What Records to Keep for IOLTA Reconciliation—and How Long to Keep Them

A practical guide to IOLTA reconciliation records, schedules, and retention triggers, with official California, Massachusetts, Pennsylvania, and North Carolina examples.

Keep enough records to connect every IOLTA transaction to the client whose funds it affects, the bank activity, and the completed reconciliation. The core set is a transaction register or account journal, individual client ledgers, bank statements and cancelled checks or equivalent transaction records, deposit and disbursement support, and reconciliation reports. There is no single U.S. retention period: official examples range from five to six years and start the clock at different events, so check the rule that governs your account before setting a destruction date.

Which records support an IOLTA reconciliation?

A bank statement shows activity in the account, but by itself it does not show how much belongs to each client. A defensible record set links the account-wide balance, each client’s balance, and the bank’s record of transactions.

  • Transaction register or account journal: a chronological record of receipts, disbursements, and other account activity.
  • Individual client ledgers: a separate running record of funds held and transactions for each client. Keep an account-charge or bank-charge ledger too if the governing rule or your accounting method calls for one.
  • Bank records: account statements and cancelled checks, or equivalent records that show the transactions and clearings.
  • Deposit and disbursement support: records substantiating money received and paid out, as required by the local rule.
  • Completed reconciliation reports: retain the reports that show the comparison and resulting balances, with any required dates or signatures.

The State Bar of California describes a three-way reconciliation comparing the trust account journal, individual ledgers (including a bank-charge ledger if applicable), and bank statements with cancelled checks. North Carolina’s rule describes comparing the general ledger, the total of subsidiary-ledger balances, and the adjusted bank balance. See the California State Bar handbook and North Carolina Rule 1.15-3.

How often should you reconcile?

Frequency depends on the jurisdiction. California’s handbook says reconciliation is required monthly for both IOLTA and non-IOLTA trust accounts. Massachusetts Rule 1.15 requires reconciliation reports regularly and at least every 60 days. Those examples are not a nationwide schedule; consult the current rule governing your account.

How long should IOLTA records be kept?

The period and the event that starts it vary by jurisdiction. The following official examples illustrate why a single national deadline would be misleading; they are not a fifty-state survey.

Jurisdiction Record or requirement described Retention period and trigger
California Client ledgers, account journals, bank-charge ledgers, bank statements and cancelled checks, and monthly reconciliation records Five years after disbursement of all funds to which the records relate. If the attorney is under State Bar investigation, retain the records until the investigation concludes. Source: State Bar of California training transcript.
Massachusetts Records under Rule 1.15 Six years after termination of representation and distribution of the property. Source: Massachusetts Rule 1.15.
Pennsylvania Records under Rule 1.15 Five years after the later of termination of the client-lawyer or fiduciary relationship, or distribution or disposition of the property. Source: Pennsylvania Rule 1.15.
North Carolina Signed, dated trust-account reconciliations Six years. Source: North Carolina Rule 1.15-3.

Read the trigger carefully: a retention clock may depend on when funds are disbursed, when representation ends, when property is distributed, or a combination of events. The California State Bar training material also says records must be retained through the conclusion of a State Bar investigation. A local rule, audit, court order, investigation, or other legal hold may require a longer hold; do not destroy records while such an obligation applies.

How to set a safe retention process

  1. Identify the governing rule. Determine the state or court rules that apply to the account, then check the current text rather than relying on another jurisdiction’s period.
  2. Inventory the records the rule covers. Include source documents as well as the final reconciliation report: journals or registers, client ledgers, bank records, transaction support, and any required signed or dated reports.
  3. Record the trigger date for each matter. Track the event specified by the rule, such as final distribution or termination of representation, and calculate the retention end date from that event.
  4. Apply holds before destruction. Keep relevant records longer when an investigation, audit, court order, or other legal hold is active.
  5. Confirm electronic records remain usable. Preserve the records in a form that can be retrieved and reproduced as the applicable rule requires. Requirements can be format-specific: for example, Wisconsin rule text has described computer records as reproducible in printed form and printing IOLTA registers, subsidiary ledgers, and reconciliation reports every 30 days, with printed copies kept for at least six years. Because the available Wisconsin text may be an older version, verify the current rule before relying on that schedule.

Accounting software may help maintain recurring registers, client ledgers, and reconciliation reports, but using software does not by itself establish compliance. Check the local rule and whether the system can preserve and reproduce the records it requires.
