What Does “Level Playing Field” Mean? Definition and Examples

A level playing field means participants have a fair chance to succeed, without anyone receiving an undue advantage. Its precise meaning depends on context.

A level playing field is a fair situation in which everyone has the same opportunity to succeed and nobody has an undue advantage at the outset. The phrase is used in everyday conversation, business and policy, but what counts as fair depends on the context.

What does “level playing field” mean?

In ordinary use, a level playing field is a situation in which everyone has the same chance of succeeding. Cambridge defines it as “a situation in which everyone has the same chance of succeeding” (Cambridge English Dictionary). Collins’s British English definition likewise focuses on a competition in which no participant has an initial advantage (Collins English Dictionary).

The expression is figurative: participants do not have to be on an actual sports field. It describes the fairness of their opportunities or competitive conditions.

How is the phrase used?

Everyday situations

In everyday use, the phrase means making it fairer for people to succeed. For example: “The revised application process gave every candidate a more level playing field.” This is an illustrative sentence, not a quotation.

Business and competition

In business, a level playing field generally means companies can compete on their merits, rather than being unfairly helped or hindered by rules or restraints. The U.S. Department of Justice’s Antitrust Division says competition gives businesses the opportunity to compete on “price, quality, innovation, and wages” in an open market and on a level playing field, “unhampered by anticompetitive restraints” (DOJ Antitrust Division mission).

Policy and competitive neutrality

In policy discussions, the phrase can refer to competitive neutrality: applying neutral conditions to firms regardless of ownership, nationality or legal form. The OECD identifies state support and regulations that favour established businesses as possible sources of an undue advantage (OECD Competitive Neutrality Toolkit; OECD: Competitive neutrality in competition policy).

Equality and opportunity

When the phrase is used in discussions of equality, it can mean making opportunities fairer. But identical treatment does not always give everyone the same practical chance: a policy applied in exactly the same way can disadvantage people who share a protected characteristic. The Law Society of England and Wales distinguishes formal equality, or treating people in the same way, from substantive equality, which takes a broader, multidimensional view of outcomes (Law Society D&Ictionary).

Does “level playing field” have a legal definition?

There is no single, universally precise legal test supplied by the phrase alone. During UK parliamentary oral evidence, Professor Andrea Biondi said that someone seeking a “very tight legal definition” of the expression would “probably struggle to find one” (UK Parliament oral evidence). This was his view in a particular discussion, not a ruling that the phrase can never have legal significance.

In a legal or contractual context, the applicable obligation comes from the relevant jurisdiction and the specific statute, treaty, contract or policy instrument—not from the general expression by itself.

What should you check when someone calls for a level playing field?

The phrase expresses a goal, but does not by itself say what rules or remedies would make a situation fair. To understand a particular proposal, ask:

  • What advantage is at issue? Is the concern that one participant starts with an undue advantage?
  • Does fairness mean identical rules or a fair practical chance? The same rule for everyone may not account for different circumstances.
  • In a market, what affects competition? Consider state support, regulation, ownership, nationality or other conditions identified in the discussion.
  • If the claim is legal, what instrument applies? Identify the jurisdiction and the specific source of the obligation.
