Before buying a home to rent for short stays, confirm that the exact address can legally be used that way, that private rules and your lender allow the plan, and that conservative net income can cover the costs. These answers vary by city, county, state, property type, and loan program; a listing platform does not grant permission to host.
Can you legally use this address as a short-term rental?
Check with the city and county before you make an offer—or make the offer contingent on verifying that the intended use is allowed. Local zoning, ordinances, or administrative rules may limit or prohibit short stays. Where hosting is allowed, registration, permits, licenses, inspections, and local taxes may apply. Airbnb’s general U.S. hosting guidance says that “In many cities, you must register, get a permit, or obtain a license before you can list your property or accept guests.” That platform guidance is not a ruling on any particular property.

Contact the relevant planning, licensing, tax, fire, and building departments, and check for state requirements where applicable. Ask officials directly:
- Is short-term rental use allowed at this address and for this type of property?
- Are new permits available, or are there caps, waiting lists, or other limits?
- Does the rule differ for an owner-occupied home, a second home, or an investment property?
- Is an existing permit transferable to a buyer, or must the new owner apply?
- What inspections, registrations, fees, and tax obligations apply, and when must they be completed?
Do not assume a seller’s permit will transfer or that a permit can be obtained later. Get the current requirements from the authority responsible for them and keep written confirmation with your purchase records.
Local rules are not interchangeable
Airbnb’s Whitefish, Montana local-rules page describes requirements specific to that city: short-term rentals are allowed only in named zoning districts, require a short-term-rental permit and business registration, and require an annual fire life-safety inspection. This is an illustration of local variation, not a rule for other places; confirm current requirements and fees with Whitefish itself if you are considering a property there.
Can an HOA, condo association, or other agreement stop hosting?
Public permission does not settle private restrictions. Review the recorded covenants, declaration, bylaws, rules, board policies, and any other agreements that bind the property. HOA, condo, co-op, or other rules may restrict rentals, subletting, guest stays, or the duration and frequency of bookings.
Ask the association or its management company for written confirmation of the current rules and any pending changes. Airbnb’s responsible-hosting guidance likewise advises checking HOA or co-op rules. Do not rely only on a seller’s or agent’s verbal description: ask your real-estate attorney or other qualified adviser to review the documents before your inspection or contingency deadlines expire.

Will a lender count short-term rental income?
Tell the mortgage lender before applying that you intend to operate the property as a short-term rental. Do not assume projected platform receipts will be treated like long-term lease income or will help you qualify. Ask which loan program applies, whether the intended use is eligible, what documentation is required, and how the lender will assess your down payment, reserves, and ability to repay.
Fannie Mae’s Selling Guide provision B3-3.8-03, dated September 2, 2026, addresses rental income from a subject property used as a short-term rental. For that provision, Fannie Mae describes an STR as furnished residential property rented for brief periods, typically under 30 consecutive days. The guidance limits eligibility to one-unit investment properties legally permitted to operate as STRs, and says income from an accessory dwelling unit (ADU) is not eligible under this provision. Documentation and qualification conditions apply. This is a specific Fannie Mae underwriting rule, not a universal definition or promise of approval; your lender must confirm the rules for your proposed loan.
How should you estimate whether the property can pay for itself?
Build a property-specific monthly and annual model before treating projected bookings as investment income. Use dated local comparables for the destination and relevant seasons; do not substitute a nationwide occupancy, nightly-rate, or return estimate. The available evidence does not establish a defensible market-wide revenue figure.

Start with a conservative estimate of booked nights and nightly rates, account for seasonal variation and vacant periods, and then subtract the costs of operating the property. A gross booking-revenue screenshot is not profit, and comparing gross receipts only with the mortgage payment leaves out substantial expenses.
Build a complete cost model
- Cleaning, laundry, linens, guest supplies, and consumables between stays.
- Utilities, internet, routine maintenance, repairs, and replacement of worn furnishings or equipment.
- Property insurance, property taxes, and any required permits, registrations, inspections, or professional services.
- Platform charges, property-management or co-host fees, and costs of handling bookings and guest issues.
- Lodging or occupancy taxes, including any amounts you must collect or remit yourself.
- Financing costs, vacancy, and a reserve for unexpected repairs and interruptions.
Ask the relevant tax authority and the booking platform who is responsible for collecting and remitting each lodging tax. Airbnb says it collects some occupancy taxes in some jurisdictions; that does not establish that every tax obligation is covered for your property. Include taxes and operating expenses in the model rather than assuming a platform handles them all.
Compare candidate properties on the same basis
Use a consistent worksheet for each address so an appealing gross-revenue estimate does not distract from a legal or financial obstacle.
| Diligence area | What to verify |
|---|---|
| Legal eligibility | Whether short-term rental use is allowed at the address, and whether permits are available, transferable, or capped. |
| Private rules | What the HOA, condo, co-op, covenants, or other binding agreements allow, confirmed in writing. |
| Financing | Whether the intended loan permits the use and whether projected rental income can be considered under that program. |
| Net cash flow | Conservative seasonal booking assumptions minus operating costs, financing, taxes, vacancy, and reserves. |
| Insurance | Whether hosting is covered, which liability or property-damage exclusions apply, and what coverage costs. |
| Personal use and taxes | Planned owner-use days and the tax consequences of mixing personal and rental use. |
| Workload and distance | Who will manage turnovers, maintenance, guest problems, and emergencies, and whether paid help is needed. |
Will insurance and the property support hosting?
Before committing, ask the insurer whether short-term rental activity is covered and how it affects property-damage and liability coverage. Confirm exclusions, conditions, and cost in writing; do not infer coverage from a standard homeowner policy or from a booking platform’s policies.
Check local safety and inspection requirements with the responsible authority. Assess whether guests can use the property safely and reliably, including access and parking, fire egress, alarms, heating and cooling, plumbing, laundry, and emergency response. A generic host checklist is not a substitute for local code compliance or a required inspection. Airbnb’s hosting guidance identifies safety, health rules, and insurance as items to check, but no single device list or checklist establishes compliance everywhere.

The IRS’s Publication 527 (2025), Residential Rental Property (Including Rental of Vacation Homes), covers rental income, expenses, depreciation, passive-loss limits, and vacation homes. Rental income is generally reportable, but how expenses and losses are treated depends on the owner’s circumstances. If you also use the home personally, you may have to allocate expenses between personal and rental use.

The IRS discusses a special rule for a dwelling used as a home and rented fewer than 15 days during the year. That rule depends on those conditions; it is not a blanket exemption for short-term rentals. Before setting personal-use dates or relying on deductions, ask a tax professional how the rules apply to your situation.
Keep records supporting rental receipts and expenses. The IRS’s rental-real-estate recordkeeping guidance recommends keeping documentation; useful records can include booking statements, invoices, receipts, tax records, and relevant mileage or repair-travel records.
Quick Recap
What to verify before closing
- Check the address with local authorities. Confirm permitted use, permit availability, transferability, inspections, and taxes with the agencies responsible for those requirements.
- Get the private rules in writing. Obtain the binding association and property documents, and confirm current hosting restrictions and pending changes.
- Have the lender review the intended use. Ask which loan rules apply and what documentation and qualification conditions govern the purchase.
- Confirm insurance and safety obligations. Get the insurer’s position on hosting and identify required local inspections and equipment.
- Stress-test the operating model. Use local, seasonal booking assumptions, include every recurring and irregular cost, and allow for vacancy and repairs.
- Plan for personal use and tax records. Decide how often you expect to use the home and preserve receipts and booking documentation from the start.
