Before paying, identify the exact game, edition, platform, storefront and country, then check the transaction’s current status, the scope of any binding commitment and the refund rules that apply to your purchase. A headline about a publisher merger does not tell you whether your version will remain available, whether online features will continue or whether you can return it.
Separate four different things: a proposed deal, a regulator’s allegation, a remedy imposed or accepted as part of a transaction, and a later support or licensing policy. Those categories answer different questions. Use the checklist below to decide what you are actually buying and what recourse you would have if access changes.

1. Write down exactly what you are buying
Start with a purchase record before reading merger news. “The game” may refer to several products with different licenses and support requirements.
Record these details
- Title and edition: note the base game, deluxe edition, expansion bundle, remake, remaster or subscription version.
- Platform: specify the console model, handheld, Windows PC or another supported device. A commitment covering PC and console releases does not automatically cover every device or operating system.
- Storefront and seller: record the exact store, account region and, for a physical copy, the retailer and seller of record.
- Country or territory: licensing, consumer law and cloud-service availability can change by region.
- Purchase type: distinguish a perpetual digital license, a disc or cartridge, a code, a cloud-streaming entitlement and access supplied through a subscription.
- Online requirements: note whether an account, internet connection, subscription or publisher server is required for installation, activation, multiplayer or single-player play.
Save the product page, price, edition description and order confirmation. Screenshots or a PDF made at checkout can be useful if the listing later changes.

2. Establish whether the transaction is proposed, pending or closed
Merger coverage often mixes events that have very different legal effects. A proposed acquisition may be abandoned, challenged, revised or completed with conditions. A regulator’s complaint describes an enforcement theory; it is not a finding that every feared outcome will happen to your game.
Use a current official status page
Check the relevant competition authority, court docket or platform announcement for the latest status. Note the publication date and whether the page describes a proposal, an investigation, a decision, an appeal, a remedy or a completed transaction. Do not rely on an old article that says a deal is “under review” when the authority later closed or resolved the matter.
Keep allegations separate from established terms
In December 2022, the U.S. Federal Trade Commission alleged that Microsoft’s proposed acquisition of Activision Blizzard, described by the agency as a $69 billion transaction, could let Microsoft change rival access, pricing, quality, timing or availability for Activision franchises. Holly Vedova, then director of the FTC’s Bureau of Competition, said: “Microsoft has already shown that it can and will withhold content from its gaming rivals.” That quotation explains the agency’s position in the enforcement proceeding; it is not a neutral finding about a particular game. The FTC gaming page, updated May 22, 2025, lists the administrative matter as closed. The later status should not be confused with the allegations made in 2022.
For your purchase, the practical question is not whether a regulator once expressed concern. It is whether a final obligation, license or current service policy covers your title, platform and territory.
3. Read the scope of every commitment
A remedy is useful only within its written boundaries. Extract the details into a table before assuming it protects your purchase.

Save the exact wording and effective date. “Fifteen years,” for example, could describe a release window rather than fifteen years of server operation, and “in perpetuity” could describe a license while another obligation has a shorter term.

4. Understand the Microsoft–Activision cloud-rights example
The revised UK transaction illustrates why the service and territory columns matter. The UK Competition and Markets Authority described an arrangement under which Ubisoft received specified global cloud-streaming rights, excluding the European Economic Area, for Activision PC and console games released during the next 15 years. For EEA cloud rights, the arrangement included a non-exclusive license. The CMA described licensing models that could include buy-to-play and multigame subscriptions.

Attribute that wording to Microsoft; use the CMA’s description when explaining the regulator’s account. Neither statement should be generalized into a promise about every console edition, every territory, a future title outside the release window or another publisher’s transaction.
What the arrangement can answer
- It shows that cloud-streaming access was the focus of a specific remedy.
- It identifies a defined future-release period and different treatment for global rights and EEA rights.
- It indicates that a licensee may have discretion to offer access through more than one commercial model.
What it cannot answer by itself
- Whether a named game has native support on your console or PC.
- Whether a particular cloud provider currently carries the game in your country.
- Whether an online service will operate for the life of your purchase.
- Whether a buyer outside the covered territory receives the same rights.
- Whether you can obtain a refund if a feature, catalog listing or service changes.
5. Check platform availability instead of assuming it
Ask the seller or platform page a specific question: “Will this exact edition run on my device in my account region, and what must remain available for me to use it?” Look for a supported-platform list, backwards-compatibility statement, required account, activation step and online-service notice.
Native installation versus cloud streaming
A native game is installed and executed on your device, although it may still require activation or online services. Cloud streaming runs the game on a remote system and sends video and input over the internet. A cloud remedy may preserve a way to stream a game without preserving a downloadable build for your platform.
Check whether the listing promises local play, streaming, or both. Confirm minimum connection requirements, supported controllers, data-center availability and whether the service requires a separate subscription. If the store describes streaming as an optional feature, do not treat a streaming commitment as proof that local multiplayer, offline play or mod support will remain.
Console generations and PC editions
Read the edition’s compatibility statement rather than relying on the franchise name. A commitment referring to “PC and console games” may cover rights to those releases without guaranteeing cross-buy, cross-save, a next-generation upgrade or continued access to an older console’s storefront. On PC, verify the operating-system version, launcher, account linking, anti-cheat component and whether the seller allows offline mode.

6. Identify every service dependency
Ownership of a disc or digital license does not necessarily mean independent access. Make a dependency list before checkout.
Account and authentication
Some games require a platform account, a publisher account or a one-time activation. Check whether account linking can be removed, whether a child or family account is eligible and what happens if the authentication service is unavailable. Keep recovery email, two-factor authentication and backup codes current.
Servers and multiplayer
Find the official support page for server status, maintenance and end-of-service notices. Separate a server needed for multiplayer from a server needed to launch the single-player campaign. The available public information about the Microsoft–Activision example does not establish the future server life of any unnamed game, so do not infer a support period from the merger remedy.

