Start by identifying who issued the document. A USCIS denial of an employer’s H-1B petition (usually Form I-129) is different from a U.S. consular officer’s refusal of the worker’s visa application. The issuing agency, the wording of the notice, and any separate decision about a change or extension of stay determine what can happen next.
Send the complete notice to the employer’s immigration counsel immediately. Do not assume that the word “denied” by itself tells you whether you may keep working, must leave the United States, or can appeal.

First, identify the decision you received
People often call the entire process a “visa petition,” but it has separate stages. The employer files an H-1B petition with U.S. Citizenship and Immigration Services (USCIS). If that petition is approved and the worker is outside the United States, the worker may then apply for an H-1B visa at a U.S. embassy or consulate. A denial at either stage requires a different response.
| Question | USCIS H-1B petition denial | Consular visa refusal |
|---|---|---|
| Who decided? | USCIS, on the employer’s petition | A Department of State consular officer, on the visa application |
| Document to inspect | USCIS denial notice, stated grounds, appeal or motion instructions, and any separate stay decision | Refusal letter, cited INA section, document checklist, and post-specific instructions |
| Who normally acts? | The petitioning employer, usually through its authorized representative or immigration lawyer | The visa applicant, following the consular post’s instructions |
| Key timing in official guidance | For an eligible Form I-290B appeal or motion, generally 30 calendar days after service, or 33 days when USCIS mailed the decision; verify the notice and current USCIS instructions | For a 221(g) request for information, one year from the refusal to provide it; administrative-processing duration varies |
| What remains case-specific? | Whether an appeal, motion, refiling, or another response is available, and how the decision affects status or employment | Whether the applicant can overcome the refusal, needs a waiver, or remains ineligible |
The Department of State explains the consular process in its Visa Denials guidance. USCIS describes petition appeals and motions in its Form I-290B instructions and Policy Manual, Volume 6, Part J, Chapter 5.

If USCIS denied the employer’s H-1B petition
1. Preserve the notice and capture the deadline
Confirm that the document is from USCIS and concerns the employer-filed Form I-129. Save every page, envelope, delivery record, and attachment. Write down the decision date, the date and method of service, every stated denial ground, and whether USCIS issued a separate decision on a requested change or extension of stay.
A denial notice identifies the reasons for the decision and the available appeal rights. The H-1B regulations published in the Federal Register on October 23, 2023 also distinguish a petition denial from a decision denying an extension of stay; the regulation states that there is no appeal from the extension-of-stay decision. That distinction can affect the worker even when the petition and stay requests appeared in the same filing.
2. Give the full record to the employer’s representative
Send the complete notice, not just the first page, to the employer’s immigration lawyer or authorized representative. USCIS generally does not allow the H-1B beneficiary to file the petition’s appeal or motion personally. The employer is the petitioner and normally controls the response, so the worker should not mail an I-290B independently or assume that a personal filing will preserve the case.

3. Have counsel match the remedy to the denial ground
An appeal and a motion are different procedures, and neither is automatically appropriate.
- Motion to reopen: asks USCIS to revisit the decision because new facts or documentary evidence are available. The filing must explain the new evidence and satisfy the applicable procedural requirements.
- Motion to reconsider: argues that USCIS applied the law or policy incorrectly to the existing record. It is not simply an opportunity to submit evidence that should have been filed earlier.
- Appeal: asks the designated appellate authority to review an eligible USCIS decision. The denial notice and current form instructions determine whether an appeal is permitted and where it must be filed.
Some cases call for correcting a defective filing and submitting a new petition instead. Others may require addressing a substantive eligibility problem, a labor-condition issue, employer evidence, the offered role, or the beneficiary’s qualifications. The denial’s reasoning and the complete administrative record—not the label “denied”—should drive that choice.
4. File on the correct form, at the correct place, with the correct fee
USCIS’s general guidance for an eligible Form I-290B appeal or motion is a filing within 30 calendar days after service, or within 33 days when USCIS mailed the decision. The denial notice can specify a different calculation or additional requirements, so counsel should follow the notice and the current USCIS page rather than rely on an old checklist.

