What to Do If You See a Diver-Down Flag While Boating

Slow down, give a diver-down flag a wide berth, and watch for people in the water. Speed and distance laws vary by state, waterway, and craft.

Slow down, keep well clear of the flag and any dive vessel, and watch carefully for people in the water. Follow the speed and distance rules for the state or territory you are in; there is no single U.S. diver-flag buffer that applies everywhere. If a person is close to your boat, keep them in view and shut off the engine when it is safe to do so.

What the flag means—and what to do first

A red square or rectangle with a white diagonal stripe is the familiar U.S. diver-down flag. It warns that divers are in the water nearby. Treat the area around it as a place where a person may be at the surface or submerged, even if you cannot immediately see anyone.

Your first response is practical, not complicated: reduce speed, give the area a wide berth, and scan the water continuously. Do not steer close to the flag just to identify it, and do not assume that seeing no diver means the area is clear. A flag is a warning, not a guarantee that every diver is visible or that every other boater has noticed the signal.

  1. Slow down promptly. Avoid a fast approach, sudden wake, or abrupt turn near the flagged area. Use the speed required by local law; if you do not know the exact rule, slow further and keep clear rather than guessing at a legal minimum.
  2. Choose a route well away from the flag and dive vessel. Leave room for divers who may be underwater and for a support boat that may be attending them. Do not pass close simply because the flag appears to be on the edge of your route.
  3. Look for people, not only the flag. Scan the surface and the water around the vessel or marker. Keep checking as you pass; a diver can be difficult to see, and the position of a flag does not tell you exactly where every person is.
  4. Keep any nearby person in view. If someone is close to your boat, keep that person on the operator’s side where you can see them. The Coast Guard boating guide advises shutting off the engine when approaching people in the water. Do so when safe, taking account of your boat’s movement and surroundings.
  5. Resume normal travel only when clear. Do not treat passing the flag itself as proof that you are past the dive area. Continue to watch for people and comply with the local speed and distance rule until you are outside its zone.

These are safety actions. The exact legally required speed, distance, and any craft-specific restrictions depend on where you are boating.

Recognize the two signals used in diving contexts

Boaters may encounter two different signals associated with diving. They are not the same flag, and the available guidance does not establish that every jurisdiction gives them identical legal treatment.

Signal How to recognize it What a boater should take from it
Diver-down flag Red square or rectangle with a white diagonal stripe. It warns that divers are in the water nearby. Slow down, keep clear, and look for people in the water.
International Code Flag A, or Alpha Blue-and-white pennant. It is a distinct signal that boaters should recognize in diving contexts. Do not assume that its legal treatment is identical to the red-and-white flag; check local rules.

NASBLA’s boating education standard calls for instruction on recognizing both signal types and the applicable local rules. When you see either, act cautiously and avoid passing close while you determine the safe route. The signals’ appearance is useful for recognition; it does not by itself tell you the precise boundary of a legally defined zone.

Why there is no single nationwide distance to memorize

The U.S. Coast Guard’s federal recreational boating guide says the Coast Guard does not regulate diver/ski flags. Its regulations guidance directs boaters to consult the laws and regulations of their state or territory. As a result, do not rely on a supposed nationwide rule such as “always stay a certain number of feet away” or “always idle within a fixed radius.” The applicable requirement can depend on the jurisdiction, waterway, and type of craft.

  • Florida: The Florida Fish and Wildlife Conservation Commission says boaters must operate at idle speed within 300 feet of a diver-down flag in open water and within 100 feet in rivers, inlets, or navigation channels. Those are Florida distances and speed requirements, not national standards. Florida’s statute also defines the diver-down symbol and specifies differing distances by water type.
  • Ohio: The Coast Guard state-law database reports a restriction on personal watercraft (PWC) operation within 300 feet of an official diver’s flag. That database entry is a state-specific data point; verify the controlling Ohio law before relying on it as a definitive interpretation.

These examples are not interchangeable. Florida’s figures distinguish between open water and specified waterways, while the Ohio entry concerns PWC operation near an official flag. Neither example establishes what a different state requires, or whether the same rule applies to every kind of boat.

How to check the rule for your waterway

Before setting out, identify the state or territory where you will operate and check its current boating laws for diver-down flags, required distances, speed restrictions, and rules for your craft type. If you will cross a jurisdictional boundary, check both sides rather than assuming the rule stays the same. A rule for a PWC may not answer what is required of a different vessel, and a rule for open water may differ from one for a river, inlet, or navigation channel.

  1. Pin down your location. Note the state or territory and, if relevant, whether you will be on open water, a river, an inlet, or a marked navigation channel.
  2. Check the relevant boating regulation. Look specifically for diver-down or divers-down flag provisions, not only general slow-speed or no-wake rules. Confirm whether the text refers to a flag, a diver, a dive vessel, or more than one of these.
  3. Match the rule to your craft. Check whether the provision applies to all vessels or names a category such as a personal watercraft. Do not extend a rule beyond the vessel types it covers.
  4. Read the speed and distance requirements together. A distance may define where a particular speed is required; it does not necessarily mean that all other traffic is safe or unrestricted just outside that distance.
  5. Use the cautious route if the law is unclear. Keep farther away, slow down, and maintain a lookout instead of treating uncertainty as permission to pass close.

If a state-law database summarizes a rule, use it as a starting point and check the governing state law when the exact legal obligation matters. This is especially important when the summary is limited to a particular vessel type or uses a term such as “official” flag.

What to do if a diver is close to your boat

A nearby person in the water changes the immediate priority: keep the person visible and avoid putting them at risk with the engine. The Coast Guard’s recreational boating guide advises shutting off the engine when approaching people in the water. Apply that guidance when it is safe to do so, and do not maneuver in a way that takes the person out of view.

  • Keep the person on the operator’s side so you can continue to see them.
  • Slow your approach and avoid passing over or close to the person.
  • Shut off the engine when safe, rather than relying on the person to move away from the boat.
  • Continue looking for other divers; one visible person does not establish that the rest of the area is clear.

If the boat is moving, consider your surroundings before cutting power, but do not keep an engine running near a person in the water merely for convenience. The essential aim is to maintain control of the boat while preventing contact and keeping the person in sight.

Common mistakes to avoid

  • Assuming the flag marks the exact location of every diver. It warns of nearby divers; it does not make them all visible or define a universal boundary.
  • Using one state’s number everywhere. Florida’s 300-foot and 100-foot idle-speed zones are Florida rules. The Ohio database’s 300-foot entry concerns PWC operation. Neither is a nationwide standard.
  • Confusing the red-and-white flag with the Alpha flag. The blue-and-white Alpha pennant is a separate signal. Recognize both, but do not assume the same legal requirements apply to each in every place.
  • Watching only the flag or dive boat. A person may be in the water nearby and hard to see. Keep scanning the water, especially as you maneuver.
  • Assuming other boaters have seen the warning. Do not follow a close pass by another vessel as proof that it is safe or lawful to do the same.
  • Stopping your lookout once you pass the marker. Keep looking until you are clear of the area and any locally defined restriction.

What this means for a safe pass

There is no safe shortcut based on a single number or on the flag’s position alone. Slow down, make a wide pass, maintain a sharp lookout, and keep any nearby person visible; shut off the engine when approaching people in the water and it is safe. For the legal minimum, use the rule for your actual location, waterway, and craft—not a distance borrowed from another state.
