AI compliance is not a single certificate or audit: what an organization must do depends on the jurisdiction, the system’s intended use and risk category, its role, and the date the relevant rules apply. This FAQ focuses on the European Union AI Act (Regulation (EU) 2024/1689), using the consolidated text dated 27 July 2026 and European Commission guidance current as of 4 October 2026. It is not a guide to laws in other jurisdictions.
What does AI compliance mean?
AI compliance means meeting the legal and governance requirements that apply to a particular AI system, its use, and the jurisdictions in which it is used or supplied. Under the EU AI Act, obligations vary by system category and by operator role; not every AI tool is subject to the same requirements. Sector-specific rules may also matter.

The Act is binding law for its scope. Risk-management frameworks such as NIST’s AI Risk Management Framework can help organize work, but they do not replace legal obligations.
Who is responsible for AI compliance: the provider or deployer?
Responsibility is not simply handed from vendor to customer. Providers and deployers can have different duties at the same time. The European Commission describes provider responsibility as extending across a system’s lifecycle. The applicable role and system classification should be checked against the Act and the Commission’s Navigating the AI Act guidance.
#1 Best Overall
Provider responsibilities for high-risk systems
For high-risk AI systems, provider duties include ensuring the applicable requirements are met, maintaining a quality management system, preparing technical documentation, keeping required logs, and arranging the relevant conformity assessment before placing the system on the market or putting it into service. Providers also have duties concerning the declaration of conformity, CE marking, registration, and corrective action where needed. The assessment route can depend on the system category and applicable EU product legislation.
Deployer responsibilities for high-risk systems
Deployers must use the system in accordance with its instructions, monitor its operation, and act on identified risks or serious incidents. They must assign human oversight to a person with the competence, training, authority, and support needed to perform it. Where deployers provide input data, they must ensure it is relevant and sufficiently representative to the extent they control the data. Public authorities and providers of public services have additional fundamental-rights impact-assessment duties before first use in covered situations.
Does every AI system need an audit?
No. The EU AI Act does not establish one universal outside-audit requirement for every AI system. For covered systems, the relevant legal process is generally called a conformity assessment, and its route depends on the system, its intended use, and the rules that apply. A voluntary internal review or independent assurance engagement may be useful, but it is not automatically the same as a legally required third-party conformity assessment.

How the conformity-assessment route can differ
Under the consolidated Act, specified Annex III point 1 systems may use internal control or involve a notified body when the Act’s conditions are met. A notified body is required in specified circumstances, including when relevant harmonized standards or common specifications are absent or not applied. Annex III points 2–8 use an internal-control procedure under Article 43(2). Where a system is covered by other EU product legislation, the relevant sectoral conformity-assessment procedure can apply with the AI Act requirements included. A substantial modification may trigger a new assessment.
Before deciding whether outside assessment is required, establish the system category and intended use, whether EU product legislation also applies, whether the relevant standards or common specifications are available and applied, whether the system has been substantially modified, and when the obligations take effect. The specific route must be verified against the legal text; a general FAQ cannot classify an individual system.
What does an AI compliance audit include?
There is no single checklist that applies to every AI system. For a high-risk system, the legally relevant assessment is tied to the requirements and procedure applicable to that system, rather than to a generic audit template. Depending on the case, the compliance work may involve reviewing technical documentation, the quality management system, required logs, conformity-assessment evidence, and the controls relevant to the system’s intended use. The provider and deployer each need to address the duties assigned to their role.

An organization may also commission independent assurance or run internal checks beyond the legal procedure. Those can help identify gaps, but their scope and conclusions should not be represented as a statutory conformity assessment unless they satisfy the applicable legal route.
How much does AI compliance cost?
There is no established standard price or representative average. A 2025 European Commission staff working document, SWD(2025) 836, reports that a small number of respondents estimated overall AI Act compliance costs from €150 to €50,000. This is respondent-reported evidence, not an official fee schedule, a typical cost, or a quote for a particular organization.
The same document identifies hiring or training compliance staff, legal or consultancy fees, and updates to technical processes or systems as important cost drivers. Actual workload can also vary with the system’s risk classification, the number of systems, the quality of existing documentation and controls, needed data work or testing, internal capacity, and whether external legal or assessment support is required. The evidence does not establish the cost for any particular organization.

When does the EU AI Act apply?
The EU AI Act is phased. The dates below reflect European Commission guidance current as of 4 October 2026; the consolidated legal text dated 27 July 2026 is the controlling source where guidance summaries and amendments need to be reconciled. A date may depend on the system category and transition rules, so it should not be treated as a universal start date for every obligation.
| Date | Application described in Commission guidance |
|---|---|
| 2 February 2025 | Prohibitions and AI literacy provisions apply. |
| 2 August 2025 | Governance and general-purpose AI obligations apply. |
| 2 August 2026 | Main application date; certain enforcement powers also became applicable. |
| 2 December 2027 | High-risk rules for Annex III systems apply, according to current Commission guidance. |
| 2 August 2028 | Rules for AI embedded in regulated products apply, according to current Commission guidance. |
Transparency rules and enforcement have specific dates and transition cases beyond this summary. Check the applicable provisions for the system and use in question rather than relying only on the general dates.

There is not one regulator responsible for every AI use case. The European Commission AI Act Service Desk says national competent authorities supervise and enforce rules for AI systems. The AI Office has exclusive enforcement powers for specified general-purpose AI models and certain associated systems. Certain enforcement powers became applicable on 2 August 2026. The division of responsibility depends on the system and the applicable provisions.

Does NIST AI RMF certification equal legal compliance?
No. NIST describes the AI RMF as voluntary: “NIST has produced the AI RMF as a voluntary Framework.” It is intended to help people who design, develop, use, or evaluate AI manage risk. Using it may support an organization’s risk-management work, but it does not by itself demonstrate compliance with the EU AI Act or another law. NIST’s FAQs explain the framework’s voluntary status and scope.
What should an organization do next?
- Define the scope. Identify the AI system, its intended use, where it is supplied or used, and the organization’s role.
- Determine the applicable category and rules. Check the relevant provisions of the consolidated EU AI Act and whether other EU product legislation or sector requirements apply.
- Map role-specific duties. Separate provider obligations from deployer obligations, and identify where both apply within the organization’s arrangements.
- Choose the applicable assessment route. Verify whether internal control, notified-body involvement, or a sectoral procedure applies, including the conditions concerning standards and substantial modifications.
- Plan for the relevant dates. Match the system and obligation to the phased timeline and any transition provisions.
- Estimate work from actual gaps. Review existing staff capacity, records, controls, data and testing needs, and any need for external support rather than treating the reported respondent range as a budget quote.
For a specific system, classification and legal duties should be checked against the applicable text with qualified legal advice where needed.
