An acquisition does not, by itself, tell you whether your launch booking will go ahead, move to a new owner, or qualify for a refund. The answer depends on your signed agreement, how the deal is structured, whether the buyer formally takes on the mission obligations, and any required government or FAA action. Before relying on the existing plan, get written confirmation of who is responsible for your mission, what is changing, and what remedies you have if the plan fails.
Start with the entity named in your launch agreement
Find the exact legal name of the company that signed your launch-services agreement, then read the contract and every amendment. A brand name or public announcement may not identify the entity that owes you performance. In a stock purchase, the contracting company may remain the same legal entity under new ownership. In an asset sale or other transfer, a different entity may be expected to perform, and the contract may require consent or other steps before that can happen.

Look for clauses addressing assignment, change of control, consent, termination, delay, default, force majeure, and insurance. Check notice and objection deadlines, any long-stop date, and what the agreement says happens if the provider cannot perform. The relevant question is not simply whether the company was bought: it is whether the entity that remains legally responsible can and will meet the specific obligations in your agreement.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsWhat the acquisition structure can—and cannot—tell you
Stock purchase or ownership change
If the same legal entity remains your contracting party after a stock purchase, the contract may not have been assigned to a different company. That does not guarantee that the mission schedule, vehicle, funding, or operations will remain unchanged. Check whether your agreement treats a change in ownership separately from an assignment, and ask the provider or buyer to confirm in writing which entity remains liable.

Asset transfer, merger, or transfer to a new entity
If the mission business or contract is moving to another entity, ask whether the buyer has assumed the launch obligation and whether your consent is required. Do not treat a buyer’s announcement that it plans to continue launches as proof that it has accepted your particular contract. A written assumption, consent, or other transaction document may be important; the required mechanism depends on the agreement and applicable law.
U.S. government contracts are a separate case
For federal contracts, FAR 42.1204 sets out when the government may recognize a successor after a transfer of all, or the relevant portion, of the contractor’s assets. It says novation is not needed when a stock purchase leaves the same contracting party in place, in control of the assets, and performing. Ownership changes can still be documented formally. If the government does not recognize a transfer, the original contractor remains responsible and could face default termination if it fails to perform. These are federal-contract rules, not a universal test for private launch customers.
If your mission is under a NASA or other agency task order, contact the contracting officer about that specific order, the provider’s eligibility, and any required novation or ownership-change action. NASA describes its VADR launch services as firm-fixed-price task orders with FAA-licensed providers; the applicable task order and current program conditions are what matter for an individual mission.

Confirm the vehicle, site, and schedule in writing
An acquisition does not establish that your original rocket, launch site, integration plan, target date, or mission-assurance commitments will stay the same. Nor does it establish that the buyer may change those terms freely. Review the contract’s change-control, acceptance, delay, and termination provisions, and request a mission-specific statement of what is confirmed and what remains subject to change.
Ask for a revised schedule with the contractual milestones identified, not only a general target date. If a new vehicle or site is proposed, ask what technical, regulatory, and customer approvals are needed and whether your agreement gives you a right to object or terminate. Astra Space’s 2022 Form 10-K illustrates why contract language matters: Astra said some of its launch and space-product contracts allowed termination for convenience, sometimes with penalties that increased closer to launch, and described different treatment for customers moved from Launch System 1 to Launch System 2. Those were Astra-specific terms and circumstances, not rights that apply to every launch customer.
Check the FAA license separately from the contract
A corporate sale does not itself prove that the buyer holds the authorization needed to conduct a launch. Under 14 CFR § 415.13, the regulation states, “Only the FAA may transfer a launch license”; a proposed transferee must apply and meet the applicable licensing requirements. The FAA may use findings from the original licensing record and modify a license to account for a transfer. A sale announcement is not evidence that the FAA has completed any required action.

The FAA said on March 17, 2026, that commercial launch and reentry licensing was proceeding under Part 450, which consolidated four earlier rules and can cover portfolios of operations, vehicle configurations, mission profiles, and sites under one license. That licensing flexibility does not automatically transfer a license to a buyer or amend your customer agreement. Ask for the relevant license holder and status, and confirm with the provider what FAA action applies to the proposed post-acquisition mission.
Trace your prepayments and insurance obligations
Make a written accounting of every deposit, milestone payment, escrowed amount, credit, and refund obligation. Ask whether each amount remains with the original contracting entity, is assumed by the buyer, or becomes refundable under a specific termination clause. Identify which entity is liable if the mission is cancelled or the provider cannot perform; do not assume that a payment made before closing is automatically recoverable from the buyer.
Separately confirm who procures payload, transit, and launch coverage, and whether any policy details change. Check insured parties, coverage period, limits, exclusions, and the claims contact. A historical Motorola/NewCo/Boeing transition agreement illustrates that a particular launch-obligation transfer can make Boeing’s consent a condition, specify a payment consequence on cancellation or termination, set a prepayment deadline, and expressly allocate launch-vehicle and insurance responsibilities. That mission-specific agreement is not a market-wide standard.

Choose a path only after checking your contractual rights
There is no universal remedy triggered by an acquisition. These are possible approaches, not options every customer can demand; the contract and applicable law determine what is available.
| Path | When it may fit | What to resolve |
|---|---|---|
| Continue with the existing provider or buyer | The responsible entity is clear, the buyer’s assumption or consent is documented where needed, and the mission remains suitable. | Confirm the performing entity, schedule, vehicle, payments, insurance, approvals, and remedies in writing. |
| Negotiate revised terms | The mission may still work, but the vehicle, date, price, protections, or risk allocation is changing. | Document the changes, acceptance criteria, new milestones, payment treatment, and consequences if the revised plan is not met. |
| Terminate or seek another provider | Your agreement grants a termination, refund, default, or alternative-provider right that applies to the circumstances. | Check notice deadlines, penalties, refund timing, prepaid-fund recovery, and the time and cost of rebooking before acting. |
Questions to put to the provider and buyer
- Which legal entity signed my agreement, and which entity will be responsible after closing?
- Is the transaction a stock purchase, merger, or asset transfer, and what document makes the buyer responsible for my mission?
- Does my contract restrict assignment or change of control, require consent, or give me termination rights? What deadlines apply?
- Are the vehicle, launch site, integration plan, target date, and mission-assurance commitments unchanged? If not, what approval or exit rights apply?
- Who holds each prepayment, and who must refund it if the mission is cancelled or does not fly?
- Who arranges the relevant insurance, and are the insured parties, coverage, and claims contacts changing?
- What FAA license covers the proposed mission, who holds it, and what FAA action is required for the post-acquisition operator?
- For government work, what has the contracting officer decided about novation, ownership-change documentation, provider eligibility, and the task order?
- What written remedy applies if the buyer does not close, the provider stops operating, or the mission misses its contractual long-stop date?
For a live mission, have qualified counsel review the actual agreement and transaction documents before you consent, waive rights, or stop payments. The outcome cannot be determined from the acquisition announcement alone.
