What to Check Before a Data Center Is Built Near Your Home

A practical guide to checking a proposed data center’s zoning, noise, water, electricity, generators, environmental reviews, and public process.

Before a data center is built near your home, check the parcel’s zoning and application, then examine the project’s noise, water, power, generators, and other site impacts. The approvals and public process depend on the location, project size, and application status; there is no single nationwide setback or permit checklist.

Start with the parcel, zoning, and application

Get the parcel number and locate the site on the local zoning map. Ask the planning department for the application file, site plan, staff reports, studies, notices, and any proposed conditions. Confirm whether a data center is allowed in that zoning district or whether the applicant needs rezoning, conditional-use or special-use approval, or another public review.

Local pathways differ. Tucson’s rules for covered large-scale data centers, effective September 4, 2026, provide for neighborhood coordination, a public hearing, Zoning Examiner review, and final consideration by the Mayor and Council. Read Tucson’s adopted regulations. Calvert County permits data centers only in industrial zones; its I-1 district uses conditional-use and special-exception review. See Calvert County’s zoning information. Fairfax County describes review paths that vary by district and application, including some by-right uses and other proposals that require hearings. See Fairfax County’s data-center information.

These are examples, not rules that apply elsewhere. Ask the local planning authority which ordinance and approval route govern this particular parcel, whether the application is complete, and what decisions or deadlines are still ahead.

How close can it be to homes, and how loud might it be?

There is no universal data-center setback. For example, Calvert County’s current zoning summary specifies a 200-foot setback from property lines and at least 400 feet from a parcel with an existing residence or active residential building permit. Those are Calvert-specific distances, and they refer to different boundaries and receptors. Check the county’s current zoning summary.

Noise depends on the facility’s equipment, layout, operating conditions, and applicable local limits. Request the project’s acoustic study and look for the following details:

  • Which equipment is modeled, including cooling equipment and backup generators.
  • Where and when sound is assessed, and what operating scenario is assumed.
  • Whether tonal or low-frequency sound is addressed.
  • Which enforceable noise limits apply, how compliance is measured, and who handles complaints.
  • What barriers or other mitigation are committed to, and how compliance will be monitored.

Tucson’s covered large-scale facilities must provide a sound-impact study and meet requirements that include noise barriers and operational limits. Virginia has a separate, size-triggered rule: its 2026 statute defines a high-energy-use facility as one anticipated to require at least 100 MW from a retail electric utility at filing. For a qualifying new facility seeking specified land-use approvals, the statute requires an assessment of its sound profile on residential units and schools within 500 feet of the facility property boundary. The 500 feet is the area for that assessment, not a universal setback. Read the Virginia statute.

What will it use for water and cooling?

Ask for projected water use and peak demand, the cooling-system design, the proposed water source, and how wastewater will be handled. Find out whether dry cooling or reclaimed water is planned, and ask the water provider whether the supply is available under local conditions. Check whether the site or water source is subject to watershed or drought constraints.

Tucson requires an adequate water supply for covered large-scale data centers. Calvert County identifies cooling systems, water demand, stormwater, wastewater, and environmental permits as relevant review topics. Neither example establishes a general water-use figure or a cooling method that applies nationwide. Treat the applicant’s estimates as projections, and ask which permits or provider findings would confirm the supply and discharge arrangements.

How much electricity will it need, and what upgrades are proposed?

Request the anticipated peak electrical load and confirmation of utility service. Ask whether the proposal requires new or expanded substations, transmission infrastructure, or other grid work; when that work would occur; and who is responsible for its costs. A project’s stated demand is not the same thing as a completed utility review or a guarantee of service.

Virginia’s 2026 statute requires specified utility information about substations and anticipated transmission voltage for applications involving qualifying new high-energy-use facilities. In Virginia, the State Corporation Commission has authority over important energy matters such as rates, demand, and transmission lines. Elsewhere, identify the relevant utility and state regulators rather than assuming Virginia’s jurisdictional roles apply.

What backup generators and other site impacts should you check?

Ask what backup generators are proposed, how they will be tested or operated, and whether air permits and emissions controls apply. The application may also address land disturbance, stormwater, wastewater, lighting, heat, landscaping, building design, sensitive lands, construction traffic, and emergency access. Which reviews apply depends on the project and the agencies with jurisdiction.

Calvert County lists generators, mechanical equipment, cooling, noise, heat, water demand, stormwater, wastewater, and land disturbance among its review topics. Fairfax County notes that Virginia DEQ regulates air pollution and some cooling-water discharges. Tucson’s adopted rules include environmental reviews, open-space and landscaping provisions. These examples can help you identify questions to ask, but they do not establish a universal review checklist.

For each issue, ask whether the application assesses it, what mitigation is promised, which agency decides whether it complies, and whether any commitment would become an enforceable permit or approval condition. Distinguish proposed plans from approved conditions and measured operating data.

How can residents take part in the review?

Track local land-use proceedings and utility proceedings separately; they may have different agencies, records, and deadlines. Download public notices, staff reports, application exhibits, technical studies, and written decisions from the responsible authorities.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Confirm the process: Ask the planning office which hearings or meetings apply, who will decide the application, and the deadline and format for written comments.
  2. Review the record: Read the site plan and technical studies. Note missing information, assumptions that affect nearby properties, and whether proposed mitigation is specific and enforceable.
  3. Submit focused questions: Tie each concern to a location, study, operating scenario, permit, or proposed condition. Ask how to make written material part of the official record.
  4. Follow the decision: Check the final written decision for conditions, monitoring or reporting requirements, and any later permits or approvals still outstanding.

Tucson’s process includes neighborhood coordination and public hearings; Calvert County requires a public meeting before Planning Commission consideration under its local process; and Fairfax County describes testimony and written submissions for applications that require public review. The applicable steps depend on the proposal and jurisdiction.

Compare proposals using the same questions

If you are comparing possible sites or project designs, use consistent criteria rather than relying on a single distance or headline number:

  • Distance to homes and other sensitive uses.
  • Modeled noise, applicable limits, operating assumptions, and mitigation.
  • Water demand, source, cooling design, and wastewater arrangements.
  • Peak electrical demand, grid upgrades, schedule, and cost responsibility.
  • Generator type, testing, emissions permits, and controls.
  • Land, stormwater, wastewater, lighting, and heat impacts and mitigation.
  • Public process, enforceable conditions, and monitoring or reporting commitments.

These are comparison questions, not a claim that every jurisdiction requires every disclosure. For a particular parcel, verify the current local ordinance and open deadlines with the responsible planning authority; rules and application status can change.
