Yes, a game can use AI-generated character voices, but the key questions are whose voice or recordings the system uses, what the performer has agreed to, and how the game will use and protect the resulting voice data. Treat permission for a voice replica separately from whether a particular AI output is copyrightable. In the United States, the answer can depend on the applicable contract and law; this overview is not a complete survey of state, international, or storefront-specific requirements.
Can I use AI-generated voices in my game?
There is no single rule in the sources cited here that answers this for every game. A synthetic voice that does not identify or imitate a real person raises different concerns from a replica of a recognizable performer, but neither the word “AI” nor a vendor’s ability to generate audio establishes that your project has the necessary rights.
Keep two questions separate:
- Voice and source-material rights: Who performed the recordings, who controls them, and what permission covers creating and using a replica? Check rights in the recordings and other materials as well as permission relating to the person’s voice.
- Copyright in generated output: Whether a particular AI-generated result qualifies for copyright protection is a different issue. The U.S. Copyright Office addresses that question separately from digital replicas and AI training in its AI report series.
The Copyright Office’s digital-replica report says existing laws do not provide fully adequate protection and recommends a federal response. That is the Office’s analysis and recommendation, not a new law or a complete account of current law in every jurisdiction. Its report series covers digital replicas in Part 1, published July 31, 2024; copyrightability of AI outputs in Part 2, published January 29, 2025; and AI training in a Part 3 pre-publication version dated May 9, 2025. Do I need an actor’s permission to clone their voice?
For production planning, do not clone or deploy a recognizable performer’s voice without clear written permission covering the specific replica and intended uses. A general recording release or permission to use a session recording may not spell out permission to generate new lines from a voice model. Have counsel review the rights and contracts that apply to the particular performer, recordings, production, and markets.

Check whether a union agreement covers the work
SAG-AFTRA says its 2025 Interactive Media Agreement includes consent and disclosure requirements for AI digital-replica use, and permits performers to suspend consent for generating new material during a strike. These are contract provisions for covered performers and productions; do not assume they automatically govern a non-covered engagement or apply identically to every deal. SAG-AFTRA reported that members approved the agreement by a 95.04% to 4.96% vote. That figure is the ratification vote, not a measure of AI-voice adoption or impact. Agreement terms can change. SAG-AFTRA announced a standalone agreement with Replica Studios in 2024 that covered consent, compensation, and licensed performer voices for interactive projects. Its FAQ, updated September 24, 2025, says that specific agreement is no longer in effect. A past vendor-union agreement is not proof of a provider’s current terms or of coverage for your game. SAG-AFTRA has also described consent and notice or bargaining provisions tailored to character voices in its animation agreements. Those provisions apply to the relevant agreements, not universally to every game or performer. Read the union’s explainer.
What should a game developer check before using an AI voice?
Use this checklist before recording, model creation, or production approval. It is a practical diligence framework, not a universal statutory checklist.

1. Identify the voice and everything used to create it
- Classify the plan: a novel synthetic voice, an imitation of a recognizable performer or character voice, an alteration of an actor’s recording, or a licensed digital replica.
- Inventory session audio, scripts, training material, prompts, model inputs, and third-party voice models that may contribute to the result.
- For each source, record where it came from, who performed or supplied it, and which rights or permissions apply. A model vendor’s access to audio does not by itself establish your project’s rights to use the voice.
2. Put permission and scope in writing
Make the permission specific enough to match the actual production plan. Address the project and character, platforms, territory, languages, duration, updates and downloadable content, marketing use, and whether new lines may be generated after the original recording session. Identify whether the permission covers only specified uses or allows additional uses, and define how approval, restriction, suspension, or termination works.
3. Agree on compensation, disclosure, and review
Set out how the performer is paid, what use is permitted, how use will be reported, and whether the performer can review or restrict generated material. Decide what disclosures are required for the performer, players, storefronts, or other parties under the applicable contract, market, and platform. The sources cited here do not establish one disclosure rule for every game.

4. Set rules for data, vendors, and model access
- Ask what recordings and derived voice data the vendor retains, for how long, and who can access them.
- Specify whether the vendor may use the material to train or improve models, and whether subcontractors can receive or reuse it.
- Define security expectations and what happens to recordings, derived data, and model access when the relationship or permission ends, including deletion or return where applicable.
- Get current vendor terms in writing. Historical agreement materials may show that safe storage and transparency were addressed, but they do not establish today’s requirements for a different provider or engagement.
5. Review the generated performance and keep a rights record
Check lines for recognizable likeness, unintended imitation, context, and performance quality before they ship. Maintain a record connecting the source recordings to permissions, model and vendor, generation process, approvals, and the content used in the game. Escalate proposed uses involving recognizable real people, deceased performers, legacy characters, or conflicting contracts for qualified legal and labor review.

Do I have to disclose AI-generated character voices?
There is no universal disclosure answer established here. For a performer and production covered by SAG-AFTRA’s 2025 Interactive Media Agreement, the union says AI digital-replica use has consent and disclosure requirements. For other projects, check the actual talent contract, applicable rules in each release market, and storefront or platform policies rather than assuming either that disclosure is always required or that it is never required.
