Digital asset trading is the buying, selling or exchanging of digitally represented assets through an intermediary platform or a protocol-based marketplace. The phrase describes an activity, not a single type of asset or a universal legal category: the rules depend on the asset, the service being provided and the jurisdiction.
What counts as a digital asset?
In everyday use, digital assets can include crypto tokens and other assets represented digitally. The term does not have one universal legal meaning. For example, the U.S. Securities and Exchange Commission’s Division of Trading and Markets describes crypto assets in its staff FAQ as assets generated, issued or transferred using blockchain or similar distributed-ledger technology and relying on cryptographic protocols. That description is specific to the FAQ’s subject and purpose, not a binding definition for every law or transaction.

How does digital asset trading work?
A trade exchanges one asset for another, or an asset for money, under the terms of the service or marketplace being used. The marketplace may be operated by a business, or it may use a protocol that lets users trade directly. Those arrangements describe how access and execution are organized; they do not, by themselves, determine an asset’s legal status.

Intermediated platforms
A company-operated platform can provide a way to place and execute buy or sell orders. Depending on its design and the service, it may also hold customer assets. The U.S. Internal Revenue Service discusses custodial digital asset platforms and certain non-custodial platform operators in the context of tax-broker rules and reporting. That tax discussion is not a blanket determination that every platform has the same legal status or obligations. See the IRS Internal Revenue Bulletin 2023-38.
Decentralized marketplaces
The European Securities and Markets Authority describes decentralized exchanges as marketplaces where users can trade crypto assets directly without a central authority or intermediary. “Decentralized” describes the market structure; it does not establish that a service is risk-free, anonymous or outside applicable law. Trading and custody are different
Trading concerns the exchange of assets. Custody concerns who holds or controls them, including access to the keys or systems needed to move them. A platform may provide both services, but readers should check the actual arrangement rather than assume that every venue holds assets in the same way.

- Does the service hold customer assets, or do users retain control?
- What procedures govern withdrawals and transaction approvals?
- Which jurisdiction and regulatory status apply to the service?
These questions matter because control arrangements can create distinct risks. In an announcement dated August 15, 2025, Hong Kong’s Securities and Futures Commission reported that its targeted review of licensed virtual asset trading platforms found concerns involving compromised third-party wallet solutions, insufficient transaction verification and inadequate access controls over approval devices. Those findings concern the platforms and review described by the SFC; they should not be generalized to every service. SFC Executive Director of Intermediaries Dr Eric Yip said client asset protection “must always remain a top priority for all licensed VATPs.” Read the SFC announcement.

What the term does—and does not—tell you
Calling an activity digital asset trading does not establish that an asset is a particular kind of regulated product, that a platform is licensed, or that a venue holds customer funds. Legal treatment can vary with what the asset represents, what activity is being performed and which jurisdiction’s rules apply. The SEC FAQ is staff guidance; the IRS material addresses tax reporting and broker obligations; and ESMA’s analysis describes market structures in an EU context. These sources serve different purposes, so their terminology should not be treated as one universal legal test.
In short, use the phrase as a practical description of buying, selling or exchanging digital assets, then assess the particular asset, venue, custody arrangement and jurisdiction separately.
