Before starting construction in Ireland, confirm the planning status, the applicable building-control route, any commencement-notice requirements, the site’s design risks and the safety arrangements for the work. The right answers depend on the project, its location, use and scale, so treat this checklist as a starting point—not a determination of your obligations. Ask the relevant local authority and competent professionals to assess your specific project.

1. Is the planned work covered by planning permission or an exemption?

Resolve planning status before committing to a start date or carrying out work. If permission has been granted, compare the project you intend to build with the permission, its conditions and the approved drawings. A permission for a related project is not enough if the work now planned differs in a material way: ask the planning authority whether the permission covers the actual scope.

If you already have planning permission

  • Locate the decision and the approved plans, then check that the site, development description and drawings match the work you are preparing to carry out.
  • Read every condition and establish which ones affect work before it begins. If a condition is unclear or appears to require a separate submission or action, ask the planning authority what is needed and when.
  • Check the permission’s validity and remaining duration with the authority. Do not assume that an old permission remains usable simply because it was once granted.
  • Make sure the current design team and contractor are working from the approved version. Keep a record of any clarification from the authority and of the documents used to settle the scope.

The Planning and Development (Amendment) Act 2025 introduced a specific extension route for certain uncommenced housing permissions, subject to conditions and limited application timing. It is not a general extension for every permission or project. Ask the planning authority whether this narrow provision applies to the permission in question; do not base a start date on it without confirmation.

If you think the work is exempt

Do not rely on the word “exempt” as a shortcut around checking the facts. The detailed rules depend on the proposed work and its circumstances, and a general checklist cannot determine whether a particular project qualifies. Describe the work accurately to the relevant planning authority or obtain project-specific professional advice before proceeding. If the status is uncertain, settle that uncertainty before treating construction as ready to start.

Planning law and its commencement arrangements are changing. The Department’s planning circular information describes phased commencement of the Planning and Development Act 2024, while the 2025 amendment makes a specific change for a limited class of housing permissions. Check the current position with the planning authority and against the permission itself rather than relying on an older general guide.

2. Which building-control route applies?

Once the planning position is clear, identify the building-control requirements for the work. Department of Housing guidance says building-control rules generally cover new buildings and existing buildings subject to an extension, material alteration or material change of use. The procedure and documents vary with the type of work; “building control” is not a single filing that applies identically to every project.

Work being considered What to establish before starting
New building Which building regulations and building-control procedure apply, and which notices, certificates, appointments or supporting documents are required for this project.
Extension How the extension is treated under building-control rules and what requirements apply to the new work and its connection to the existing building.
Material alteration Whether the proposed alteration is material for building-control purposes and which procedure and technical requirements apply.
Material change of use Whether the change triggers building-control requirements and what route applies to the proposed new use.

This table is a prompt to classify the work, not a legal test for deciding whether a change is material. Ask the local Building Control Authority and the project’s competent design professional to confirm the applicable route. Where the project combines several kinds of work, get the route clarified for the project as a whole rather than assuming the simplest category governs everything.

Check the regulations and required documents together

The Building Regulations set minimum performance requirements across Parts A–M. Which provisions apply, and how compliance is demonstrated, depends on the work and its commencement date. Use the Department’s current guidance for the relevant project rather than trying to apply a remembered list of technical requirements to every job.

Ask specifically whether the project requires a Fire Safety Certificate, Disability Access Certificate, statutory design certificate, an assigned certifier, a builder assignment, an inspection plan or completion certification. These are items mentioned in Department guidance, not a universal package for all construction. Have the authority or a competent professional identify which are applicable, who must prepare or sign them, and when each must be submitted.

Where the route involves the Building Control Management System (BCMS), identify the relevant parties and make sure they can use the system in time to complete the required filings. Confirm the current forms and document requirements with the local Building Control Authority. Do not infer that a document is unnecessary just because it was not needed on a different project.

3. Do you need a commencement notice, and when should it be filed?

For projects that require a commencement notice, filing dates affect when work can start. The Department’s Residential Commencement Notices Background and Methodology, published in 2026, gives a filing window of 14–28 days before work begins and says construction must start within 28 days of the council’s acceptance. These are process timings, not a general permission to begin work: first confirm that a notice is required and that the chosen notice route is correct.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Ask which notice type applies. Contact the local Building Control Authority with a clear description of the work. Confirm the correct route and the attachments it expects for that project.
  2. Confirm who supplies each item. Department guidance describes, in applicable cases, information about the owner, design and builder or assigned certifier, inspection planning, and completion certification. Establish which people and documents are required in your case.
  3. Prepare the filing through BCMS. Use the online system and allow time for the required parties and attachments to be ready. Check the current forms and rules rather than relying on older descriptions of notice types.
  4. Coordinate acceptance with the site start. Record the council’s acceptance date, then schedule the start within the applicable 28-day period. If the intended start changes or acceptance is delayed, ask the authority how to proceed rather than assuming the original filing remains sufficient.

