6 Workplace Data Privacy Risks and Ways to Reduce Them

Workplace privacy risks include phishing, excessive monitoring, unnecessary data retention, unauthorized access, weak vendor safeguards, and insecure disposal. Here is how employers can address each one.

Common workplace data privacy risks include phishing, intrusive employee monitoring, collecting or keeping more information than necessary, unauthorized access or accidental disclosure, weak third-party safeguards, and insecure disposal or breach response. Employers can reduce them by limiting data collection, restricting access, reviewing vendors, training staff, and preparing clear retention and incident-response procedures.

What are common data privacy risks in the workplace?

These six risks cover both privacy harms caused by an employer’s own data practices and security failures that expose personal information. They are practical categories, not a worldwide ranking: the available figures come from different countries, populations, and reporting systems.

1. Phishing and social engineering

Fraudulent emails, messages, links, or calls can persuade an employee to reveal personal information, disclose credentials, or grant access to an account. A European Commission release on 30 September 2026 reported that three in four employees surveyed in the EU had encountered suspicious emails, messages, or links at work. In that employee-reported survey, 39% reported phishing, 18% attempts to steal personal data, 16% password-theft attempts, 17% malware attacks, and 15% AI-generated scams. These are survey responses, not confirmed breach rates or estimates for workers outside the EU. European Commission survey findings

In a separate UK survey of organisations, phishing remained the most prevalent attack type: 38% of businesses and 25% of charities reported experiencing it. The Cyber Security Breaches Survey 2025/2026 was published on 30 April 2026 and its fieldwork took place from August to December 2025; those figures describe UK organisations, not individual employees worldwide. 2. Excessive or opaque employee monitoring

Workplace monitoring can involve location, communications, keystrokes, webcam images, or information that reveals details about a worker’s home and family life. Monitoring may create a privacy risk even when no hacker or data breach is involved: the issue can be the information the employer collects, the reason for collecting it, and how it is used or retained.

The UK Information Commissioner’s Office (ICO) says workers’ privacy expectations are likely to be greater at home, where monitoring is more likely to capture information about family or private life. It advises employers to identify a clear purpose, process information fairly and lawfully, weigh business interests against workers’ rights, and choose the least intrusive method that achieves the purpose. ICO guidance on monitoring workers

Canada’s privacy regulator likewise advises targeted, appropriate monitoring and collecting only what is necessary. Applicable legal requirements vary by jurisdiction, worker status, sector, and data type.

Computer Privacy Screen Filter for 24 Inch 16:9 Aspect Ratio Monitor
  • Privacy Screen Filter Size: If the visible area of your display has the following dimension: Width x Height (Exclude Frame/Arrow 1 to 3 mm errors): 20 15/16" x 11 13/16" (532 mm x 299 mm), then this filter is good for you. Very Important to double check your screen's Width and Height excluding frame before ordering. It's not recommended to make your selection based solely on your screen's diagonal size

  • Matte and Glossy Sides: It's a reversible privacy screen filter, giving you the flexibility to choose glossy or matte finish. The matte side will have less glare, however the glossy side will have stronger privacy
  • Perfect for Open Workspaces: Ensure your working space is bright and well lit. Privacy screens do not work in dimly lit areas
  • Two Installation Option: Option 1 uses clear double side adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to take out the privacy screen filter easily as needed

3. Collecting or retaining more information than needed

Extra copies of employee records, broad surveillance, and records kept indefinitely increase the volume of personal data that could be misused or exposed. They can also make it harder to identify who has access and when information should be deleted.

Canada’s Office of the Privacy Commissioner says: “Only collect the personal information that is necessary for a stated purpose, and collect it by fair and lawful means.” Its workplace guidance also advises telling employees what information will be collected and how it will be used, and setting out retention periods in monitoring policies. The UK ICO says employers should document the purpose for monitoring and should not monitor workers “just in case.” Office of the Privacy Commissioner of Canada: Privacy in the Workplace ICO guidance on monitoring workers

4. Unauthorized access, insider misuse, and accidental mishandling

Information may be exposed when an employee with legitimate credentials looks at records without authorization, access permissions are broader than a role requires, correspondence goes to the wrong recipient, or a social-engineering attack compromises an account. Mistakes in data entry, labels, or handling can expose information without any malicious intent.

