Before signing a rental agreement in Spain, verify what kind of tenancy it is, who is renting the property to you, the full written terms, the total cost, and the dwelling’s condition. Pay particular attention to duration, early-exit terms, the deposit and any extra guarantee. The rules can depend on the property’s location, the landlord, the contract’s purpose and date, so treat this as a national checklist—not a ruling on a specific lease.
First check what kind of rental you are signing
Ask whether the agreement is for your habitual residence, a room, or a genuinely temporary stay. The contract’s label is not enough: its stated purpose should reflect your actual arrangement. Classification affects which statutory rules apply, and room or temporary agreements may raise questions that cannot be resolved without the location and specific facts.

If the contract describes a temporary stay, make sure you understand what that means for your rights and obligations before signing. Do not assume that calling an agreement “seasonal” settles its legal status.
Verify the landlord, property and complete contract
Confirm who is entitled to rent the dwelling
Check the landlord’s identity or the representative’s authority to act for them. Make sure the agreement identifies the exact dwelling and lists anything else included, such as storage, parking, appliances or furniture.

Get the full agreement in writing
Review the complete contract rather than relying on the listing or verbal assurances. Either party may require a written agreement under Spain’s national Urban Leases Act (Ley de Arrendamientos Urbanos, or LAU). It should identify the parties and rented property, state the agreed term and initial rent, and record other agreed clauses. Keep a signed copy and proof of every payment.
Document the starting condition
Compare the inventory with what is actually in the property. Before taking possession, record existing marks, damp, broken fixtures, appliance condition, keys and meter readings in dated photographs or a signed condition schedule. Do not sign an inventory stating that the dwelling is in good condition if it is not.
Under the LAU, the landlord is generally responsible for repairs needed to keep the dwelling habitable, except for deterioration attributable to the tenant; small repairs caused by ordinary wear are the tenant’s responsibility. Report necessary repairs promptly and in writing. If the landlord promises to fix an existing problem, have the promise and timing recorded in the contract or an attached schedule.

Understand the duration, renewal and early-exit terms
Check the agreed term and statutory extensions
The parties agree the lease term. For a dwelling lease covered by the LAU, if that term is shorter than five years—or shorter than seven years when the landlord is a legal entity—the tenant generally has annual mandatory extensions until the applicable minimum is reached. The tenant can prevent an extension by giving at least 30 days’ notice of non-renewal.
There are statutory exceptions. For example, a natural-person landlord may be able to recover the dwelling for a stated need after the first year if the contract contains the required clause. Read any landlord-need wording carefully rather than assuming that the minimum term guarantees you can stay in every circumstance.
Find out what leaving early would cost
A tenant may generally withdraw after at least six months by giving at least 30 days’ notice. Compensation for leaving early is due only if the contract includes the permitted agreement: the statutory measure is one month’s rent for each remaining year, proportionally adjusted for a shorter period. Check the lease’s notice, move-out and key-return provisions before accepting them.

Calculate the full monthly and upfront cost
Separate rent from recurring charges
Write down the rent, payment due date and method, individually metered utilities, shared expenses, taxes and any other charge. The LAU allows general expenses and charges that are not individually metered to be assigned to the renter by written agreement specifying their annual amount. Individually metered services are for the renter. Ask for charges to be separately identified and evidenced so you can see what each amount covers.
Confirm who pays agency and contract-formalization costs
Under the current LAU text, real-estate agency management costs and contract-formalization costs are for the landlord. Ask for any requested payment to be identified clearly rather than folded into an unexplained charge.
Check whether a rent limit may apply
For a rental in a declared stressed residential market zone, statutory rules may limit the starting rent by reference to the prior rent for the habitual dwelling; a ceiling based on a rent index may also apply to a large holder. Which limit applies depends on the location, landlord status, property characteristics and rental history. You need the address and contract facts to determine whether a limit applies and calculate it.

Check the deposit and any additional guarantee
For a dwelling lease, the LAU requires a cash deposit equal to one month’s rent. The contract can also require additional guarantees. For qualifying dwelling contracts of up to five years—or seven years when the landlord is a legal entity—those additional guarantees are capped at two months’ rent. Ask the agreement to state each amount separately and explain its purpose.
Keep receipts and check the deposit-lodgement procedure for the relevant autonomous community. If the deposit balance is not returned within one month after the keys are delivered, it accrues legal interest.

Visit the property when possible. Check:
- Visible damp, leaks and the condition of walls and ceilings.
- Whether windows and doors open, close and lock properly.
- Hot water, heating or cooling, plumbing and electrical outlets.
- Appliances, keys and locks.
- Noise at a time that gives you a realistic sense of the surroundings.
Ask who will handle unresolved repairs and when they will be completed. Record any commitment in the contract or an attached schedule. These checks are practical precautions, not a claim that each item is a statutory document or test.

Account for the October 2026 legal changes
The rules changed and were repealed within days. Real Decreto-ley 26/2026 was published on 30 September, took effect on 1 October, and was repealed by Congress on 2 October. The consolidated LAU marks its changes to lease provisions as left without effect. Real Decreto-ley 27/2026, which also amended renewal provisions, is marked derogated by the Congress resolution published on 2 October.
Do not treat the short-lived decrees’ changes to fees, deposits, repairs or renewals as current law on 4 October 2026. Check the consolidated LAU version applicable on the date your contract was made: prior contracts may have different transitional treatment. The official sources for this date-sensitive check are the BOE’s consolidated LAU and the relevant decree and Congress-resolution records.
