Traditional automation typically follows configured rules or steps; an AI agent may choose among actions to pursue a goal. The practical difference is not simply whether a system uses AI: it is how much discretion it has, what it can do without approval, how people can intervene, and how the organization detects and contains failures. “AI agent” is not a separate category under the EU AI Act, so the label alone does not determine legal obligations.
How do AI agents and traditional automation differ?
Think of traditional automation as a workflow whose actions are largely specified in advance: when a condition is met, the system runs a configured step. An AI agent may instead select among available actions to pursue an objective. These are practical descriptions, not universal technical or legal definitions. Either kind of system can have broad effects if it is connected to consequential tools or data.

The most useful comparison is operational: who or what selects the next action, how much can happen without review, and whether a responsible person can detect and correct a problem in time.
| Dimension | Traditional automation (practical framing) | AI agent (practical framing) | What to examine |
|---|---|---|---|
| Action selection | Often follows a predefined sequence or ruleset. | May choose among actions to pursue an objective. | Can an operator inspect why an action was selected? |
| Autonomy | Often bounded by configured steps, though integrations can still create broad effects. | Varies with design, available tools, and operating context. | Which actions can run without approval, and where are the limits? |
| Intervention | May rely on stop conditions or manual review. | Needs clear monitoring and, where appropriate, override, reversal, or stop mechanisms. | Can an assigned person intervene in time and with authority? |
| Failure modes | Rule errors, incorrect inputs, integration failures, or unexpected edge cases. | May share those issues and add model errors, over-reliance, feedback loops, and model-specific attacks. | What is logged, detected, contained, and recoverable? |
| Accountability | Often assigned to workflow owners and system operators. | Can involve provider and deployer roles as well as organizational owners. | Who approves use, monitors operation, investigates incidents, and records decisions? |
What does meaningful human control require?
For high-risk AI systems covered by the EU AI Act, Article 14 requires human-oversight measures during use. The measures must be proportionate to the risks, the system’s autonomy, and its context. Oversight is more than placing a person in an approval queue: assigned people should be able to monitor performance, understand relevant capabilities and limitations, interpret outputs, and disregard, override, or reverse them where appropriate. Read Article 14: Human oversight.

The Act’s Recital 73 further emphasizes operator responsiveness and, where appropriate, built-in operational constraints that the system itself cannot override. It also points to the competence, training, and authority needed by people assigned to oversight. A checkpoint is not meaningful if the reviewer lacks the information, time, or power to stop the action. Read Recital 73.
What risks should teams plan for?
A wrong output is only one possible failure. The EU AI Act’s accuracy, robustness, and cybersecurity provisions address resilience to errors, faults, and inconsistencies, as well as feedback-loop risks for systems that continue learning and technical vulnerabilities such as adversarial inputs or data poisoning. These are requirements for systems within the Act’s scope; they do not mean every agent is high-risk or that the Act applies outside its jurisdiction and scope. - Plan for containment and recovery: decide what gets logged, how failures are detected, and how affected workflows can be stopped or restored.
- Review the system after deployment: assign responsibility for monitoring operation and investigating incidents rather than treating launch approval as the end of oversight.
Who is accountable for operation and oversight?
Accountability should be assigned before deployment, not inferred from whether a system is called an agent. In the EU high-risk context, provider and deployer obligations differ. The European Commission’s overview describes deployer duties that include oversight and monitoring, and provider post-market monitoring. An organization should identify who approves the use, who operates and monitors it, who can intervene, and who investigates and documents incidents.
