It tests whether able, willing, qualified, and available U.S. workers can fill a permanent job and whether hiring the foreign worker would harm similarly employed U.S. workers’ wages or working conditions.
PERM is one stage—not a green card, immigration status, or guarantee of a visa. When a category requires labor certification, a certified Form ETA-9089 normally supports the employer’s Form I-140 petition to U.S. Citizenship and Immigration Services (USCIS). The worker can then pursue an immigrant visa abroad or adjustment of status in the United States when a visa is available.

What PERM labor certification actually is
PERM is the name commonly used for permanent labor certification. Historically, the acronym referred to Program Electronic Review Management; today, it describes the DOL process for certifying certain permanent employment opportunities.

DOL’s program page states: “The filing of applications is the responsibility of the employer, not the employee.” The employer must show that the job is a genuine, permanent, full-time opportunity and that employing the foreign worker will not displace qualified U.S. workers or depress their wages and working conditions.

PERM is therefore a labor-market protection procedure, not an assessment that the worker deserves permanent residence. DOL evaluates the job, its minimum requirements, the offered wage, the recruitment conducted, and the employer’s attestations. A worker may benefit from the case, but the worker does not file the PERM application.
Where PERM fits in the employment-based green card process
For an employment category that requires labor certification, the usual order is:
- Job planning: The employer defines a permanent, full-time position and its actual minimum requirements.
- Prevailing wage: The employer obtains a valid DOL prevailing-wage determination for the occupation and location before filing.
- Recruitment: The employer completes the recruitment required for the occupation and the applicable regulatory path.
- PERM filing: The employer submits Form ETA-9089 to DOL.
- DOL decision: DOL certifies, audits, supervises recruitment, or otherwise acts on the application under the applicable procedure.
- Immigrant petition: If certified, the employer submits the certification with Form I-140 to USCIS within the certification’s validity period.
- Visa or adjustment stage: The worker applies for an immigrant visa through a U.S. consulate or, if eligible and a visa is available, files for adjustment of status with USCIS.
The Department of State describes labor certification as an initial step for some employment-based immigrant categories, followed by the I-140 petition. Other categories do not require PERM. Whether it is needed depends on the specific immigrant classification, not simply on the fact that the worker is employed in the United States.
Which parties do what?
| Party | Primary responsibility | What the role does not mean |
|---|---|---|
| Employer | Defines the job, obtains the prevailing wage, conducts required recruitment, files ETA-9089, and—after certification—files Form I-140. | The employer cannot treat PERM as a promise that a visa number will be available. |
| Foreign worker | Provides accurate background, education, experience, and immigration information and responds to the employer’s requests. | The worker does not file the PERM application or control the DOL case. |
| DOL | Reviews whether the labor-market test and application meet the labor-certification rules. | DOL does not issue a green card or an immigrant visa. |
| USCIS | Adjudicates the employer’s Form I-140 and later adjustment-of-status filings, where applicable. | USCIS approval does not itself create an immediately available visa number. |
| Department of State | Handles immigrant-visa processing through consulates and publishes visa-availability information. | A PERM certification does not guarantee consular visa issuance. |
The PERM process, step by step
1. Define a real permanent job
The employer begins with a permanent, full-time job opportunity rather than a temporary assignment. The stated duties and minimum requirements must describe the actual position. Requirements that are unusually narrow, tailored to one individual, or unsupported by the employer’s business needs can create problems during review.

Before recruitment starts, the employer should settle the work location, duties, education, experience, skills, travel or remote-work expectations, and any licensing requirements. The requirements used in recruitment and on ETA-9089 need to be consistent. A later change to a material job requirement can require a new analysis and may prevent the employer from relying on the original recruitment.
2. Obtain the prevailing wage
DOL requires a valid prevailing-wage determination before the PERM application is filed. The determination is tied to the occupation, geographic area, and other characteristics of the job. The employer must be prepared to offer at least the required wage under the applicable rules.
The prevailing wage is not a suggestion for negotiating salary. It is a compliance benchmark for the labor-certification case. Employers should preserve the determination, its validity dates, and the job description used to request it so the filing can be checked against the wage record.

