In the United States, the response depends first on where the property is and which laws apply. On private or state land, local and state law govern discoveries and excavation first; there is no single nationwide private-property procedure. The federal Native American Graves Protection and Repatriation Act (NAGPRA) discovery process applies to federal and tribal lands, though NAGPRA may also affect certain Native American remains or cultural items removed from private or state land.
What happens when archaeologists discover human remains on private property?
The applicable state, local, and project rules determine whom to notify, whether work must stop, who may investigate or remove remains, and what deadlines apply. The National Park Service says discoveries and excavations on private or state land are governed first by local or state laws. It also notes that human remains or cultural items removed from private or state land may be subject to NAGPRA repatriation, depending on who controls them. That means an archaeologist, landowner, or construction manager should not assume that the landowner can decide unilaterally to move, keep, or dispose of the remains. Nor should they assume that the federal NAGPRA reporting deadlines automatically govern a private-land discovery. The exact procedure cannot be determined without the property’s state or territory and the circumstances of the find.
What should you establish first?
- Location: Identify the country, state or territory, and local jurisdiction. The specific contacts and legal requirements depend on location.
- Land status: Confirm whether the site is genuinely private or state land, or whether it is federal or tribal land. The federal and tribal NAGPRA process is distinct.
- Project connection: Check whether the work involves federal land, funding, or permits. These circumstances may affect whether NAGPRA applies, including in some cases involving private landowners or public agencies. See the National Park Service’s NAGPRA compliance guidance.
- Nature of the find: Determine whether the material is suspected to be human remains. If it is, follow the applicable local and state instructions rather than disturbing or removing it on your own.
How the federal and tribal process differs
For a discovery on federal or tribal lands, NAGPRA sets out specific reporting and protection requirements. The National Park Service says a person who knows or has reason to know of a discovery must immediately notify the appropriate official, make a reasonable effort to secure and protect the discovery, and provide written documentation no later than 24 hours after discovery. The documentation should give the location by county and state, describe the discovery, and explain the protective steps taken. This 24-hour deadline is for the federal or tribal process; it is not a nationwide private-land deadline. See NPS guidance on discovery and excavation.

When work may threaten a discovery
If an activity related to the discovery is taking place on federal or tribal land, activity that could threaten the discovery must stop. It cannot resume until the appropriate official issues written certification and the required notice period has been met. The responsible contact depends on the land: on federal land, report to the agency with primary management authority; on tribal land, contacts vary and may include the Tribe or, in Hawai‘i, the State of Hawai‘i Department of Hawaiian Home Lands. Do not apply this federal rule as a universal private-property requirement.
Excavation and decisions about disposition
Intentional excavation on federal or tribal land requires written authorization. On tribal land, written consent from the relevant Tribe or Native Hawaiian organization is also required. NAGPRA establishes priorities for control or disposition of Native American remains and cultural items, including lineal descendants and, in specified circumstances, Tribes or Native Hawaiian organizations. These rules are not a substitute for checking the separate local and state requirements that govern private land. See 25 U.S.C. § 3002 and the NAGPRA provisions in Title 25, Chapter 32.

What to do for a private-property discovery
- Identify the jurisdiction and land status. Establish the property’s state or territory and whether federal or tribal land, funding, or permits are involved.
- Contact the relevant state or local authority. Check the current state statute and official state archaeology or historic-preservation guidance for the responsible official and reporting instructions. There is no single contact or deadline that can be recommended for every private property.
- Protect the find while you seek direction. Avoid disturbing or removing suspected remains; follow the applicable authority’s instructions about securing the area and any work nearby.
- Confirm who may authorize further work. Ask the responsible authority what investigation, excavation, or construction may proceed and what written approvals are required.
State examples illustrate why local verification matters, not a national rule. Maryland Historical Trust says Maryland law generally governs human remains discovered outside the NAGPRA framework. New Hampshire law describes a role for the state archaeologist in arrangements with a landowner to protect or remove certain unmarked burials. Those examples should not be applied to another state: see Maryland’s NAGPRA FAQs and New Hampshire’s RSA 227-C.

Can construction continue after remains are found?
There is no nationwide yes-or-no answer for private property. The applicable state or local rules and any project-specific federal or tribal requirements determine whether work must stop and what approvals are needed before it resumes. The NAGPRA stop-work procedure described above is specific to threatening activity on federal or tribal lands; it should not be presented as the automatic rule for every private site.
