India does not have one blanket rule requiring every business to keep all data—or all AI processing—in India. The applicable answer depends on the kind of data, the business’s sector and regulatory status, and every service that stores, processes, or can access the data. A key qualification as of 13 October 2026: the Digital Personal Data Protection Act’s main processing and transfer provisions, including section 16, are notified but not yet in force.
Does India require every business to store all personal data in India?
No. The general transfer framework in the Digital Personal Data Protection Act, 2023 (DPDP Act) is not a blanket localisation command. Section 16 allows the Central Government to restrict transfers of personal data for processing to a country or territory by notification. Section 16(2) also preserves any Indian law that provides a higher degree of protection or places a greater restriction on transfers.

That means the general framework and any stricter rules for a particular sector must be considered together. A business cannot assume that a general permission to transfer data overrides a payment, financial-sector, telecommunications, public-sector, procurement, or contractual restriction that applies to it. Nor should a business assume that a sector-specific rule applies to every company or every dataset. Scope depends on the entity, service, and data covered by the relevant requirement.
The distinction matters for AI because a company may send data through several services: an application, a retrieval system, a model, logging and monitoring tools, cloud storage, backups, and vendor support. A decision to use an India-based cloud region does not, by itself, establish that every relevant data flow stays in India or satisfies the applicable rules.

When do the DPDP Act and Rules take effect?
The Act and the DPDP Rules, 2025 were notified in November 2025 with phased commencement. Under the commencement notification dated 13 November 2025, the Act’s main personal-data processing provisions, sections 3–17, are scheduled to take effect 18 months after publication. Section 16 is among them. As of 13 October 2026, those provisions are not yet in force; the scheduled 18-month date is 13 May 2027.
The Rules also have staggered commencement dates. The schedule below reflects the notifications dated 13 November 2025; it is not a claim that the full regime is already operational.
| DPDP Rules provisions | Commencement set by the notification |
|---|---|
| Rules 1, 2, and 17–21 | On publication, 13 November 2025 |
| Rule 4 | One year after publication, 13 November 2026 |
| Rules 3, 5–16, 22, and 23 | 18 months after publication, 13 May 2027 |
Rule 23 is a targeted power concerning Significant Data Fiduciaries (SDFs). It allows the Central Government to require that personal data specified by it, together with associated traffic data, not be transferred outside India. It is not an automatic requirement that every SDF, much less every business, keep all data in India. The rule’s effect depends on whether a requirement is made and what data it specifies.

What is the clearest current example of data localisation?
The Reserve Bank of India’s (RBI) payment-system data direction is a concrete, sector-specific example. Its 6 April 2018 direction applies to authorised or approved system providers and requires the entire data relating to payment systems they operate to be stored in systems located only in India, subject to the direction’s stated treatment of foreign transaction legs.
RBI’s FAQ, dated 26 June 2019, explains that the scope reaches beyond a provider’s own infrastructure. It includes service providers, intermediaries, payment gateways, third-party vendors, and other entities engaged by a covered provider for payment services. The covered provider remains responsible for compliance even when it has engaged another organisation to handle part of the service.
The direction is about covered payment-system data, not every customer record held by every business that accepts payment. A company should establish whether it is a covered system provider, whether a vendor is handling data for a covered provider, and which data relates to the payment system before applying the rule to an AI workflow.
Does the RBI payment-data rule allow overseas processing?
Yes, within the specific limits explained by RBI. The FAQ distinguishes processing from storage: payment data may be processed abroad, but it must be deleted abroad and returned to India no later than one business day or 24 hours after processing, whichever is earlier. This is a scoped clarification under the RBI payment-data regime, not a general permission for any business to send any data to an overseas AI service.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
The RBI direction also recognises a limited foreign-leg case. Data for the foreign leg of a transaction may be stored abroad if required. For a cross-border transaction with both foreign and domestic components, the FAQ says the domestic component may also be stored abroad if required. These qualifications should not be expanded beyond the payment-data context or read as a general exemption from other applicable rules.
For a covered payment workflow, an overseas model or service therefore raises practical questions beyond where the model runs. The organisation needs to understand what payment data is sent, where processing takes place, how and when copies are deleted abroad, how the data is returned to India, and whether logs or vendor systems create additional copies. If the provider cannot demonstrate the required handling and timing, its location claims alone do not resolve the issue.
How do RBI cloud rules affect AI workloads?
RBI’s Outsourcing of Information Technology Services Directions, 2023 address cloud services used by regulated entities. Their cloud requirements focus on managing the full data lifecycle—from generation and entry into the cloud to permanent deletion—rather than treating a selected cloud region as the whole compliance answer.
For an RBI-regulated entity considering an AI workload, the directions call for attention to a documented cloud adoption policy, data classification, recoverability, regulatory compliance including sovereignty and storage, multi-tenancy, and the possibility of storage or processing across multiple locations. They also require the entity to address the shared responsibility model between itself and the cloud provider.