3. Complete the required recruitment
Recruitment is the labor-market test. The exact advertisements, notices, and timing depend on the occupation and the regulatory path. DOL’s FLAG overview emphasizes that the recruitment procedure varies with the program being used; a professional occupation and a nonprofessional occupation do not necessarily follow identical steps.

The employer must follow the applicable instructions, present the opportunity accurately, and keep evidence of where and when recruitment occurred, the text used, and the responses received. Qualified U.S. applicants cannot be rejected simply to preserve a preferred foreign-worker case. If a U.S. applicant meets the stated minimum requirements and is available for the job, the employer needs a lawful, documented reason for not hiring that person.
4. File Form ETA-9089
After recruitment and the other prerequisites are complete, the employer files ETA-9089 with DOL. The form captures the employer, job opportunity, prevailing wage, recruitment, worker qualifications, and required attestations. The employer is responsible for the truth and consistency of the filing, even when an attorney or agent helps prepare or submit it.
Small discrepancies can matter. The employer should compare the ETA-9089 with the prevailing-wage request, recruitment materials, internal job description, and the worker’s résumé and supporting records before submission. The worker should review personal information and qualifying experience for accuracy, but should not sign or submit an employer filing outside the role assigned by the process.
5. Respond to DOL review or an audit
DOL may approve the application, request additional documentation through an audit, require supervised recruitment, or issue another determination under the governing rules. An audit is not the same as a denial, but it requires a prompt, organized response. Recruitment records, résumés, interview notes, lawful rejection reasons, payroll or business records, and proof of the prevailing wage may become important.

If DOL denies the application, the employer must evaluate the stated reason before deciding whether an appeal, correction, or new case is appropriate. A new filing may require repeating recruitment and obtaining a new prevailing-wage determination.
6. Use the certification promptly for Form I-140
A certified PERM application is time-limited. DOL states that the certification expires if it is not submitted to USCIS with Form I-140 within 180 days. The employer should coordinate the I-140 filing early enough to account for document collection, signatures, corporate approvals, and delivery or electronic-submission requirements.
Submitting the I-140 does not finish the green card process. USCIS must still decide whether the employer and worker meet the requirements of the selected immigrant category, and the worker must wait for visa availability before the final immigrant-visa or adjustment stage can proceed.
How long does PERM take?
Processing figures describe a particular DOL workload, not the entire green card case. The DOL Office of Foreign Labor Certification reported an average of 336 calendar days for PERM analyst-review determinations processed in August 2026, on a page marked current as of October 5, 2026. DOL cautions that actual times vary with the employer’s application and circumstances.

| Measure | What it means | What it does not tell you |
|---|---|---|
| 336 calendar days | Average PERM analyst-review determination time for cases processed in August 2026, according to DOL’s October 5, 2026 processing snapshot. | It is not a promise for a newly filed case and does not include recruitment, prevailing-wage preparation, I-140 adjudication, or visa processing. |
| 180 days | Validity period for a certified PERM application to be submitted to USCIS with Form I-140. | It is not an estimate of how long the green card will take. |
| Approximately 140,000 visas each fiscal year | Department of State’s broad annual employment-based immigrant-visa availability figure across categories. | It is not an individual case’s waiting-time estimate or a guarantee that a visa is immediately available. |
Recruitment and prevailing-wage preparation occur before the analyst-review clock, while later USCIS and visa stages can add substantial time. A worker should therefore ask for a case-specific timeline that separates each stage instead of treating the PERM average as a green-card estimate.

PERM is not the I-140
PERM answers a labor-market question for DOL. The I-140 answers an immigrant-petition question for USCIS: whether the employer, the worker, and the selected employment category satisfy immigration requirements. The I-140 generally relies on the certified ETA-9089 when labor certification is required, but the agencies perform different reviews.
PERM is not a priority-date guarantee
The priority date and visa availability determine when the worker can move to the final immigrant-visa or adjustment stage. In a labor-certification case, the relevant date is generally connected to the properly filed labor-certification application, but the worker must still follow the category’s visa-availability rules. A certified PERM can sit in a case waiting for a visa number.

