Crypto exchange licensing means a company has permission to provide specified crypto services in a particular jurisdiction. It can bring duties for handling client assets, but it is not a guarantee that funds are insured or that every customer will recover assets after a failure. The rules depend on where you live, which legal entity serves you, and what service it provides.
What does crypto exchange licensing mean?
“Licensed” is a useful everyday shorthand, but laws may use terms such as authorized, registered, or permitted. Under the EU’s Markets in Crypto-Assets Regulation (MiCA), a firm generally must be an authorized crypto-asset service provider (CASP), or qualify through a specified regulated-entity route, to provide covered crypto-asset services in the Union. The requirement concerns defined services and entities; it is not a general quality badge for every product or brand. MiCA Article 59

Authorization in one jurisdiction does not establish permission elsewhere. A familiar exchange brand may operate through multiple companies, and different services may have different regulatory status. Check the entity named in your account terms and the specific service you use.

Licensing can impose concrete operating duties, but it does not remove the risks of holding crypto through a provider. Under MiCA Article 70, providers holding client crypto-assets or the means to access them must make adequate arrangements to safeguard clients’ ownership rights, especially in insolvency, and prevent using client assets for the provider’s own account. For relevant business models holding client funds other than e-money tokens, the article also requires safeguarding arrangements and separate identification of accounts. MiCA Article 70

These are legal duties, not a promise of a particular outcome. The provisions do not guarantee that every customer will recover assets after insolvency, hacking, fraud, operational failure, or a dispute.

Does a crypto license mean my funds are insured?
No. A crypto authorization is not, by itself, deposit insurance, a guarantee against loss, or a promise of full recovery if a provider fails. Do not infer that a licensed crypto exchange has the same protections as a bank deposit account. The rules described here set obligations for providers; they do not establish universal insurance or recovery for customers.
How do I check if a crypto exchange is regulated?
For a service in the EU, use ESMA’s interim MiCA register and check the relevant national regulator’s information. ESMA says register data is supplied by national competent authorities and the European Banking Authority; its MiCA page reported the interim register’s latest update as 24 September 2026. The register is a status-checking tool, not an endorsement of a platform or its products. ESMA MiCA page and interim register

- Find the legal entity. Check the company name in the exchange’s terms, account documents, or other official account information rather than relying on the brand name alone.
- Identify the relevant jurisdiction. Establish where you are located and which company operates the service for your account.
- Check the official register. Search for that entity and confirm that the listed permission covers the service you intend to use.
- Check the record’s date. If results are unusual or conflict with the platform’s claims, ask the relevant regulator to clarify the entity’s status.
- Read the account terms. Review custody, withdrawals, insolvency, and complaints information; a register entry does not answer every account-specific question.
A register result can help establish an entity’s status, but it does not tell you everything about how your account is handled or what recovery would look like in a failure. No particular exchange’s current status is established here.

MiCA is an EU framework; the UK has a separate regime and timeline. The UK Financial Conduct Authority (FCA) says its final rules, published on 30 June 2026, apply to firms granted permission under the Financial Services and Markets Act (FSMA) on or after 25 October 2027. Firms wishing to undertake new regulated cryptoasset activities will need FCA authorization under that regime. This date should not be confused with EU MiCA or treated as a statement that every current UK crypto activity already follows those final rules. No. Self-custody changes who controls the keys; it does not establish an exchange’s regulatory status. A hardware wallet can keep key access under your control, but you then take responsibility for protecting the recovery backup. Trezor’s Safe 3 product page describes PIN and passphrase protection and on-device confirmation; its terms warn that losing the device and forgetting the backup can mean losing access.