5. Check status and work authorization separately
A petition denial does not, by itself, answer whether the beneficiary is currently in lawful status, may continue working, or must depart the United States. Those questions depend on the person’s last I-94, the status in which they were admitted, whether employment authorization is tied to the petition, whether a change or extension of stay was requested, and whether another application or status is pending.
Have qualified immigration counsel review the current I-94, passport, approval notices, payroll and employment dates, and any pending applications. Do not keep working, stop working, or make travel plans based solely on a verbal description of the denial.
If a consular officer refused the H-1B visa
1. Read the refusal letter and identify the legal section
A consular refusal occurs after the worker applies for a visa at a U.S. embassy or consulate. It is not the same as USCIS revoking or denying the employer’s petition. Check the refusal letter for the cited section of the Immigration and Nationality Act, the list of missing documents, the submission method, and any interview or appointment instructions. Keep copies of everything submitted.

Under INA section 221(g), a consular officer may refuse the application temporarily while requesting documents or information, or while completing additional review. Follow the specific post’s instructions exactly: use the stated courier, upload portal, email address, or appointment process, and send a complete response rather than piecemeal material when the instructions call for a full set.

The Department of State says an applicant has one year from the date of refusal to provide the requested information. If the applicant does not respond within that period, the applicant must submit a new visa application and pay another application fee. The controlling instructions are those from the post handling the case; do not send documents to a different embassy without being told to do so.
3. Understand administrative processing
If the letter says the case is in administrative processing, there is no reliable universal completion date. The Department of State states that the duration varies with the individual case and that the officer may ultimately determine that the applicant qualifies for the visa or remains ineligible. Avoid booking irreversible travel or setting a start date that assumes a particular completion time.
If the applicant has a unique, serious hardship, the Department of State’s Administrative Processing Information page says to inform the consular section where the application was made. Explain the concrete circumstance and include the case details the post requests; a hardship notice does not guarantee expedited processing.
4. Treat other refusal grounds as a separate analysis
A refusal that cites a ground other than 221(g) may require different evidence, a waiver, correction of an application error, or a new application. The refusal letter should control the next step. An approved H-1B petition does not guarantee visa issuance: the consular officer separately assesses visa eligibility, admissibility, identity, documentation, and other requirements.

What not to do after an H-1B denial or refusal
- Do not confuse agencies. USCIS cannot fix a consular refusal, and a consular post cannot decide an employer’s Form I-129 appeal.
- Do not wait for a deadline while gathering informal opinions. Send the notice to the employer’s authorized representative immediately and ask for a written deadline calculation.
- Do not use an old I-290B address or fee. Filing locations and fees can change; confirm them on USCIS’s current page.
- Do not submit partial 221(g) evidence unless the post permits it. Follow the post’s stated format and retain proof of delivery.
- Do not assume a petition denial automatically cancels every immigration benefit. Status, employment authorization, and departure obligations require a review of the person’s own documents and filings.
- Do not misstate facts in a new filing. A rushed refiling that conflicts with the prior record can create additional problems.
A practical document checklist
Prepare these materials for the employer’s counsel or the consular post, as applicable:
- The complete USCIS denial notice or consular refusal letter, including the reverse side and attachments.
- The Form I-129 package, supporting exhibits, requests for evidence and responses, approval notices, and prior decisions.
- For a worker in the United States: passport biographical page, visa, most recent I-94, admission record, prior approval notices, pay statements, and employment timeline.
- For a consular case: DS-160 confirmation, appointment and interview records, passport, petition approval information, refusal worksheet, and every requested document.
- Proof of delivery, courier tracking, upload confirmation, or other evidence showing when a response was submitted.
Organizing the record does not replace legal advice, but it helps counsel identify the decision being challenged, calculate deadlines, and avoid filing an incomplete response.
When to obtain individualized legal advice
Prompt advice is especially important when the notice mentions a change or extension of stay, the I-94 is near expiration, employment has already started or ended, the worker has dependents, there are prior status violations, travel is planned, or the refusal raises admissibility or waiver issues. U.S. immigration outcomes depend on the exact record and current facts. A general article cannot determine whether an appeal, motion, refiling, waiver, consular submission, or departure is safest in a particular case.
