A virtual electronic record is generally an electronic record that is presented or assembled digitally. The phrase does not have one universal definition: in a particular system, “virtual” may mean that information is brought together from linked sources for access rather than stored as one consolidated file or database.

The phrase combines two ideas, but its precise meaning depends on the field, system and jurisdiction. “Electronic record” refers broadly to information created or handled electronically. “Virtual” may describe how that information is presented or accessed, rather than where every underlying piece of data is stored.

In the United States, the E-SIGN Act defines an “electronic record” as “a contract or other record created, generated, sent, communicated, received, or stored by electronic means.” The statute’s definition of “record” covers information inscribed on a tangible medium or stored in an electronic or other medium and retrievable in perceivable form. These are U.S. statutory definitions, not universal definitions. 15 U.S.C. § 7006
How can a record be “virtual”?

In a healthcare example, New Zealand’s Hira programme business case describes a virtual electronic record made possible by linking existing electronic medical record systems and data repositories as needed. That kind of virtual view can make information from multiple sources accessible together without claiming that it has all been moved into one central patient record. A named, longitudinal programme record
A different use appeared in a 2009 U.S. congressional hearing about the proposed Virtual Lifetime Electronic Record (VLER). Testimony described it as a longitudinal record combining health and administrative data for current and future service members, veterans and eligible family members. Is a virtual record stored in one place?
Not necessarily. A virtual record may be a view assembled from connected source systems, as described for Hira, rather than a single consolidated repository. The term alone does not tell you whether information is copied, linked, retrieved on demand or maintained as a persistent record. To understand a particular system, check its documentation for where the source data reside, what is brought together, and who can access it.
Is an electronic record the same as a digital record?
These expressions can overlap in ordinary usage, but the sources here establish a specific statutory definition for “electronic record” under U.S. E-SIGN—not a universal legal distinction between “electronic” and “digital.” Avoid assuming that “virtual electronic record” means a cloud file, blockchain entry or electronic health record unless the relevant system defines it that way.

Does electronic form make a record legally valid?
No. Calling something an electronic record does not by itself establish that it has been signed, satisfies a particular form requirement or is legally effective for a specific transaction. Requirements can also be transaction-specific. Singapore’s Electronic Conveyancing and Other Matters Act 2025 sets additional conditions for certain conveyancing instruments, including use of a prescribed electronic transaction system and prescribed secure electronic signatures.
