Check the giveaway’s published official rules before choosing another winner or deciding what to do with the prize. Follow the stated claim deadline, notification method, eligibility requirements and procedure for an unclaimed prize. There is no universal claim period or automatic right to redraw, keep or redirect a prize; the rules and applicable law determine what you can do.
Start with the rules that applied to the giveaway
Find the version of the official rules and promotion materials that applied while entries were open. Look for these details:
As an Amazon Associate I earn from qualifying purchases.
- Claim deadline: when the winner must respond, and how the deadline is calculated.
- Notification method: the channel and contact details the rules specify.
- Claim instructions: what the winner must do and where to send a response.
- Eligibility and paperwork: any affidavit, release, tax form or other requirement stated in the rules or required by law.
- Nonresponse consequence: whether the rules permit disqualification, forfeiture, an alternate winner or another remedy.
Do not substitute a deadline or requirement that was not in the rules. If the rules do not explain what happens after a missed claim, or appear to conflict with applicable law, get jurisdiction-specific legal advice before disposing of the prize.

Verify the original winner and document contact attempts
- Confirm that the selection followed the announced method and that the potential winner meets the eligibility requirements.
- Contact the winner through the channel and using the address or account information specified in the rules.
- Send the exact claim instructions and deadline. Request only documents required by the rules or law, and handle personal information securely.
- Keep the rules, draw records, copies of notices, dates sent, delivery information and any replies. Distinguish evidence that a notice was sent from evidence that it was received.
- At the deadline, record whether the required response arrived and whether any eligibility or document requirements were met.
A sample set of New York City Department of City Planning giveaway rules allows an alternate winner if the selected winner fails to claim within two days after the award notification was sent, is ineligible, or does not return a required affidavit and release on time. That two-day period is specific to that sample, not a standard deadline for giveaways generally. Read the NYC sample rules.

Choose a next step only if the rules and law allow it
If the rules authorize an alternate winner
Follow the specified alternate-selection process, keep a record of it, verify the alternate’s eligibility and repeat the same notice-and-claim process. Do not assume an alternate may be selected just because the first winner did not respond.
If the rules do not say what happens
Pause before retaining, donating, substituting or leaving the prize unawarded. Check the law for the promotion’s jurisdiction and format, and get legal advice when the value or uncertainty makes the decision material.

Check Florida requirements when they may apply
Florida Statutes §849.094 covers certain game promotions connected with the promotion or sale of consumer products or services where chance and a prize are involved. It prohibits arbitrary disqualification and failure to award prizes offered. For covered promotions with total announced prize value above $5,000, the presented 2024 Florida statute (including 2025C) provides for advance filing at least seven days before commencement, security through a trust account or bond subject to a waiver provision, and a certified winners list within 60 days after winners are finally determined. Applicability depends on the promotion; these are Florida-specific requirements, not nationwide rules. Check the current statute and its application before acting. Florida Statutes §849.094 and the Florida Department of Agriculture and Consumer Services overview provide further information.

It discusses disclosures such as odds, a free way to participate, and material costs or conditions to receive or redeem a prize, and bars misrepresentations about material aspects. Warn entrants about fake prize-claim requests
A real sweepstakes prize should not require an entrant to pay a claim fee. Requests for urgent payment or financial details are scam warning signs. Entrants should verify a message using contact information found independently rather than relying on links or numbers in the message.
