What Should a School Anti-Bullying Policy Include?

A clear school anti-bullying policy defines covered conduct, explains reporting and investigation steps, protects students, and adapts to state and local law.

A school anti-bullying policy should define prohibited behavior, explain where the rules apply, show how to report concerns, and spell out how the school will investigate, protect students, respond, communicate, and prevent future incidents. It should also identify routes for handling possible discrimination or disability-related concerns. The details must be checked against current state and local law; there is no single federally mandated template for every school.

What should an anti-bullying policy cover?

Use plain language that students, families, staff, and administrators can understand and follow. The U.S. Department of Health and Human Services’ StopBullying.gov describes common components in state anti-bullying laws and policies, while cautioning that states and local education agencies should check applicable federal and state law: Common Components in State Anti-Bullying Laws, Policies and Regulations.

  • The policy’s purpose and clear definitions of bullying and cyberbullying.
  • The locations, activities, and technologies covered, along with any applicable limits on off-campus reach.
  • Prohibitions on bullying and retaliation, plus accessible reporting routes.
  • Named responsibility for receiving reports, investigating, deciding responses, and escalating unresolved concerns.
  • Prompt investigation, protective measures, documentation, family communication, consequences, and student support.
  • Prevention education, staff training, policy communication, and periodic review.

These are useful policy-design components, not a universal checklist of legal duties. Local requirements and the school’s legal obligations control.

How should the policy define bullying and explain its scope?

Use definitions students can apply

Explain the policy’s purpose, including its aims for student safety, learning, engagement, and school climate. Define bullying in accessible terms and include cyberbullying. The federal common-components framework recommends describing a range of conduct, including intentional efforts to harm that may be direct or indirect, physical or nonphysical, verbal or nonverbal. It also identifies retaliation for reporting and redistribution of harmful material as conduct to address. Use the definition required by state law where one applies, and do not leave students to guess whether a threatening message, humiliating post, or indirect behavior is covered.

State where the rules apply

Say whether the policy covers school grounds, school-sponsored activities held elsewhere, school transportation, school-owned technology, and off-campus conduct that creates significant disruption to the school environment. The federal framework offers these as examples; it does not override state law or constitutional limits.

Identify characteristics that have historically made students targets, using terminology and requirements that match current law. Make clear that conduct can violate the school’s bullying policy whether or not it is based on a particular characteristic.

How should schools handle reports of bullying?

Make reporting routes and ownership clear

Explain how students, families, staff, and other witnesses can report concerns. Name the official or role responsible for receiving reports and provide current contact details in the policy itself. Consider an anonymous reporting option where appropriate, but do not treat an anonymous submission as a substitute for investigation or protection. Explain that confidentiality will be maintained to the extent possible, and prohibit retaliation against people who report or participate in an inquiry.

Require staff to pass on incidents they witness or learn about to the designated official in a timely way. The policy should tell families and students how to raise a concern if they disagree with the initial response or need it escalated.

Describe the school’s next steps without inventing a universal deadline

Set out an intake and investigation process: who determines what occurred, how the school will act promptly, how immediate safety needs will be handled, who decides the response, and how the outcome and actions will be recorded. Explain when parents or guardians will be notified, consistent with applicable law and privacy requirements. Federal guidance supports prompt investigation and safeguards, but does not set one deadline or require one report form for every school.

What responses and support should the policy explain?

Describe a range of responses rather than promising one automatic penalty for every case. The response should address the conduct, help stop it, and reduce the risk it will recur. Explain how the school will protect a targeted student, check for continued behavior or retaliation, and refer students for counseling or other support services when appropriate.

Tell families what process and support they can expect while protecting student information as required by law. Avoid presenting “zero tolerance” as a proven solution: StopBullying.gov reports that research finds zero-tolerance policies are not effective in reducing bullying. Its overview also summarizes 11 recommended guiding principles and reports an association between certain state-law components and 20 percent lower odds of a child being bullied. That figure is an attributed association, not evidence that any one school policy guarantees a reduction: Research Resources.

What prevention, training, and review belong in the policy?

Give the school a way to make the written rules work consistently. The policy should address age-appropriate prevention education, relevant staff training, parent engagement, and how students, families, and staff will be informed about expectations and reporting routes.

Require regular review. Consider collecting and analyzing incident data to identify patterns and assess whether responses are working. StopBullying.gov includes training, education, monitoring, and data collection among the Department of Education’s recommended guiding principles; whether a particular element is legally required depends on jurisdiction.

When does a report require more than a bullying-policy response?

Some student-on-student misconduct may also be discriminatory harassment under laws enforced by the U.S. Department of Education’s Office for Civil Rights (OCR). OCR says that when a school knows or reasonably should know of possible harassment, it must take immediate and appropriate steps to investigate or otherwise determine what occurred. If the school finds discriminatory harassment that created a hostile environment, it must take prompt and effective steps to end it, eliminate the hostile environment, prevent recurrence, and, as appropriate, remedy its effects. See OCR’s Harassment and Bullying guidance.

A policy should direct staff to the district personnel responsible for civil-rights issues when facts may raise them. OCR’s current summary notes that the 2010 Dear Colleague Letter is inconsistent in some respects with later regulations and executive orders; do not rely on that older letter as an unqualified statement of current Title IX requirements. Check current law and agency guidance.

Disability-related concerns may also call for attention beyond discipline. StopBullying.gov explains that federal protections can apply in relevant circumstances and that IDEA support may be implicated when bullying interferes with a student’s appropriate public education. State and local requirements vary: Federal Laws.

How can a school check a policy before adopting it?

Review proposed language against the state’s definition and rules on scope, reporting, investigations, and required responses. Then check whether a student and caregiver can readily tell what conduct is covered, whom to contact, what happens next, how the school will safeguard students, and where possible civil-rights or disability concerns go. Finally, confirm who will train staff, communicate the policy, monitor implementation, and lead periodic review. The policy is useful only if those procedures can be carried out consistently.
