Why Small Contractors Face Serious Liability When a Worker Is Hurt on a Job Site

A small contractor can face OSHA citations after a jobsite injury even if the injured worker is employed by another company. On a multi-employer worksite, OSHA looks at each employer’s role in the hazard and what it did about it. That enforcement question is separate from workers’ compensation, a private injury claim, insurance coverage, and how a contract allocates costs.

Why OSHA may look beyond the injured worker’s employer

On a site where several employers are working, OSHA may assess whether an employer created a hazardous condition, exposed its workers to it, was responsible for correcting it, or controlled the worksite. The agency’s Multi-Employer Citation Policy describes these four roles and directs inspectors to consider the actual facts at the site. One employer may have more than one role. OSHA puts the key point plainly: “more than one employer may be citable for a hazardous condition that violates an OSHA standard.” That statement comes from an OSHA interpretation dated July 20, 2012; it describes the agency’s policy, not a finding that every employer at an injury scene is liable. How OSHA assesses an employer’s role

OSHA’s policy uses a two-step approach: identify the employer’s role in relation to the hazard, then assess whether the employer took the steps expected for that role. The level of care is not identical for every employer. OSHA’s Multi-Employer Citation Policy

Creating, exposing, and correcting

  • Creating: The employer caused the hazardous condition.
  • Exposing: The employer’s own employees were exposed to the hazard.
  • Correcting: The employer was responsible for correcting the hazard.

These categories help OSHA evaluate which employers may be responsible for a condition and whether they acted adequately. A subcontractor may be directly responsible for hazards arising from its work or for protecting its own employees; another employer may have a different role on the same site. Controlling the worksite

A controlling employer has general supervisory authority over the worksite, including the power to correct safety violations or require others to correct them. That authority can come from a contract, a combination of contractual rights, or broad control exercised in practice. A company’s title—such as prime contractor or subcontractor—does not by itself settle whether it has control; the authority it actually holds matters. OSHA says a controlling employer must use reasonable care to prevent and detect violations. The directive describes that as less than the measures expected of an employer protecting its own employees: a controlling employer is not normally required to inspect as often or to have the same level of standards knowledge and trade expertise as the employer it hired. OSHA citations are only one kind of exposure

“Liability” can refer to several separate legal and financial questions. An OSHA citation concerns compliance with workplace-safety requirements; it does not, by itself, decide who owes workers’ compensation benefits, whether a private injury claim succeeds, what an insurance policy covers, or which party ultimately bears a cost under a contract.

Workers’ compensation

Workers’ compensation rules depend on the applicable state or other jurisdiction and the employment and contracting facts. The U.S. Department of Labor provides a directory of state and territorial workers’ compensation officials for locating the relevant agency. Without a specific location and facts, no single nationwide benefit or responsibility outcome can be stated.

Private claims and contract terms

OSHA says its interpretations do not decide state-law tort remedies. In a separate interpretation about floor-hole covers, the agency also explains that allocating costs between parties by contract is outside OSHA’s authority. A private claim or dispute over costs may require review of state law, the contract, who created or controlled the condition, and other incident facts. OSHA interpretation letters explain how the agency views requirements in particular circumstances; they do not create additional employer obligations or replace the governing standard or a court’s decision. What small contractors can do before an injury

Clear responsibilities and prompt action can help contractors manage safety duties that apply to their work and authority. OSHA’s construction standard includes provisions on accident prevention. 29 CFR 1926.20, General safety and health provisions

  • Identify who is responsible for each work activity and the hazards it may create.
  • Understand what authority contracts give each company to stop work, correct a hazard, or require another party to act.
  • Address hazards your business creates and take action when your role gives you responsibility or authority to require correction.
  • Make sure coordination and escalation procedures work across the employers on site.

A written agreement can help clarify responsibilities, but it does not, by itself, establish who OSHA considers responsible under the facts or eliminate duties an employer independently has. What facts matter after a jobsite injury

For an actual incident, separate established facts from conclusions about legal responsibility. The information needed to assess the OSHA question includes:

  • Which company employed the injured worker, and what work was being performed?
  • What was the hazardous condition, and which employer created it?
  • Which workers were exposed to it?
  • Who had responsibility or authority to correct it, stop the work, or require correction?
  • What do the relevant contracts say, and what authority was exercised in practice?
  • What steps were taken before and after the hazard was identified?
  • Which state or other jurisdiction is involved?

These facts can point to different answers for OSHA enforcement, workers’ compensation, and a private dispute. OSHA cautions against deciding how its policy applies from a hypothetical scenario because actual site circumstances may differ. OSHA’s November 9, 2017 interpretation

Who can take a hazardous electrical cord out of service?

That depends on the employers’ roles and authority on the particular site. OSHA has addressed multi-employer responsibilities involving electrical cords, but the interpretation does not make a job title alone decisive. The relevant questions include who encountered or created the hazard, who was exposed, and who had authority or responsibility to act.
