A TPO generally requires written consent for specified work; the conservation-area process generally requires six weeks’ notice. Check the local order, map and conservation-area status before arranging work.
What makes a tree legally protected?
Protection depends on a local planning decision or on the tree’s location in a conservation area—not simply its species or size. A local planning authority can make a TPO to protect particular trees, groups or woodland in the interests of amenity. Separately, section 211 of the Town and Country Planning Act 1990 generally requires advance notice for certain work on a tree in a conservation area that is not already covered by a TPO.

The national framework is set out in Part VIII of the Town and Country Planning Act 1990, as amended, and the Town and Country Planning (Tree Preservation) (England) Regulations 2012, which came into force on 6 April 2012. The government’s guidance for England is titled Tree Preservation Orders and trees in conservation areas.
How does a Tree Preservation Order work?
A TPO is an order made by a local planning authority to protect identified trees or woodland in the interests of amenity. The authority decides whether an order is justified; there is no automatic protection based on a tree being a particular species or reaching a particular size. Government guidance says authorities should consider whether removing a tree would significantly harm the local environment and its enjoyment by the public, and whether protection would provide a reasonable degree of public benefit. Visibility from public places is relevant, but visibility alone is not enough.

What can an order cover?
A TPO can cover an individual tree, a group of trees, an area, or woodland. The order identifies what is protected and has an associated map, so the order and map should be checked against the actual tree. A woodland-classification order also covers regeneration and new planting within the designated woodland area.
What work is controlled?
Without written consent from the local planning authority, a TPO generally prohibits cutting down, topping, lopping, uprooting, wilful damage or wilful destruction of a protected tree, subject to defined exceptions. The government guidance says the Secretary of State’s view is that cutting roots is also a prohibited activity requiring consent. The rules can depend on the exact work and circumstances, so do not assume that pruning or making a tree safe is automatically exempt.

How is conservation-area tree protection different?
If a tree in a conservation area is already covered by a TPO, the TPO process applies. If it has no TPO, section 211 generally requires the person proposing certain work to give the local planning authority six weeks’ advance notice.

If the authority does not make a TPO, the work may proceed after the notice period, within the period described in the government guidance. Check that guidance and the authority’s advice for the precise work and any applicable exception.

How to check before arranging tree work
- Find the local planning authority. Contact the authority responsible for the tree’s location and ask whether the land is in a conservation area and whether a TPO applies.
- Ask for the relevant order and map. If there may be a TPO, confirm that the specific tree or woodland is covered rather than relying on a general property description.
- Describe the work precisely. State what is proposed, including whether it involves branches, roots, removal or urgent safety work. Different activities and exceptions may be treated differently.
- Follow the correct procedure. For TPO work, check whether written consent is required and follow the application process and any conditions. For a non-TPO tree in a conservation area, check whether section 211 notice is required and allow the notice period before relevant work.
- Verify any claimed exception. Owners, agents and contractors should take care not to exceed an exception. Ask the authority or a qualified arboriculturist if the scope is uncertain.
- Check for other constraints. Protected-species rules and, in some circumstances, felling-licence requirements may also apply. GOV.UK explains the relationship between felling permissions and TPOs in its tree-felling permission guidance.
What happens after a TPO application?
The local planning authority considers the effect of the proposed work on amenity and whether the work is justified, taking account of the reasons and supporting information in the application. It may grant consent with conditions. If consent is refused, an appeal may be made to the Secretary of State. What are the risks of unauthorised work?
Carrying out work prohibited by a TPO can be an offence. The government guidance says a prosecution must establish, among other things, that the tree was protected at the relevant time, prohibited work took place, and the defendant carried it out, caused it or permitted it. Not knowing about an order is generally not a defence, which is why checking the local records before work matters.

A replacement duty can arise when a TPO-protected tree is removed, uprooted or destroyed in circumstances set out in section 206 of the Town and Country Planning Act 1990. The duty and rules differ for woodland classification, and statutory exceptions may matter. A replacement tree planted under the statutory duty is automatically protected by the original order; replacement is not automatic in every case.

The local order and map, conservation-area boundary, proposed work and any applicable exception determine what is required at a specific site. The government guidance page displays a revision date of 6 March 2014; consult the local planning authority and current legislation for a live decision.
