First check what the signed order actually does and whether the GST Portal’s demand record matches it. If you paid an amount that is now refundable, make a separate claim in FORM GST RFD-01. Interest may be payable in specified circumstances, but it is not automatic.
What “dropped” means for your demand and payment
The outcome depends on the order, the portal record and whether you paid. An order may withdraw a demand, change its amount, quash it on appeal, or send the matter back for redetermination. A portal status by itself does not establish that the demand has been legally withdrawn or that a refund has been sanctioned.

| Situation | What to check or do |
|---|---|
| Demand withdrawn or reduced; nothing paid | Check that the electronic demand record reflects the order. If an amount remains shown as payable or recoverable contrary to the order, ask the jurisdictional GST officer to correct the record. |
| Some or all of the demand paid | Identify the payment and its tax, interest and penalty components. If the order supports repayment, apply separately in FORM GST RFD-01. |
| Order remands the matter for redetermination | Do not assume the dispute is finally over or that the full amount is refundable. Read the directions and check whether a fresh determination or another demand follows. |
| Appeal admitted and disputed balance flagged as non-recoverable | Treat this as a recovery status, not a refund approval or payment. A payment already made requires the separate refund process. |
The GST Portal’s appeal FAQ describes a non-recoverable flag for the balance disputed amount after an appeal is admitted. That flag does not itself return money. GST Portal appeal FAQ

Compare the signed order with the demand summary and electronic liability record. Under rule 142 of the CGST Rules, DRC-07 summarizes a demand; where an order uploaded on the system is rectified or withdrawn, the proper officer uploads a DRC-08 summary. DRC-08A relates to certain demands under existing laws. The relevant officer and portal entry determine whether the record has actually been updated. CGST Rules, including rule 142
#1 Best Overall
- Read the complete signed order. Note the authority, case reference, tax period, provisions applied, and whether tax, interest and penalty are each withdrawn or changed. Check whether the order directs a refund, an adjustment, or a fresh determination.
- Find the matching demand record. Compare the order with the DRC-07 summary and the electronic liability record. If an uploaded demand was withdrawn or rectified, check for the corresponding DRC-08 summary and corrected balance.
- Keep dated evidence. Save the order, downloaded portal records or screenshots, and any demand identifier. If the portal still conflicts with the order, send the order and demand ID to the jurisdictional GST officer and retain the representation or grievance reference. The cited rules do not establish one universal correction timeline.
How to claim repayment of an amount already paid
Refund is a separate process from dropping or correcting a demand. A person claiming refund of tax, interest, penalty, fees or another amount paid may apply electronically in FORM GST RFD-01. Attach the order and evidence that connects the payment to the demand, along with material supporting the refund basis. The required supporting documents depend on the category of claim. CGST refund rules
After examining the claim, the officer may issue FORM GST RFD-06 stating the amount sanctioned and any adjustment against an outstanding demand. If some or all of the claim appears inadmissible or not payable, the officer may issue FORM GST RFD-08; the claimant can reply in FORM GST RFD-09 within 15 days. Rejection requires an opportunity to be heard. A refund application therefore does not guarantee that the full amount claimed will be paid.
When interest may be due on a refund
Section 56 of the CGST Act sets conditional interest rules for delayed refunds. For a refund ordered under section 54(5), the general rule applies if it is not made within 60 days after receipt of the application; the notified rate cannot exceed 6%. A separate rule applies when a refund claim arises from an order of an adjudicating authority, appellate authority, Appellate Tribunal or court that has attained finality. If that refund is not made within 60 days after the consequent application is received, the notified rate cannot exceed 9%. These percentages are statutory ceilings, not confirmation of the currently notified rate or an automatic award in every dropped-demand case. CGST Act, section 56
For an order-based claim, whether the order has attained finality matters. The relevant start point for the 60-day period also depends on the statutory basis for the refund. Keep the application receipt date, any notices and replies, the order’s appeal or review status, and the date the money arrives. Confirm the applicable notified rate and the facts before calculating interest.
Why a GST proceeding may be dropped
Limitation is one possible reason, but it should not be assumed in another taxpayer’s case. CBIC Circular 185/17/2022-GST, dated 17 November 2022, describes specified cases where a section 74 notice cannot be sustained and is treated as a section 73 notice. In the limitation examples addressed by the circular, if the section 73 time limit is not met, the proceeding is to be dropped; the circular describes the relevant deadline as 2 years and 9 months from the annual-return due date, or from the erroneous-refund date where applicable. It also discusses redetermination where the time limit is met. This is a fact-specific explanation, not a universal limitation rule for every demand, period or proceeding. CBIC Circular 185/17/2022-GST
If the dispute is still at the appeal stage
The GST Portal’s appeal FAQ states a general period of three months after communication of an order to appeal to the Appellate Authority. Check the current deadline and applicable pre-deposit requirements against the law and your order before acting; the portal’s recovery flag does not resolve a refund claim. GST Portal appeal FAQ

Records to keep and when to get help
- The complete signed order and any appeal or review decisions.
- DRC-07, DRC-08 or other relevant demand records, plus dated portal evidence.
- Payment challans and ledger entries showing amounts paid by tax, interest and penalty component.
- The refund application, acknowledgement, any RFD-08 notice and RFD-09 reply, and the refund order.
- Evidence of any adjustment against another outstanding demand and the date any balance was credited.
Consider case-specific advice from a chartered accountant, GST practitioner or tax lawyer if the order is partial, remands the case, another demand remains outstanding, or a refund is rejected or adjusted. The outcome depends on the full order and payment record.
