What to Do If a Company Delays Disclosing a Data Breach

A late breach notice does not automatically mean the company broke the law. Protect exposed accounts, keep the notice and dates, and check the rules that apply to your location and the company.

If a company told you about a data breach later than you expected—or you are still waiting—protect the information that may have been exposed, save the notice and dates, and ask the company for clarification. A late notice alone does not establish that the company broke the law: the deadline depends on your state or territory, the company and data involved, and when the breach was discovered.

What should I do if a company tells me late about a data breach?

Start with the notice’s description of the information involved. The risk and the right response differ if the incident exposed a password, payment-card details, a Social Security number, health information, or other identifying data. The company’s notice should also tell you what happened, when it says it discovered the incident, and what help it is offering.

  1. Save the notice and related messages. Keep copies of emails, letters, and any updates, and record the date you received them. Note the company’s stated discovery date, the date it sent or posted the notice, the data it says was affected, and any protective services it offers.
  2. Secure affected accounts. If a password may have been exposed, change it on the affected service and anywhere else you reused it. If payment information was involved, check the relevant account for unfamiliar activity and contact the financial institution through its official channel if you see a problem.
  3. Use the FTC’s recovery guidance. The Federal Trade Commission advises consumers: “First, take a deep breath. Then, visit identitytheft.gov/databreach.” Its consumer guidance helps you choose steps based on the information exposed.

If the notice is vague, contact the company using the official channel listed on its website or in the notice. Ask what specific data was involved, when the company discovered the incident, when it decided to notify affected people, and what protective help is available. Do not send sensitive information in response to an unsolicited message; independently verify the company’s contact details.

What should I do while I’m waiting for a breach notice?

You do not need to wait for a formal notice to take sensible precautions if you have a credible reason to believe your information may be exposed. Match the response to the type of data rather than treating every breach as an identity-theft emergency.

  • PRIVACY PROTECTION: useful not only as an ADDRESS BLOCKER or ID POLICE, but also keeps away preying eyes from invoices, authority documents, checks, bank statements and many more.
  • SIMPLE TO USE: Just remove the cover and swipe. The wide swipe makes it easy to cover sensitive information.
  • VERSATILE APPLICATION: Ideal for a variety of documents, including contracts, court documents, shipping labels, tax returns and more.
  • LONG-LASTING INK: The high-quality ink works on both glossy and standard paper and provides up to 330 feet of coverage.
  • Password or login details: Change the affected password and any reused passwords. Turn on available multifactor authentication and review recent sign-ins or account recovery settings.
  • Payment-card or bank information: Watch the relevant account for unfamiliar charges or transfers and use the financial institution’s official reporting process if you find suspicious activity.
  • Social Security number or other identity information: The FTC recommends checking credit reports for unfamiliar accounts and considering a credit freeze or fraud alert when appropriate. These are different tools; use the FTC’s IdentityTheft.gov/databreach guidance to choose a response.
  • Health information: Be alert to suspicious communications or activity involving the affected account or provider, and use the company’s official contact route to ask what information was involved.

If the company offers relevant free monitoring or recovery assistance, review its scope, duration, enrollment requirements, and any terms before deciding whether to use it. Monitoring may alert you to certain activity; it is not a guarantee that identity theft will be prevented. The FTC’s business guide says companies should consider at least a year of free monitoring or other support particularly when Social Security numbers or financial information were exposed, but that guidance is not a universal entitlement for every breach (FTC, Data Breach Response: A Guide for Business).

How long can a company wait to notify me?

There is no single notification deadline that applies to every U.S. company and every breach. The relevant rule can depend on where you live, the type of organization, the kind of information involved, and when the organization discovered the breach. The FTC says all states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands have breach-notification legislation, while the specific requirements vary (FTC business guide, August 2023).

Rule or jurisdiction What the timing rule says What it means for a consumer
State and territorial breach laws Requirements and notice contents vary; the FTC business guide does not give one nationwide deadline. Check the law for the state or territory connected to your situation; a delay cannot be judged against a universal clock.
FTC Health Breach Notification Rule For covered personal health record entities, individual notice generally must be provided without unreasonable delay and within 60 calendar days after discovery. This is a specific rule for defined entities, not every hospital, health app, or company holding health information. See the FTC rule guidance.
FTC Safeguards Rule Covered financial institutions must report certain security events involving at least 500 consumers’ unencrypted information to the FTC as soon as possible and no later than 30 days after discovery. This is an institution-to-FTC reporting duty, not a general deadline for notifying consumers. See the FTC Safeguards Rule guidance.

Under the Health Breach Notification Rule, the FTC also describes different agency-reporting timing depending on whether a breach affects fewer than 500 people or 500 or more. Media notice is required in specified circumstances when at least 500 residents of a state, the District of Columbia, a territory, or a possession are affected. A law-enforcement determination that notice would impede a criminal investigation or harm national security can permit delay. These provisions apply within that rule’s scope; they do not create a general deadline for all companies (FTC Health Breach Notification Rule guidance).

To assess a particular delay, you need the relevant location, company type, exposed information, discovery date, and notification date. The company’s notice may provide some of those facts, but it may not establish which law applies or whether an exception is relevant.

Can I report a company for waiting too long?

You can raise a concern even if you have not established that a legal deadline was violated. First, ask the company for its explanation and preserve its response along with the notice. If you want to raise a state-level consumer concern, use the USAGov directory to find your state or territorial attorney general. The appropriate regulator or complaint route depends on the company and the facts; filing a complaint does not itself prove a violation or guarantee a particular outcome.

If you suspect a substantial legal violation or have suffered a concrete financial loss, consider speaking with a qualified attorney or the regulator relevant to the company’s industry. A general article cannot determine the deadline or remedy for an individual case.
