Who Is Responsible When an AI Agent Causes Damage?

No single rule assigns liability for every AI-agent mishap. The answer depends on the harm, jurisdiction, and duties of the people and organizations behind the system.

There is no universal rule that automatically makes one person or company liable whenever an AI agent causes damage. The answer depends on where it happened, what kind of harm occurred, and the duties and relationships of the people and organizations that selected, supplied, configured, controlled, or used the agent. In a UK consumer-law context, the Competition and Markets Authority (CMA) says a business remains responsible for unlawful consumer-facing conduct by an agent it uses—even if another company designed or supplied it. That is not a rule for every kind of damage or every jurisdiction.

What does “responsible” mean?

Several different questions can arise after an agent causes harm, and an answer to one does not settle the others:

  • Who had a duty to prevent the conduct? A regulator or law may impose obligations on a business, provider, deployer, or public agency.
  • Who must correct or stop it? An organization may need to intervene, fix a system, or address a consumer complaint.
  • Who owes compensation? That depends on the applicable civil law, the facts, and any relevant contracts. The official materials discussed here do not determine who would owe damages in a particular incident.

An AI agent is not a legal person that replaces the people and organizations involved. Its autonomy, by itself, does not decide who is liable. A developer, supplier, business user, customer, or another party may have different roles and duties; which ones matter depends on the law governing the incident.

What do official rules say in the UK, EU, and Australia?

The official sources address different questions. The CMA discusses UK businesses’ consumer-law responsibilities; the European Commission explains AI Act coverage; and Australian Government guidance sets governance expectations for government agencies. None provides a universal damages-allocation rule.

United Kingdom: a business cannot blame the agent for unlawful consumer conduct

The CMA says consumer law applies whether a decision is made by a person or AI. Its guidance addresses business-to-consumer uses such as marketing, refunds, customer-service answers, and deal comparison. It states: “Ultimately, you will be responsible if an AI agent does something illegal, so it is important to make sure you think about compliance with consumer law from the start.” The guidance says this remains the case when another party designed or provides the agent.

This is a specific point about UK consumer-law responsibility for businesses using agents with consumers. It does not establish that a UK business is automatically liable for every injury or financial loss, nor does it rule out possible claims against developers or suppliers under other legal theories.

European Union: the AI Act covers agents, but does not decide every compensation claim

The Commission’s AI Act Service Desk says “AI agent” is not a separate legal category under the Act. Instead, agents generally fit the Act’s existing definitions of an AI system and, where relevant, a general-purpose AI (GPAI) model. In the FAQ’s words, “the definitions of an AI system in Article 3(1) AI Act and of a GPAI model in Article 3(63) AI Act are sufficient to cover AI agents.”

The Commission’s FAQ says transparency rules apply from 2 August 2026 for agents intended to interact with natural persons or generate content. It identifies later dates for certain high-risk requirements, depending on classification. Those are regulatory obligations, not a statement that one named party must compensate anyone harmed by an agent. The Commission also describes its considerations as preliminary because agent development is evolving quickly.

Australia: government-agency guidance emphasizes human accountability

The Australian Government addendum supplements its AI technical standard and applies to agencies exploring or using agentic AI. It says agencies should identify what agents are responsible for while assigning a human accountability for decisions and outcomes, including in multi-agent systems. It also calls for documented, auditable records; human-in-the-loop or human-on-the-loop oversight; and a way for people to intervene in irreversible or high-risk actions.

The addendum captures its approach this way: “In an agentic system, agents are tasked with actioning responsibilities, while a human should be assigned accountability for the decisions made by these agents.” This is government-agency governance guidance, not a general private-sector civil-liability statute.

How can you assess an actual incident?

To understand who may be responsible, first establish what happened and which legal duties could apply. The following questions help organize the facts; they do not determine liability on their own.

  1. Describe the harm and where it occurred. Distinguish, for example, an unlawful consumer interaction from a physical injury, financial loss, privacy issue, or other harm. The type of claim and jurisdiction can change which rules matter.
  2. Map the people and organizations involved. Identify who selected, supplied, configured, integrated, controlled, and used the agent. Record who set its permissions, goals, safeguards, and escalation rules.
  3. Establish what the agent did and what people knew. Preserve relevant prompts, outputs, tool calls, settings, logs, approvals, alerts, and communications. Note whether a person reviewed the action, could intervene, or was alerted to a problem.
  4. Identify the potentially relevant duties. Consider consumer-law obligations, regulatory requirements, contracts, and any other law that may apply in the jurisdiction. A rule about system governance or classification is not automatically a rule about who pays compensation.
  5. Get advice for the specific jurisdiction and claim. The sources described above do not resolve defenses, fault-sharing, or damages for a particular event. Someone facing a real loss or claim should consult a qualified lawyer in the relevant jurisdiction.

What should a business do before an agent causes harm?

For UK businesses using agents with consumers, the CMA recommends treating consumer-law compliance as part of deployment rather than assuming the system will behave correctly. Its practical guidance points to training, testing, monitoring, active human oversight, and prompt action when a problem is found.

  • Train and configure the agent to respect statutory and contractual consumer rights.
  • Test how it handles consequential tasks such as marketing, refunds, service answers, and deal comparisons.
  • Monitor real-world results and provide active human oversight, with a clear route to intervene.
  • Keep records that help establish what the agent did, who was accountable, and how the issue was handled.
  • Act quickly when the agent causes or appears likely to cause a compliance problem.

These controls can help an organization detect and address problems; they do not guarantee that an agent will never cause harm or decide a later compensation claim.
