Double Fine’s 2026 union petition was withdrawn, not rejected by the National Labor Relations Board (NLRB). The agency’s docket records that employees filed the petition on May 7 and that the NLRB approved a withdrawal request on May 20. Kotaku’s later reporting describes confusion over who belonged in the proposed bargaining unit, strained workplace conversations and personal conflict as factors in the drive’s collapse. Those explanations come from interviews and reviewed communications; the NLRB docket does not state why employees withdrew the petition.
What happened to the petition?
The NLRB’s San Francisco docket records a representation petition for Double Fine Productions Inc., filed May 7, 2026. The docket lists 42 employees and describes the proposed unit as regular part-time and full-time employees, excluding other employees, supervisors, guards and office clericals as defined in the National Labor Relations Act. The 42-person figure is the docket’s employee count; it does not mean all 42 were eligible for the proposed unit. The NLRB docket lists a withdrawal request and an approval letter dated May 20, with the case closed.

That is a withdrawal approved by the agency—not an NLRB decision rejecting the union or ruling on the campaign’s merits. The docket records the procedural outcome, but does not explain the employees’ reasons for withdrawing.

In an investigation published October 9, 2026, Kotaku said it interviewed 15 current and former employees, reviewed Slack messages and spoke with Double Fine CEO Tim Schafer. Its account presents several overlapping explanations, rather than one settled cause.

Disagreement and uncertainty about eligibility
Employees described uncertainty about which jobs would be included in the proposed unit. Kotaku’s reporting depicts Double Fine as having a comparatively fluid structure, with overlapping managerial responsibilities that could make role boundaries difficult to explain. Some interviewees said organizers could not give clear answers to direct questions about eligibility.
Some employees outside the proposed unit also felt excluded from a process they believed would affect their workplace. The petition’s proposed unit did exclude certain categories, including supervisors and office clericals, but the public docket does not identify the specific roles that were disputed. These are employee accounts reported by Kotaku, not findings by the NLRB.

Strained conversations and workplace conflict
Kotaku’s sources also described anti-union messaging, difficult conversations and personal conflict. Taken together with the eligibility confusion, those accounts suggest how disagreement over the unit and the organizing process may have fed distrust. They do not establish that any particular person or event caused the withdrawal, nor do they constitute an official finding of unlawful conduct.
A separate organizing effort in 2019
Kotaku also discussed an earlier organizing effort in 2019, including a meeting it described as heated; later conversations were curtailed during the pandemic. Game Developer’s summary likewise referred to the earlier effort and the pandemic’s impact. That history is context, not part of the May 2026 petition: the 2019 attempt and the 2026 case should not be treated as one campaign.

What Schafer said—and what it does not establish
In his interview with Kotaku, Schafer said he was generally supportive of unions and thought the games industry’s treatment of workers could create a need for protection. He also said he did not want to intervene in employees’ organizing conversations because he was the company’s CEO. Those statements describe his own views; they do not resolve employees’ accounts of the campaign.
In discussing the later layoffs, Schafer told Game Developer, “That’s definitely not the reason. We didn’t target people for layoffs.” That is his denial of a connection between the union campaign and the layoffs, not an independent determination of what motivated the decisions.

Were the organizers among the people laid off?
Yes. Kotaku reported that Double Fine laid off 23 employees on July 28, 2026, after the company’s departure from Xbox, and that all eight organizing committee members who signed the withdrawal letter were among those laid off. The overlap is significant, but the available reporting does not establish that union activity caused the layoffs or that the company retaliated against organizers. Schafer denied that organizers were targeted.