These are governance requirements for relevant regulated entities and their cloud use. They are not a universal India-wide rule that every cloud workload, AI model, or business dataset must be located in India. A regulated entity should assess the actual service design and its responsibilities; an ordinary business should not mistake the RBI directions for a rule that automatically applies to it.
How should a business map an AI data flow?
Start with the data and the business activity, not the AI vendor’s headline region. The following is a practical review method derived from the transfer framework, the RBI payment direction, and RBI’s cloud-governance requirements. It is an operational checklist, not a claim that every item has its own standalone localisation mandate.
- Identify the entity and service. Record which legal entity operates the workflow, what sector it serves, whether it is regulated or licensed, and whether the AI tool is being used for a regulated service. Check customer, public-sector, and procurement contract terms alongside applicable regulation.
- Classify the data before it enters the tool. Separate ordinary personal data from payment-system data and any other data subject to a sector-specific rule. Note whether prompts, uploaded files, retrieval indexes, evaluation samples, or fine-tuning datasets contain those categories.
- Trace the full path. For each data category, record where it is collected, stored, retrieved, sent for inference, used for fine-tuning or evaluation, and returned. Include model endpoints, application servers, cloud storage, and relevant subprocessors.
- Map copies and access, not just the primary database. Ask where logs, abuse-monitoring records, telemetry, backups, disaster-recovery copies, and support records are kept. Establish whether vendor staff or subprocessors can access data from outside India. A service’s inference location does not answer these separate questions.
- Check the handling rules for each transfer. Determine whether a transfer is permitted for the relevant data and entity, whether a more restrictive rule applies, and whether any specific storage, return, deletion, or timing condition must be met. Do not apply the RBI overseas-processing clarification to a different dataset or sector.
- Test the provider’s controls against the workflow. Obtain clear terms and operational information on retention, deletion, subprocessors, training use of submitted content, access controls, audit evidence, and incident support. Confirm that the stated controls cover the actual feature and service tier being used.
- Document recovery and responsibility. For relevant regulated cloud use, record how data can be recovered, how deletion is handled, and which controls belong to the business and which to the provider. Keep the decision tied to the data classification and architecture that were assessed.
- Reassess when the workflow changes. A new model endpoint, logging feature, subprocessor, backup location, or support arrangement can alter where data is stored or accessed. Review the map when those elements change and when applicable commencement dates or official requirements change.
This map should make a provider comparison concrete. For each option, compare the location of storage, inference, backups, logs, telemetry, and support access; the relevant data category and rule; any difference between processing and storage permissions; provider retention, deletion, subprocessors, training use, audit evidence, and incident support; resilience and access controls; and the customer/provider division of responsibility. No single configuration or provider statement guarantees compliance for every business.

What should a business ask an AI provider?
Vague assurances such as “India region available” are not enough to evaluate a data flow. Ask for answers that identify specific services and data handling, and retain them with the workflow assessment.
Best Value
- Which locations are used for prompt processing, retrieval, fine-tuning, evaluation, storage, backups, logs, and telemetry?
- Can support personnel or subprocessors access submitted content, and from where?
- Is customer content used to train or improve models, and which settings or contract terms govern that use?
- What retention periods apply to prompts, outputs, logs, and abuse-monitoring records? How is deletion requested and verified across copies and subprocessors?
- For an overseas processing path involving covered payment-system data, can the provider support the required return to India and deletion abroad within RBI’s specified window?
- What audit evidence, incident support, recovery arrangements, and allocation of shared responsibilities are available for the exact service being purchased?
These questions are useful because a provider’s public description may identify an available region without describing every copy, access path, or operational record. A contractual or technical answer should match the actual product configuration; otherwise, the business cannot confidently map the workflow.
Common mistakes to avoid
- Calling the DPDP Act a blanket localisation law. Section 16 establishes a government-notification mechanism and preserves stricter Indian laws; it does not itself require all personal data to remain in India.
- Treating notified provisions as already effective. The DPDP regime has phased commencement. As of 13 October 2026, sections 3–17 and the Rules scheduled for the 18-month phase have not yet commenced under the cited notification.
- Conflating processing with storage. The RBI FAQ’s overseas-processing clarification has specific return and deletion conditions. It does not remove the India-storage requirement for covered payment-system data.
- Assuming an exception travels across sectors. RBI’s payment-data treatment should not be applied to other data or businesses without a separate basis.
- Equating a cloud region with end-to-end residency. Inference, logs, backups, telemetry, support access, and recovery arrangements may have distinct locations and responsibilities.
- Assuming a vendor takes over the regulated entity’s responsibility. RBI’s payment-data FAQ says the covered provider remains responsible when it engages vendors for payment services.
How broad is the picture beyond the examples here?
RBI’s published overview describes localisation measures as concentrated in financial, banking, and payments sectors, followed by public-sector and telecommunications contexts. That is useful context, not a complete inventory of every current rule. The examples in this article therefore establish neither that these are the only relevant restrictions nor that the same requirements apply to every organisation in those areas.
The Government of India’s Press Information Bureau reported 6,915 consultation inputs in its 17 November 2025 backgrounder on the DPDP Rules. That figure counts reported consultation inputs; it does not measure support for the Rules, business impact, or compliance burden.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe statutory language that preserves stricter law appears in section 16(2) of the DPDP Act: “Nothing contained in this section shall restrict the applicability of any law for the time being in force in India that provides for a higher degree of protection for or restriction on transfer of personal data by a Data Fiduciary outside India in relation to any personal data or Data Fiduciary or class thereof.” For an individual business, the practical conclusion follows from that preservation clause: identify the rules that apply to its entity, data, service, and contracts before deciding where an AI workflow may run.
