If your parental leave request is denied, delayed, or unanswered, follow up in writing, ask for the reason and any missing information, and check whether the Family and Medical Leave Act (FMLA) or a state, local, or employer policy protects your leave. A delay does not automatically mean approval, and a denial is not automatically unlawful. Your rights depend on the employer, your eligibility, the reason for leave, and the rules where you work.
What do I do if my parental leave is denied?
Start with a short written follow-up to HR or the person handling leave. State the dates you requested, that the leave is for birth, adoption, foster placement, or bonding, and when you first notified your employer. Ask whether the request is being evaluated under the FMLA and any applicable state law or employer policy.

You do not have to say “FMLA” when making a first request. You do need to give enough information for the employer to understand that the leave may qualify. The U.S. Department of Labor (DOL) gives requesting time off to bond with a newborn as an example of information that can trigger FMLA notice duties. See DOL Fact Sheet #28E on employee notice.
Ask for the employer’s decision and its stated reason. If the employer says you are ineligible, request the eligibility notice and the reason. If it has enough information to decide whether the leave qualifies, ask for its designation decision. Keep copies of your request, notices, forms, delivery confirmations, and replies. After a conversation, record the date and who you spoke with; a brief email confirming what was discussed can help keep the record clear.

How long can my employer take to respond to FMLA leave?
For an initial request, an employer generally must notify you whether you are eligible for FMLA leave within five business days after your request or after learning that your leave may qualify, unless there are extenuating circumstances. If you are ineligible, the notice must give at least one reason. If you are eligible, the employer must also provide information about your rights and responsibilities. See the DOL’s employer notice guidance and Fact Sheet #28G.
The eligibility notice is not necessarily the final decision that your specific leave is FMLA-protected. Once the employer has enough information to decide whether the leave qualifies, it must provide a designation notice saying whether the leave is designated as FMLA leave and, if possible, how much time will count against your FMLA entitlement. If you have not received a response, send a dated follow-up asking which notice is outstanding and whether the employer needs anything else from you. A missed response deadline is a reason to follow up, not a guarantee that the request has been approved.

What if HR says paperwork is missing?
Ask what exact form or information is missing, who must complete it, and when it is due. When an employer finds a certification incomplete or insufficient, it must tell you in writing what additional information is needed. Employees generally must be allowed at least 15 calendar days to provide requested certification, subject to the circumstances described in DOL guidance. See DOL Fact Sheet #28G.

Bonding leave and leave for a serious health condition are not the same. An employer may seek certification when FMLA leave is requested for a serious health condition, but you do not have to provide a diagnosis to the employer. Relevant medical facts may be required to support leave for a serious health condition. If the request is for bonding rather than a medical condition, clarify that purpose when asking what paperwork is necessary.

Can my employer deny bonding leave?
Possibly. The FMLA provides eligible employees of covered employers with job-protected leave for birth and bonding with a child, adoption, or foster placement, but it does not cover every worker or workplace. Eligibility and employer coverage rules apply, and the requested reason and required procedures matter. FMLA leave is generally unpaid; accrued employer-provided paid leave may run at the same time when policy or law allows or requires it.
A denial can be lawful if you or the employer are outside the federal coverage or eligibility rules, the reason does not qualify, or required notice or certification procedures have not been met. On the other hand, an unsupported denial, failure to provide required notices, or discouraging an employee from taking protected leave may raise an FMLA interference issue. The DOL explains that “The FMLA prohibits employers from interfering with, restraining, or denying the exercise of, or the attempt to exercise, any FMLA right” in Fact Sheet #28Q on birth, placement, and bonding leave.

Federal FMLA is only one possible route. State or local law, public-sector rules, a collective bargaining agreement, or employer policy may provide additional job protection, wage replacement, or both. Ask HR which programs apply and contact the relevant state agency for current state-specific rules. DOL’s state paid leave resources can help identify programs, but paid benefits and job-protected leave are not necessarily the same program and may have separate eligibility or administration.

Do not assume that an answer about FMLA resolves your rights under state law or an employer policy. Those rules depend on your location and employment circumstances.
When should I escalate a denial or delay?
If you believe your employer interfered with FMLA rights or retaliated against you for trying to use them, you can contact the DOL Wage and Hour Division (WHD) or consider a private lawsuit. WHD’s helpline is 1-866-487-9243; the agency provides information about filing a complaint and finding a local office. The available route and outcome depend on the facts, so do not assume that a complaint will produce a particular remedy.
If the dispute involves eligibility, retaliation, or an imminent employment consequence, a qualified employment attorney or legal-aid service may help assess your options. For state-law questions, identify your work location and check the current state agency guidance; federal FMLA materials alone cannot determine your state rights or a deadline that applies to your case.
