Updated August 18, 2026: TikTok did not shut down nationwide in 2020. The Trump administration threatened restrictions and pursued a possible sale, but court challenges stopped the planned shutdown. Montana’s separate statewide ban came in 2023 and was blocked before it could take effect.
What the 2020 TikTok shutdown threat was
In August 2020, President Donald Trump’s administration treated TikTok as a national-security concern and issued executive orders seeking to restrict certain TikTok-related transactions in the United States unless ByteDance divested the business. The measures were not a completed nationwide shutdown: they were an attempt to constrain TikTok’s U.S. operations and push a sale or restructuring. TikTok challenged the actions in federal court. Why users thought TikTok might disappear
“Shut down” could describe several different outcomes, and they are not interchangeable. Restrictions on app-store distribution might prevent new downloads without immediately disabling every existing installation. Limits on commercial transactions or technical support could, in turn, make the service harder to maintain or update. A forced sale could also have changed ownership, management or control of the recommendation algorithm. Those were potential consequences behind the 2020 headlines; they did not add up to TikTok going offline for all U.S. users that year.
Montana’s restrictions came later
2022: State-government devices and networks
Montana’s first action was narrower than a public ban. On December 16, 2022, Governor Greg Gianforte directed executive-branch agencies to prohibit TikTok on state-issued devices and state networks, with limited exceptions. That restriction concerned government technology, not a statewide ban on private citizens’ phones. Montana governor’s December 2022 memorandum

2023: A law aimed at statewide availability
In May 2023, Montana enacted Senate Bill 419, seeking to prohibit TikTok from operating within the state and mobile app stores from offering it for download there. The law set January 1, 2024, as its intended effective date. Its penalty provision specified $10,000 for each discrete violation and an additional $10,000 for each day a violation continued, subject to the statute’s terms, including an affirmative defense where an entity could not reasonably have known the violation occurred in Montana. That statutory text describes what Montana attempted to do; it does not mean the ban took effect. A federal judge issued a preliminary injunction on November 30, 2023, before the intended start date, preventing enforcement. Why a judge blocked Montana’s law
The court concluded at the preliminary-injunction stage that TikTok and its users were likely to succeed on several claims. Those included First Amendment and Commerce Clause arguments, claims that federal foreign-affairs authority or Section 721 of the Defense Production Act preempted the state law, and the argument that the ban was not sufficiently narrowly tailored to Montana’s stated concerns.
These were preliminary findings used to decide whether enforcement should be stopped while the case proceeded—not a final ruling after a full determination of the merits. Montana officials cited data-collection and Chinese-government-access concerns; TikTok disputed those claims and described its data-security efforts. How the federal case changed the picture in 2025
A later federal law—the Protecting Americans from Foreign Adversary Controlled Applications Act—created a different rule from either the 2020 orders or Montana’s statute. It restricted covered applications under foreign-adversary control unless there was a legally sufficient “qualified divestiture.” The Supreme Court upheld the federal law on January 17, 2025; it took effect on January 19, 2025. The Court upheld the law, not TikTok’s business practices. The Congressional Research Service explains the law and its relationship to the Montana appeal in Montana’s TikTok ban before the Ninth Circuit and its TikTok FAQ.
Montana had appealed the injunction, but the Ninth Circuit stayed the appellate proceedings pending developments in the federal litigation. After the federal law was upheld, the Congressional Research Service noted that the federal resolution could make issues in Montana’s appeal moot or substantially affect them. That changed the legal landscape; it does not by itself establish that Montana’s statute was formally repealed or that every Montana-specific question received a final disposition.

What TikTok’s U.S. joint venture means
On January 23, 2026, TikTok announced that TikTok USDS Joint Venture LLC had been established to operate its U.S. service. According to the company’s announcement, the joint venture is majority American-owned and is responsible for U.S. data security, algorithm security, content moderation and software assurance. TikTok said ByteDance retained a 19.9% stake, while Silver Lake, Oracle and MGX each held 15%. These ownership and governance details are TikTok’s own claims. TikTok USDS Joint Venture announcement

What is known about TikTok in Montana now?
The available official material establishes that SB 419 was blocked before its January 1, 2024 intended start date, and TikTok’s January 2026 announcement says its U.S. service remains available to Americans. Its current U.S. terms identify the joint venture as the U.S. operator. These facts do not verify whether Montana’s statutory text was later repealed, formally resolved or remains subject to a particular state enforcement position. A state-government device restriction is also distinct from the law aimed at private users and app-store availability.