For Canadian business breaches reported under PIPEDA in fiscal year 2025–2026, the Office of the Privacy Commissioner reported that unauthorized access accounted for 78% of reported breaches. Among those reported unauthorized-access breaches, 68% involved cybersecurity incidents, 13% social engineering, and 8% employee misuse of access privileges. These are Canadian regulator-reported figures for that reporting period, not universal rates. In the same annual report, mishandling—including data-entry, misdirection, or labelling errors—was the most common cause of reported breaches under the federal Privacy Act, with 368 cases. 5. Weak safeguards at third-party providers

Payroll, HR, hosting, and monitoring providers may handle sensitive worker information. Outsourcing a service does not remove the employer’s responsibility to decide why and how monitoring happens. The UK ICO advises employers not to assume that a purchased application complies with data-protection law; they should check the provider’s competence and put appropriate contractual arrangements in place.

For restricted international transfers from the UK, the ICO guidance describes adequacy regulations or appropriate safeguards and a transfer risk assessment as relevant routes. These are UK-specific considerations; other jurisdictions may impose different requirements. The ICO’s monitoring guidance page is marked as under review following legislative changes made by the Data (Use and Access) Act, so its current text should be checked when applying it. 6. Insecure disposal and unprepared breach response

Paper records, old computers, and portable storage can expose personal information if they are discarded without secure disposal. A breach can also become harder to contain when staff do not know whom to contact, what to preserve, or how to escalate a suspected incident.

The US Federal Trade Commission advises businesses to securely dispose of information they no longer need, use a written retention policy for records they must keep, and make sensitive paper unreadable before disposal. It specifically recommends shredding, burning, or pulverizing paper records, and making shredders available throughout the workplace, including near photocopiers. It also advises having an incident-response plan and promptly investigating incidents. FTC guide to protecting personal information

How can employers reduce workplace privacy risks?

Build safeguards around the information’s full life cycle: decide what is needed, limit who can use it, protect it while it is held, and dispose of it securely when the purpose or applicable retention requirement ends.

  • Secure disposal and response. Make sensitive paper unreadable before disposal, including for home workers. Assign internal response responsibilities and define how incidents are escalated and investigated.

These measures are consistent with the Canadian workplace privacy guidance and the FTC business guide; legal obligations differ across jurisdictions.

How should employers assess workplace monitoring?

Before introducing or expanding monitoring, assess whether the proposed information collection is necessary and proportionate to a defined purpose. A useful review considers the sensitivity and volume of data, likely privacy effects, expected effectiveness, less intrusive alternatives, retention, transparency, and workers’ expectations—particularly when monitoring people at home.

  1. Define the purpose. Write down the specific business objective and why monitoring is needed to achieve it.
  2. Test necessity and proportionality. Consider what information the method captures, how intrusive it is, and whether a less intrusive approach could meet the objective.
  3. Set boundaries. Decide what will be collected, who can access it, how it will be used, and how long it will be retained.
  4. Explain the practice. Give workers clear information about the monitoring and its purpose, including relevant details about collection and use.
  5. Assess the risks. The ICO recommends considering a data protection impact assessment (DPIA). Under the UK guidance, if a DPIA identifies high residual risk that cannot be reduced, the employer must consult the ICO before proceeding.

The ICO’s core instruction is: “You must be clear about your purpose and select the least intrusive means to achieve it.” Its guidance is UK-specific and currently marked under review after changes made by the Data (Use and Access) Act. ICO guidance on monitoring workers

What should employers check before using a data-handling provider?

  • Which personal information the provider can access, and whether that access is limited to what the service needs.
  • Who decides the purposes and means of processing, and which responsibilities each party has accepted in the contract.
  • What safeguards the provider uses and whether its competence is appropriate for the sensitivity of the information.
  • Where information is stored or accessed, and which international-transfer rules apply in the relevant jurisdiction.

For UK restricted international transfers, the ICO describes adequacy regulations or appropriate safeguards and a transfer risk assessment as relevant routes. Do not assume that the same legal mechanism applies in other countries. ICO guidance on monitoring workers
