If your U.S. visa expires while you are in Brazil, you generally cannot use it to travel to a U.S. port of entry. To return, you will usually need a new visa in the appropriate category, unless you independently qualify to travel without a visa. Check the current instructions for the U.S. embassy or consulate where you plan to apply before making arrangements.
Can you return to the U.S. on an expired visa?
Generally, no. A visa is used to request admission at a U.S. port of entry; an expired visa generally cannot serve that purpose. If you need to travel to the United States, you will typically need to apply for a new visa in the appropriate category. A separate basis for visa-exempt travel may apply to some travelers, but visa expiration alone does not create one. See the U.S. Department of State’s visa expiration guidance.

Does expiration mean you overstayed?
No—not by itself. Visa validity and authorized stay in the United States are different things. For someone already admitted to the U.S., the admission record, including Form I-94 or the admission stamp, indicates the authorized period of stay. The visa’s expiration date does not extend or shorten that period. The State Department explains that a person admitted for a specified period may remain for that authorized period even if the visa expires while they are in the United States.

Do you have to renew your visa in Brazil?
Not necessarily. In guidance updated July 15, 2026, the State Department says nonimmigrant visa applicants should schedule in their country of nationality or residence. If you apply based on residence, you must be able to demonstrate that residence. Someone visiting Brazil should not assume that Brazil is the right place to apply.
The Department warns that applying outside your country of nationality or residence, or a designated processing post, may make it harder to qualify. The application fee may not transfer or be refunded, and applicants should expect significantly longer waits. Review the State Department’s guidance on where to apply and the current instructions from the specific U.S. post before choosing a location.

How to apply for a new nonimmigrant visa
- Identify the correct visa category. Apply for the category that matches your purpose of travel; the appropriate category depends on your circumstances.
- Complete the DS-160. Submit the online nonimmigrant visa application and keep its confirmation page with the barcode. The State Department explains the process on its visitor visa page.
- Pay the application processing fee. Follow the payment instructions for the post where you will apply.
- Follow that post’s appointment instructions. Arrange an interview or other required appointment using the local process. Consular officers use the application and, when required, an interview to assess eligibility.
- Wait for the visa decision before committing to travel. A visa is not guaranteed. The State Department advises applicants not to make final travel plans or buy tickets until a visa has been issued.
Can you renew without an interview?
Possibly, but an interview waiver is limited and is not automatic. Under the State Department’s rules effective October 1, 2025, most nonimmigrant applicants generally require an in-person interview.
A limited waiver category covers certain applicants renewing a full-validity B-1, B-2, or B1/B2 visa within 12 months of the previous visa’s expiration, if they were at least 18 when that visa was issued. Applicants must also meet other conditions, including applying in their country of nationality or usual residence, having no unovercome visa refusal, and having no apparent or potential ineligibility. A consular officer may still require an interview. Check the State Department’s interview-waiver guidance and the local post’s instructions before relying on a waiver.

What if the visa is valid but the passport expired?
That is different from an expired visa. According to the State Department, a valid, undamaged visa may generally be used with a new valid passport if both passports are from the same country and type and the visa matches the purpose of travel. Do not remove the visa from the old passport. This arrangement does not make an expired visa valid again. Read the Department’s visa expiration guidance for the distinction.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Does the Brazil reciprocity schedule apply to everyone applying there?
No. The State Department’s Brazil reciprocity schedule lists B-1, B-2, and B-1/B-2 visas issued to Brazilian nationals as multiple-entry visas valid for 120 months. That nationality-specific schedule is not a promise of the same validity for every foreign national applying from Brazil. Check the Brazil reciprocity schedule for the applicable nationality and visa category.

What to verify before you make plans
- Your visa category, nationality, and country of residence, since these affect where to apply and which rules apply.
- Whether the visa is actually expired, or whether it remains valid in an expired passport.
- Whether you meet every condition for a possible interview waiver; the post or officer may still require an interview.
- The current post-specific appointment, fee-payment, document-submission, and passport-return instructions. These logistics can change, so use the relevant U.S. post’s current guidance rather than an old wait-time estimate.
