input and output data Under the exact plan and contract, how are inputs and outputs retained or used for model development, and what controls are available?
Security and quality What safeguards are provided, and what review responsibilities remain with the user?
Organization controls What policy settings are available to govern use across a team or enterprise?

The cited GitHub material supports these as relevant questions about Copilot; it does not provide a cross-vendor comparison or establish that other products have equivalent features.

What is not settled by these sources?

The U.S. Copyright Office’s Jan. 29, 2025 announcement addresses copyrightability of AI outputs; it does not decide whether training models on copyrighted code is lawful, how pending litigation will be resolved, or the obligations attached to a particular generated snippet. The vendor documentation describes product behavior and terms, not authoritative legal rulings. This article does not establish legal outcomes outside the United States.

The Copyright Office reported that it received more than 10,000 comments by December 2023 in response to its notice of inquiry on copyright and AI. That figure describes responses to the inquiry; it is not a measure of code infringement, developer opinion, or legal outcomes. The cited material also does not establish a reliable general rate of AI-code infringement or the probability that a suggestion will match licensed code.
