A delayed employment-based green card does not, by itself, extend your right to work or remain in the United States. Tech workers should first identify their current status and expiration date, then check whether an AC21 H-1B extension, AC21 job portability, a still-available immigrant-visa path, or another temporary classification fits the documented facts. These routes are separate, conditional benefits—not automatic consequences of a backlog—and should be assessed with qualified U.S. immigration counsel.
This overview reflects USCIS materials available as of October 13, 2026. It is general information, not an individualized eligibility opinion.

Start with the issue that expires first: work authorization
A priority date, an approved I-140, or a pending green-card case is not the same thing as permission to work. Employment authorization normally comes from a valid nonimmigrant status, an employment authorization document (EAD) issued under a qualifying benefit, or another specifically authorized basis. If that authority expires, the fact that an immigrant case is delayed does not automatically cure the gap.
Before choosing a strategy, assemble a one-page timeline containing:

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- Your current status (for example, H-1B), I-94 expiration date, visa-stamp validity, and any prior extensions or status changes.
- The employer, legal entity, worksite, job title, duties, salary, and requested employment dates.
- The dates and current status of any labor-certification application, I-140 petition, and I-485 adjustment application.
- Your employment-based preference category and country of chargeability.
- Any periods outside the United States, prior status violations, job changes, or periods without employment authorization.
- Planned international travel, consular processing, or a possible employer change.
Those facts determine which rules apply and when a filing must be made. Do not assume that an option that works for one engineer, product manager, or founder works for another person in the same industry.
Can an H-1B be extended beyond the usual six-year limit?
Sometimes. The American Competitiveness in the Twenty-First Century Act (AC21) permits certain H-1B workers to remain in H-1B status beyond the normal six-year maximum when an employment-based immigrant process has reached specified milestones. USCIS interim guidance describes extensions in one-year increments when at least 365 days have passed since the filing of a qualifying labor-certification application or employment-based immigrant petition, subject to the applicable statutory and procedural conditions.
What must be checked
The extension analysis is chronological. Counsel will typically verify:
- Whether the underlying filing is a qualifying labor-certification application or employment-based immigrant petition.
- The exact filing date and whether the filing remains pending, was approved, denied, withdrawn, or otherwise ended.
- Whether the 365-day threshold was met before the requested H-1B extension period.
- How much H-1B time has been used, including time that may be recaptured for days spent abroad.
- Whether the worker maintained valid H-1B status and whether the requested start date is legally supportable.
- Whether a visa number is unavailable because of the worker’s category or country of chargeability, or whether another statutory limitation applies.
The USCIS memorandum discusses separate statutory pathways and the importance of valid status and requested start dates. It is interim guidance, not a promise of approval. A delayed green card alone does not qualify every H-1B worker for an extra year.

What an H-1B extension does—and does not do
An approved extension can preserve employment authorization for the petitioning employer during the approved validity period. It does not make the green card current, confer permanent residence, or authorize work for an unrelated employer. A new employer generally needs its own H-1B filing and must satisfy portability and other H-1B rules. If the immigrant filing that supported an extension is withdrawn or no longer qualifies, future extensions may be affected.
Documents to gather before filing
- Approval notices and receipt notices for prior H-1B, labor-certification, and I-140 filings.
- Payroll records and prior I-94 records showing maintenance of status.
- A travel history to identify potentially recapturable H-1B time.
- The labor-certification or I-140 filing chronology, including any notices of audit, denial, withdrawal, or revocation.
- The proposed extension start date and the employer’s current offer, duties, and worksite information.
Can you change jobs after an I-485 has been pending 180 days?
For some employment-based adjustment applicants, yes—but the rule is narrower than “an approved I-140 lets you switch jobs.” USCIS states:
“The portability provisions of the American Competitiveness in the Twenty-First Century Act (AC21) allow certain adjustment applicants with approved employment-based immigrant visa petitions in the 1st, 2nd, and 3rd preference categories to change jobs and employers if the adjustment application has been pending for 180 days or more, provided that the applicant’s new job offer is in the same or similar occupational classification as the job for which the petition was initially filed.”