Some employment-based classifications are exempt from labor certification. The correct route depends on the classification and the facts, such as the type of work, the requested category, and whether a statutory or regulatory exemption applies. Filing PERM when a category does not require it can add delay; assuming an exemption without confirming it can create a serious filing error.
What can derail a PERM case?
- Inconsistent job descriptions: The prevailing-wage request, advertisements, ETA-9089, and internal records describe materially different duties or requirements.
- Unclear minimum requirements: The employer cannot show that the education, experience, or special skills are genuinely necessary for the position.
- Recruitment defects: A required step is missing, published at the wrong time, inaccurately describes the job, or lacks supporting records.
- Unlawful rejection of U.S. applicants: The employer cannot document a legitimate reason tied to the stated minimum requirements.
- Worker-qualification mismatch: The worker’s education or experience does not satisfy the requirements listed on ETA-9089 by the relevant date.
- Late I-140 filing: The employer allows the 180-day certification validity period to expire.
- Material job change: The location, duties, employer, or requirements change enough that the original labor certification no longer describes the offered position.
- Assuming visa availability: The employer or worker plans the final stage without checking the current Department of State Visa Bulletin and USCIS filing-chart guidance.
A practical checklist for workers
- Ask the employer which employment-based category is being pursued and whether that category requires PERM.
- Request a plain-language description of the permanent job, work location, minimum requirements, and expected recruitment timeline.
- Verify every degree, date, employer, job title, duty, and period of experience that will appear in the case.
- Ask when the prevailing-wage determination was obtained and whether its validity covers the planned filing.
- Keep copies of your résumé, diplomas, transcripts, experience letters, licenses, and immigration records.
- Confirm who will monitor the DOL case, the 180-day certification deadline, and the I-140 filing.
- After the I-140, monitor visa availability by category and chargeability area rather than assuming certification means a visa is current.
- Seek individualized advice from a qualified employment-immigration professional when the job, employer, category, or personal history is complicated.
A practical checklist for employers
- Confirm that the position is permanent and full-time and that the business can document the genuine need for it.
- Freeze the job description and minimum requirements before requesting the prevailing wage and starting recruitment.
- Use the recruitment procedure that applies to the occupation and preserve complete evidence of every step.
- Apply the stated requirements consistently to U.S. applicants and document lawful, job-related reasons for any rejection.
- Reconcile the prevailing-wage determination, recruitment materials, ETA-9089, worker records, and corporate information before filing.
- Prepare an organized audit file even when no audit has yet been issued.
- Track DOL notices, the certification date, the 180-day I-140 deadline, and any material change to the job or employer.
- Use an attorney or agent when appropriate, with a written engagement that explains responsibilities and deadlines. The official sources cited here do not establish a universal rule for allocating every recruitment or legal cost, so obtain case-specific guidance rather than relying on assumptions.
When professional help is sensible
PERM is employer-led, form-heavy, and sensitive to small factual differences. Professional advice is especially useful when the employer has never sponsored a worker, the position has unusual requirements, recruitment produces qualified U.S. applicants, the worker’s experience was gained abroad or with a related company, the job may change, or the case receives an audit or denial.
The American Immigration Lawyers Association lists a print AILA’s Guide to PERM Labor Certification, 2026 edition, released September 29, 2026. Its publisher describes coverage of prevailing wage, job requirements, recruitment, ETA-9089, audits, supervised recruitment, appeals, and practice tools. It is a practitioner reference, not a substitute for advice about a particular employer or worker.
What to verify before relying on a timeline
Processing times, forms, filing procedures, and visa availability can change. Before acting, confirm the current DOL FLAG instructions, the latest OFLC processing-time page, the Department of State Visa Bulletin, and USCIS guidance on which filing chart applies. October 2026 visa cutoffs and the applicable adjustment filing chart are not established by the information summarized here, so they should be checked directly at the time of filing.

The central distinction is simple: PERM certifies a labor-market test for a particular employer and job. It does not confer status. The I-140, visa availability, and the final immigrant-visa or adjustment process still determine whether the worker can become a permanent resident.