Subscriptions and cloud access
Write down which features stop when a subscription ends. A subscription catalog can remove a game while a separately purchased license remains, or a cloud provider can have a different catalog from the platform’s local store. Confirm whether your purchase includes streaming rights or only a local license.
7. Review refund and consumer-law options before paying
Refunds are separate from merger remedies. A transaction condition does not automatically create a right to return a changed game.
Read the actual storefront policy
Check the store’s terms for your country, purchase type and platform before placing the order. Microsoft Store support guidance says digital goods, including games, are not refundable unless the offer or applicable law makes the buyer eligible. It provides a request route for Microsoft Store PC games and notes that online returns are not available in all markets. That guidance is not a universal rule for every Microsoft product or every country, so read the terms shown for your transaction.

Check local statutory rights
Consumer law may provide remedies for faulty, misdescribed or undelivered digital content. The conditions can depend on where you live, when you accepted performance, whether you waived a cancellation period for immediate digital delivery and whether the problem is substantial. A voluntary store policy and a statutory right are different sources of recourse. If you rely on local law, preserve the receipt, listing, error messages and correspondence.

- Save the order number, date, edition, platform and account region.
- Describe the concrete problem: unavailable entitlement, failed activation, missing promised feature or a service that cannot be accessed.
- State whether you seek a refund, replacement, repair or another remedy under the store policy or applicable law.
- Keep the confirmation and any response. Online request forms may be unavailable in some markets, in which case use the support channel named in the store’s terms.
Do not wait for a merger announcement to discover the return deadline. Some policies measure eligibility from purchase, release, download or time played.

A physical copy is not automatically safer, and a digital copy is not automatically more vulnerable. Compare the exact edition and seller using the same criteria.

Only compare products that are actually available in your region. The evidence here does not identify a particular game or edition that should be recommended over another.
9. Follow a purchase workflow that leaves an evidence trail
- Capture the listing. Save the title, edition, platform, region, price, included content and stated online requirements.
- Check transaction status. Read the latest regulator or official platform notice and record its date and whether the deal is proposed, resolved or closed.
- Extract the commitment. Write down covered games, platforms, service type, territory, duration, beneficiary and any exclusions.
- Verify the current catalog. Search the exact title on the intended storefront or cloud service while signed into the correct regional account.
- Test prerequisites. Confirm account linking, subscription, internet, storage, controller, operating system and any launcher or activation requirement.
- Read returns. Open the store’s refund terms for your market and note deadlines, play-time limits, exceptions and contact route.
- Choose the seller. For physical media, confirm who accepts returns and whether the item is new, used, sealed or supplied with redeemable codes.
- Save the order record. Keep the receipt, policy version, product description and support contacts in one place.
This sequence prevents a broad merger headline from substituting for a title-specific check.

“The regulator guaranteed access”
Ask whether the document actually guarantees access to consumers or instead grants rights to a competing provider. Identify the service and territory before treating the statement as relevant.
“Fifteen years means the servers are guaranteed for fifteen years”
A release window, license term and server-support promise are different provisions. Look for an explicit uptime or support obligation; do not convert one into another.
“In perpetuity means every version is protected”
Perpetual language may apply to a particular license or rights package. Check the games, platforms, territory and triggering conditions attached to it.
“A digital purchase is refundable if the game changes”
Refund eligibility normally turns on the store’s offer terms and applicable law. A merger, by itself, is not a general refund trigger.
“A physical disc works offline”
Check the package and support page for activation, mandatory patches, account login and server requirements. Media ownership does not remove those dependencies.
“The deal is closed, so all uncertainty is gone”
Closing ends one stage of a transaction; it does not answer catalog rotation, regional availability, support decisions or the terms of a specific edition.
11. Apply a simple go/no-go test
Buy only when you can answer all five questions in writing:
- Which exact edition, platform, storefront and country am I purchasing?
- What is the current status of the transaction, and which official document supports that status?
- Does any commitment cover this game, service, platform and territory for the period that matters to me?
- What account, subscription, server or cloud dependency could block access?
- What refund or statutory remedy applies if the listing changes or the service fails?
If one answer is unknown, decide whether the uncertainty is acceptable before paying. For a low-cost purchase you may accept a short-term catalog risk; for an expensive collector’s edition, a multiplayer game or a title dependent on cloud streaming, unresolved service and return terms are stronger reasons to wait.

12. What the documented example teaches buyers
The Microsoft–Activision proceedings do not provide a probability that an individual game will lose access or support. No named statistical study establishes such a probability. They do show why buyers should read the operative terms instead of treating “merger” as a single risk category.
- The FTC’s 2022 concerns covered possible effects on rival access, pricing, quality, timing and availability; those were allegations in an enforcement case.
- The CMA’s revised UK arrangement focused on cloud-streaming rights, with different descriptions for global rights, EEA rights and the next 15 years of releases.
- The EEA consumer page from Microsoft states that eligible license holders may stream eligible Activision Blizzard PC and console games through eligible cloud-streaming services under European Commission commitments.
- The same Xbox page says Microsoft’s obligations last ten years and that a consumer or provider license taken during that period endures perpetually. It is explicitly about the EEA, not a worldwide guarantee.
- Microsoft Store guidance treats digital refunds as conditional on the offer or applicable law and notes that online returns are not available in every market.
Your final decision still depends on the game, platform, storefront and region you recorded at the beginning. Those details, not the publisher-wide headline, determine what you can access and what remedy you can use.