This language appears in the USCIS Policy Manual, Volume 7, Part A, Chapter 8. The 180-day period is measured from the I-485 filing and requires an adjustment application that is actually pending for the required time. An approved I-140 without a pending I-485 does not, by itself, create this portability benefit.

Same or similar is a factual comparison
USCIS does not reduce “same or similar occupational classification” to matching job titles. The comparison can involve duties, skills, educational requirements, industry context, occupational codes, compensation, and the relationship between the old and new roles. Keep the original labor-certification and I-140 materials alongside the new offer letter, job description, reporting structure, worksite, and compensation records so counsel can document the comparison.
Important exceptions and timing traps
- USCIS describes exceptions for applicants whose approved petitions are based on extraordinary ability or a national interest waiver; those applicants are not eligible for this particular portability provision.
- Moving to a different employment-based category can reset the 180-day portability period.
- The I-485 must remain viable, and the underlying immigrant petition must meet the applicable approval and validity requirements.
- A job change before the required 180 days, or into work that is not same or similar, can create serious adjustment risks.
Portability is not a blanket right to change employers, work without authorization, or ignore the terms of an existing nonimmigrant status. Obtain a portability assessment before resigning, accepting a new role, or changing locations.
What does a backlogged priority date mean?
The priority date controls a place in the employment-based immigrant-visa queue; it is not a work permit. USCIS explains that the date generally comes from the immigrant-petition filing date, or from the labor-certification filing date when labor certification is required. Your category and country of chargeability determine which cutoff applies.

Adjustment of status versus consular processing
An applicant physically present in the United States may use adjustment of status when eligible. The alternative is immigrant-visa processing through a U.S. consulate abroad. USCIS employment-based materials distinguish these routes because they involve different filing sequences, travel considerations, and documentary steps.

Cutoff dates change. They can advance, retrogress, or become unavailable as demand and annual visa limits change. Do not rely on an old chart, a social-media estimate, or a coworker’s date. Check the current Department of State Visa Bulletin and the USCIS filing-chart announcement for the specific month, category, and chargeability country. The available materials do not establish a universal wait time or current cutoff.
When a date becomes current
A current priority date can allow the next immigrant-processing step only if every other requirement is met. It does not cure an expired nonimmigrant status, authorize employment before an EAD is issued, or excuse a missed filing deadline. If a date retrogresses after filing, the adjustment case may remain pending, but final approval generally cannot occur until a visa number is available.

An alternative status may be worth investigating when the worker’s background, nationality, employer relationship, and proposed duties satisfy a different classification. The classification must be independently available; a green-card delay does not convert an ineligible job into a qualifying one.