A commencement notice is one part of the building-control process, not a substitute for planning permission, technical compliance or site-safety arrangements. Build the time needed to confirm and prepare the correct submission into the programme before booking contractors or promising a start date.

4. What should you assess about the site before design and construction?

Check ground conditions and moisture risks early enough for them to shape the design. Technical Guidance Document C (2023 Amendment) addresses site preparation and resistance to moisture. The Department says the amendment applies to new buildings and extensions commencing from 1 October 2023. Have the project’s design professional assess how the guidance relates to the actual site and proposed work.

Ground and moisture

Ask what is known about the ground and how water or moisture could affect the building. Share relevant site information with the design team and establish whether further assessment or specialist input is needed. The guidance’s subject matter makes this a design and site-preparation question, not something to postpone until construction has started. The necessary investigation and design response depend on the site; a general checklist cannot specify them for an unknown location.

Radon

Technical Guidance Document C references the Environmental Protection Agency’s updated radon map and gives guidance on radon-resistant measures in high-radon areas, including a radon-resisting membrane in the context of the applicable guidance. Check the map as one input to the design conversation, then ask the design professional to determine suitable measures for the project. A map is not a site assessment, and seeing a location on it does not by itself establish the right construction detail for a particular building.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Other location-specific issues

Depending on the site, other matters may need review, such as contamination, protected habitats, flooding, archaeology, access, utility services or geotechnical conditions. This is not a statement that every project needs a separate approval for each item. Ask the planning authority, relevant service providers or suitable specialists which checks are relevant at this location and whether any findings could change the design, consent route or construction sequence.

5. What safety roles and arrangements need to be in place?

Construction-site safety arrangements should be considered before work begins, not treated as a contractor-only matter after the site is active. The cited framework is the Safety, Health and Welfare at Work (Construction) Regulations 2013, SI 291 of 2013. The Department of Enterprise, Tourism and Employment describes the Regulations as clarifying and strengthening the general duties of parties involved in securing safety, health and welfare in construction work, including clients, project supervisors, designers, contractors and employees.

Identify who the client is and ask which project-supervisor roles, appointments, planning, safety arrangements and notifications are required for this project. The answer depends on the project’s characteristics and current Health and Safety Authority guidance. Do not assume that every small domestic project has identical duties, or that a public-works contract guide describes the obligations of a homeowner’s project.

  • Discuss the project’s scope and proposed work sequence with the people responsible for design and construction.
  • Check who is responsible for coordinating the required safety planning and who must be appointed to any relevant role.
  • Confirm whether a notification or particular safety documentation is required before work starts, using the regulations and current HSA guidance.
  • Make sure the contractor and relevant project supervisors understand the arrangements before site work begins, and get competent safety advice if the responsibilities are unclear.

The point of this check is to settle responsibility and required arrangements for the actual project. A checklist cannot decide appointments or notification triggers without facts about the work, parties and site.

6. How can you tell whether the project is ready to start?

Use a short readiness review with the owner or client, design team and contractor. Its purpose is to make unresolved decisions visible; it does not add a separate legal approval process.

  • Scope: The intended work is described consistently in the permission or exemption assessment, the design documents and the contractor’s understanding.
  • Planning: Permission status, conditions, validity and any relevant authority clarifications have been checked.
  • Building control: The project has been classified, the applicable route identified, and required certificates, appointments and submissions confirmed with the Building Control Authority.
  • Commencement: If a notice is required, the correct filing route and attachments are being prepared, and the start date is coordinated with the acceptance timing.
  • Site: Ground, moisture and relevant location-specific issues have been considered in the design and construction planning.
  • Safety: The responsible parties, roles and any required plans or notifications have been verified before site activity.
  • Records: Keep the relevant decisions, approved drawings, submitted documents and authority responses together so the project team can work from the same current information.

If any item is unresolved, name who will confirm it and which authority or professional will answer it before fixing the start date. That practical pause is preferable to discovering that the design, filing or safety arrangements do not match the work once construction is under way.

7. Who should you contact for project-specific answers?

Start with the local planning authority for permission, exemption questions, conditions and validity. Contact the local Building Control Authority for the applicable building-control procedure, notice type and documents. Use the Department’s current building-regulations and technical-guidance material for the relevant work, and consult the Health and Safety Authority’s current guidance on construction duties and roles. A competent architect, building surveyor, engineer or other relevant professional can help interpret those requirements for the design and site; the appropriate expertise depends on the question.

Give each adviser the same accurate outline: location, proposed use, scope of work, whether the project is new construction or work to an existing building, and any permission or drawings already available. Ask for a project-specific answer where a general web page cannot settle the issue. This guide is Ireland-focused and general; it does not determine the permissions, technical route or safety duties for an individual site.