An L-1 analysis asks whether the U.S. petitioner and foreign organization have a qualifying corporate relationship, whether the worker completed the required prior employment abroad, and whether the U.S. position meets the managerial, executive, or specialized-knowledge standard. The cited USCIS Administrative Appeals Office decision illustrates these fact-intensive questions and describes a general five-year maximum for L-1B specialized-knowledge status. That 2006 decision is non-precedential, so current statutory, regulatory, and USCIS requirements must be confirmed before relying on it.
Best Value
An L-1 is not a generic fallback for a software worker moving between unrelated companies. Corporate ownership, the foreign employment period, and the actual duties—not the industry label—drive eligibility.
Other classifications to raise with counsel
Depending on personal facts, counsel may discuss O-1, E-3, TN, or H-4 employment authorization. Their criteria, nationality limits, employer requirements, filing procedures, and work authorization rules differ substantially. Do not treat these labels as interchangeable substitutes or assume that a tech occupation alone qualifies. A careful review should identify the exact classification, the evidence needed, and whether employment is tied to a particular petitioner.
How the main paths compare
| Route | What it may provide | Key eligibility facts | Main cautions |
|---|---|---|---|
| AC21 H-1B extension beyond six years | Additional H-1B validity, described by USCIS guidance in one-year increments for qualifying cases | Qualifying labor-certification or immigrant-petition filing; at least 365 days since filing; valid status and correct timing | Not automatic; interim guidance; tied to petitioning-employer H-1B employment |
| AC21 portability | Ability for certain adjustment applicants to change employers | Approved employment-based petition, I-485 pending at least 180 days, and same or similar new occupation | Exceptions apply; category changes can reset the period; authorization and adjustment must remain valid |
| Priority-date progression | Movement toward immigrant-visa or adjustment processing when a visa number is available | Preference category, priority date, chargeability, and current monthly cutoff | A priority date is not work authorization; dates can retrogress |
| L-1 or another temporary classification | Separate nonimmigrant work-authorized status if approved | Classification-specific employer, role, prior employment, nationality, or achievement requirements | Not a universal fallback; evidence and maximum periods vary |
There is no evidence-based universal ranking by speed, cost, or approval probability. The best route depends on the worker’s expiration date, filing chronology, employer relationship, occupation, category, chargeability, and travel plans.
Travel, gaps, and employer changes require separate planning
International travel can affect maintenance of status, visa issuance, adjustment processing, and the practical ability to return to the United States. A pending immigrant case does not itself guarantee admission. Before booking travel, confirm whether the current status and visa document permit reentry, whether an adjustment application is pending, and whether consular processing would be triggered or complicated.
Likewise, do not stop working or begin with a new employer merely because an extension, EAD, or portability filing has been submitted. The filing type, receipt date, statutory portability rule, and any automatic-extension provision must be matched to the exact facts. If work authorization may lapse, obtain advice before the expiration date; correcting an unauthorized-employment period later can be difficult.
A practical case-review checklist
- Mark the hard deadlines. Record the I-94 expiration, six-year H-1B limit, EAD expiration if applicable, passport and visa dates, and any employer-requested start date.
- Build the immigrant timeline. List labor-certification, I-140, and I-485 filing, approval, withdrawal, denial, and transfer dates.
- Confirm category and chargeability. Identify the employment-based preference category and the country used for visa-number allocation.
- Check the monthly charts. Compare the priority date with the current Department of State Visa Bulletin and USCIS filing chart for the month you intend to file.
- Test each legal route independently. Ask counsel to analyze AC21 extension eligibility, 180-day portability, and any alternative classification rather than selecting one based only on the backlog.
- Prepare evidence before changing jobs or traveling. Collect duties, organizational charts, payroll, status records, travel history, petition notices, and the proposed offer letter.
- Make a contingency plan. Decide what happens if a petition is denied, a priority date retrogresses, an employer withdraws sponsorship, or a filing cannot be submitted before expiration.
Common assumptions that create avoidable risk
- “My priority date is old, so I can keep working.” A queue position is not employment authorization.
- “My I-140 was approved, so I can work anywhere.” Portability requires a qualifying pending I-485, the 180-day period, and same-or-similar employment, with exceptions.
- “Any green-card filing gives me an extra H-1B year.” AC21 extensions depend on the qualifying filing, the 365-day threshold, status, and timing.
- “An L-1 is an easy backup for tech workers.” It requires a qualifying related organization, prior foreign employment, and a qualifying U.S. role.
- “A coworker’s Visa Bulletin date applies to me.” Cutoffs vary by preference category and chargeability country and change monthly.
What to ask an immigration lawyer
Take the timeline and documents to counsel and ask for written answers to these questions:
- Which work-authorized status covers me through my next intended employment date?
- Do my labor-certification or I-140 filings satisfy an AC21 extension pathway, and when should the petition be filed?
- Has my I-485 been pending at least 180 days, and is the proposed job same or similar?
- Would a category change, employer change, travel, or consular processing alter my eligibility or reset a period?
- If no current route works, what lawful contingency avoids an unauthorized-employment or overstay problem?
Because USCIS policy and visa availability can change, verify the governing rules and current forms at the time of filing. The safest strategy is the one supported by your actual notices, dates, duties, and status records—not by the age of the backlog alone.
